Case summary

That from last four years he  and his son Gurpreet Singh (Age- 18) were employed by Mewa Singh S/o Baj Singh, R/o Village- Alipur, tehsil- Zira, District- Firozpur who belongs to caste “Jatt Sikh” which is a non Scheduled Caste. They were employed as a “Siri” (Agriculture labourer). They were also taking care the 8 buffalos of the employer. That when they were employed by the employer they were given Rs. 1000 (Rupees one thousand) and 40 KG wheat as an advance. The  employer fixed the annual wages of Buta Singh RS. 40,000/- for first year, for second year 50,000/- and for third year Rs. 60,000/- and for the fourth year  the employer do not give him any information regarding his wages. For his son Gurpreet Singh the employer fixed annual wages RS. 25,000/- for first year, for second year 30,000/- and for third year Rs. 35,000/- and for the fourth year the employer do not give him any information regarding his wages.That when they started to work for the employer the employer give them 4 Marlas of land. The employer said  that from their fixed salary he will deduct the cost of the land which he has given to them. The employer said he will deduct Rs. 1,50000 (Rupees one lakh fifty thousand) as a cost of the land.That Buta Singh and his son were working from 4:00a.m to 8:30 p.m for the employer during the wheat and paddy transplantation the employer was extracting work from him day and night. On their many requests the employer was allowing him to go to their house only for one night after a week. The employer was not even allowing them to go to their relatives house on marriages. There was a marriage of Buta Singh’s nephew but the employer does not allow them to attend the marriage of his nephew. That the employer was not allowing them for any weekly rest or overtime. Whenever they could not attend the work due to any urgent work or sickness then the employer was charging them a fine of Rs. 500/-  per day and night and by adding this amount in the advance amount the employer was charging a interest on the whole amount as per his own wish. That the employer never pay the full  wages of  Buta Singh and his son whenever they makes many requests to the employer then hardly the employer pays them only Rs. 1000 (Rupees one thousand) so that they could buy some ration for their family and told them that he is deducting the amount of the land whenever it will finish then he will give them their wages but after four years work he never give  them their wages.
