Case summary

Basnti Mallik is a young married lady belonging to SC community. The accused Ajay Ranasingh of Maradhapalli under Kanas Police Station assaulted her near the bathing ghat of the village pond. On 30.3.2016 at about 5 AM when she had gone to the pond, the accused disrobed her, tightly embraced her and tried to rape her. She fell down on a thorny spot; the accused dragged his over the throne, bit her cheeks; she shouted at the peak of her voice. Ajay threatened to murder all member of her family if she disclosed the incident before anyone. Taking the advantage of loose grip, she ran to other 2 women near the pond. Seeing other persons, the accused went away. The victim was given clothes by the 2 women and she went back home. She complaint before the village committee; but after discussing among themselves they said that they won’t interfere in the matter. Hence she went to Kanas Police Station and lodged complaint on 31.3.2016. The complaint was registered as F.I.R No-44 dated 2.4.2016, under section 341, 323, 324, 354B, 354D, 506 of IPC & 3 of SC & ST PoA Act. The investigation of the case was completed and Charge Sheet No 87 was filed by police on 20.5.2016 under section 341, 323, 354(A), 354(B), 506 IPC & 3(i)(xi) of SC &ST PoA Act.

 

                     Surprisingly, no relief amount was paid to the victim for nearly a year. Hence the victims spouse contacted Sri Kissan Patnaik. Letters to different offices were sent, but the effects were not visible. Finally a paltry sum of Rs.22500/- was paid to the victim after one and half years which was not as per the Norms of Relief; hence a Fact Finding was conducted.
