Coimbatore District, Udumalaipettai taluk, Thinnapatti union in Salaiyur village nearly 250 caste hindu families and 150 Arunthathiyar community families and 50 other caste family people also living in this village. On 06.06.2008 there is a celebration in Madurai Veeran temple festital. During that time Mr. Karthikeyan belongs to dalit community went Muthupandi Devar shop to drink a cool drink. That time unfortunately his hand was touched with Kumar (Belongs to Caste Hindu community ) hand. He was derogatory referred and abused in filthy words then he brutally attacked by his hand in many parts of karthikeyan body. He pulled Karthikeyan head and smashed in wall. Following that Kumar parents also brutally attacked Karthikeyan. After that Panchayat president Mr.Murugan was admitted him in government hospital. He lodge the complaint in police station.
Mr.Baldev Singh s/o Ronak Singh Village- Peron, Tehsil-Sardoolgarh, Distt-Mansa.Baldev Singh belongs to scheduled caste community. He was working as bonded labourer (Sirii) for the last 4 years in the farm of a Land Lord named Gurchet Singh s/o Karnail Singh r/o the same village. Besides,his routine to agriculture related work, Baldev also used to irrigate the farm during day and night. The mode of irrigation in the farm was a tube well operated by electricity with 3 phased motor. The starter of the motor comprising 3 insulated grips, one of the grip was broken and the electricity wire was exposed, the switch was not in good state for past few months. The condition of switch was brought to the knowledge of Suchet Singh by Baldev. But the Land lord , did not give attention for its repair, he continuously instructed Baldev to carry on the function of tubewell motor with broken switch. According to Baldev, a piece of wooden stick or a piece of stone was the instrument to make the switch/fuse on. On 2.6.2008 Suchet Singh instructed Baldev to go to the farm and irrigate the Cotton Crop. Baldev went to the farm, and as per routine, he caught a piece of stone and started doing the switch on, but that day, unfortunately, he met with a severe electric current, his entire right side was burnt, he was fallen down and was injured. After this incidence he was lying unconscious in the farm, a labourer working in the nearby farm saw him and informed Suchet Singh. Suchet, the Land Lord took him into a private nursing home in Mansa and hospitalized him therein for three days. As this was a seriously burnt /broken spine case which needed special /intensive and expensive Medicare in a good hospital. But Suchet Singh after three days brought him back at his home and gave few ointments and tablets to his wife and said that there was no treatment of him, and said, pray to God, God may cure him. VSJ staff visited Mansa on 5 12.08 and met Baldev Singh in the Govt. Hospital Mansa where he was lying hopelessly on the bed and struggling for his life for the last six month. Baldev said, his land lord (Suchet Singh) did not gave money for treatment and never came to see him. The doctors of Mansa Hospital say - this is a case of spine injury, the lower portion (hind limbs) of his body is totally senseless and the case can be properly treated either in PGI Chandigarh or in the AIIMS Delhi. Baldev being a very poor person is unable to afford the expensive treatment in these reputed hospitals. Baldev Says, my family is totally abandoned, my wife(Kulvinder Kaur) is staying with me in this hospital, my children(daughters –Karamjeet 14 years old,Amandeep 10 years and son Vijay Singh 12 years old) have left the School due to financial crunch. DDVA is supporting Baldev Singh to file a complaint against the employer. Now Baldev Singh is physically free and free from bonded dept.
Rajwati got married 15 years ago and has been living in the village Khatiwas with her husband and his family. Her husband Shyam Lal Valmiki works in mines nearby to their house. The villagers of Khatiwas to grind their wheat grains have to go to village Mayapur as there is no mill in their village and need to cross a jungle to reach Mayapur, which is around 2 kilometers away from their village.
