Smruti Mallik is a 15 year old girl daughter of Bidyadhar Mallik of village Dandikira under Tulasipur GP in Nimapara Police Station area of Puri District. One Gopinath Mishra, nickname Gudu, S/o- Jatia Mishra of Keshereipur village, Police Station- Niali under Cuttack district was following her repeatedly and trying to trouble her for over 7 months. Nearly 4 months ago, Gopinath telephoned Smruti; being irritated she informed and gave the phone to her mother Urmila. Urmila asked Gopinath why he was repeatedly making phone calls to Smruti. Gopinath could not reply properly and handed over the phone to his mother. There was hot exchange of words and Gopinath’s mother abused Urmila aspersing her caste name. Following the incident Gopinath threatened over phone to kidnap Smruti.
On 5.7.2020 Smruti’s parent’s had gone out to attend a marriage function. Smruti, her younger sister and her grandfather were at home. At about 7 pm Smruti had gone to the toilet in their back yard. Gopinath and two other persons were hiding near the toilet. They put a Gamuchha (Towel) on Smruti’s mouth and took her forcibly to nearby field. There they tried to rape her. In desperation Smruti kicked one of the abductors and he fell down. Somehow Smruti escaped, ran back towards her home and fainted near their back yard toilet.
Smruti’s aunt and cousin found her there, rescued her and took her to Charichhak CHC. She was extremely shocked and unconscious. She was referred to Capital Hospital, Bhubaneswar. From there she was advised to consult doctors at AIIMS, Bhubaneswar. After going through treatment she returned home on 9.7.2020.
On 10.7.2020 Smruti described the incident of forcible abduction and attempt of rape to her mother. Her father immediately informed the matter to the Sarapanch. On the next day he filed a complaint in Charichhak Police Out Post. Initially Police did not register FIR. The matter was taken up by Ambedkar-Lohia Vichar Manch and a team conducted Fact Finding. During the fact finding the team met the IIC, Nimapara and FIR No. 156 was registered u/s 341, 294, 323, 354, 376, 506, 507, 511, 34 IPC, 3(1)( r )(s)(w) (i)(ii), (2)(va) SC/ST (PoA) Act. 1989 with 7 of POCSO Act.
