Case summary

I am permanently residing at Arunthathiyar Colony, Keezhpachavur, Thandrampattu of Tiruvannamalai District. I belong to the Scheduled Caste Arunthathiyar community. I am married and have four children namely Vijaya (40), daughter Akila (26), Thanalakshmi (23), Pavithra (20) and son Vijayakumar (19). I work as a farm laborer.

48 acres of panchami land and there are around 150 families belonging to the dominant Hindu are residing in their village. The members of the above community are cultivating 2 acres or 3 acres and the members of the above community are cultivating and surviving in the Panchamiland. The Dalit families have been living in 10 or 20 sheet boats for three generations in the 5 cents area on the outskirts.

For the past two years, members of the Muslim community have been threatening to evict the Dalits. In this context, on 24.04.2020 at around 10.30 am, Dinakaran, Manivarma, Raveendran, Paunkumar, Prakash, Surya, Devendran, Kumar, Ravi, Arul, Mariappan and Tirupati, who belong to the Merpadilambadicaste (sub caste of most backward castes) resident of the same village, came together to build a barricade.

When Maniyarsauwent and asked them why they were doing such injustice, immediatelyDinakaranabused him in filthy language and brutally attacked him. Later Manivarma pelted stonesManiyarasana on the forehead, simultaneouslyRaveendran hit in the right leg, hip and right arm. Ravi, Kumar and Dinakaranhit Maniyarasan\'s brother on the left elbow and right finger. Paunkumar and Tirupati both slapped Maniyarasan\'s brother on the chest and right finger. Dinakaran, Prakash and Surya were stoned in the back by Maniyarasan\'s nephew.

Together they said they would demolish the house with the JCB machine and would not allow them to reside there. They had also threatened to kill them. The Dalit who had sustained severe and brutal injuries went to the Government hospital and received medical treatment as outpatients. The next day, on 25.04.2020, a complaint was lodged at the Maniyarasuthanipadikaval station with the crime no: 790/2020 u/s 147,148,294(b),323,324,506 (ii) – IPC r/w:3(1)(r), 3(1)(s), 3(2)(Va) – SC/ST POA Act  2015, 3 of PUBLIC PROPERTY (PRVNT OF DAMAGE ACT – 1992. The case was registered and 11 accused persons were arrested and bailed out.