On June 1st 2008 around 6 pm Rajwati went to Mayapur to pulverize the wheat at Karim Mave’s mill. She also took her mobile with her to charge it since there was no electricity in their village since 6 days. Rajwati got her work done by 7 pm. She was coming back with a bag of wheat flour over her head. Suddenly on the way, near the field of Joru Mave, Jamshed S/o Hanna Mave came in fronmt of her and seized her in his arms. She tried to release herself and beat him with slippers but to no result. The bag of floor slipped away from her hands. Jamshed forcedly took her into the shrubs in the jungle, and pushed Rajwati on the floor and clutched her mouth with a piece of cloth. Rajwati tried her best to release herself from his clasp but failed to do so. Jamshed stripped off her clothes and raped her. After raping her, Jamshed threatened her not to tell anyone about the incident otherwise she would have to pay for it again and he ran away from there. Somehow, Rajwati arrived home and narrated the whole incident to her husband and in laws. Then all of them went to culprit’s house but he absconded. Next day Rajwati and her family members went to the police station and lodged FIR against the accused. On 2nd June 2008 the local police registered her case no 222/08 under section 376 IPC and 3(1)(xii) and 3(2)(v) of SC/ST Act 1989 and sent Rajwati for medical examination at Govt. Hospital, Alwar for medical examination. Her clothes were seized and sent for FSL test. Police started searching for the accused and after 8 days, he was arrested.
On the other side, the family of the accused and whole Mave community started pressurizing victim’s family to compromise and not to pursue the case. Soon on 26th June 2009 the local police presented the charge sheet against the accused under section 376 IPC and 3(1)(xii) and 3 (2) (v) SC/ST Act.
Police registered the case and sent the victim for her medical examination and recovered victim’s clothes culprit’s clothes and broken bangles from the site. Police registered victim’s statement under 164 Cr.P.C. and arrested the accused on 10th June 2008, after 8 days of the incident. After investigating, police filed a charge sheet no. 148/08 against the accused under sections 341, 376 (IPC) 3 (i) (xii) and 3(2)(v) SC/ST Act, 1989. As accused was not arrested in time, victim’s family continuously received threats to be killed. But police failed to provide safety and security to the victim’s family. Accused and his family continuously pressurized victim’s family to compromise and withdraw the case but police did nothing in this regard. The administration provided a statutory monetary relief of Rs. 50,000/-to her for which she was eligible & entitled under the rule 12(4) of SC/ST (PoA) Act 1989. Administration did not provide travel allowance, daily allowance to the victim and other witnesses as per the rule 11 of SC/ST Act, 1989. Administration is under pressure of the accused community as they are dominant. Medical examination of the victim was done by the medical board. The medical officer did not give any opinion about the occurrence of rape and counted on FSL report. The accused was also examined medically.
Accused family is continuously pressurizing victim’s family to withdraw the case otherwise they will be killed. Due to this incident, Rajwati has confined herself in a room as whenever she goes out of the house, people see her with humiliation which badly affects her children also. She is still in trauma. She considers herself to be responsible for all that happened. The case is pending for hearing.
Village Lavan is seatuated in Diodar Taluka of Banaskantha District. The population of village is approximately 5000. There are people of different castes living in the village. For example Rajput, Dalit, Rabari, Trible, Suthar, Vania etc. There are 300 houses of Rajput community. They are domenant and powefull in the village. The village has school from 1 to 12 standards. The school has also got an Arts college. There are 80 families of Dalit community living in the village. Dalits are not allowed to enter in to the temple. They are not allowed to seat on a chair in Grampanchayat office.
On 31-5-2008 victim Manjulaben was sleeping in the night at her home, at that time accused Vaktabhai Dungrabhai Rajput and Jagatabhai Manjibhai Rajput both residing at Lavan, Ta. Diodar came there with a brown colour Car and forcefully raped her. And then the abused her and used abusive and filthy words to her against her caste. They also threatened her to kill, and then they ran away. There after on 1-6-2008 the victim filed a complained at Diodar Police station against the accused persons.
