Rape of a Minor Dalit Girl Udyog Nagar

    Rajpati Jatav belongs to Dalit community. She has faced poverty, discrimination and humiliation at every step of her life. Her father Daya Ram Jatav was a daily wages laborer but he lost his legs in some accident and now lives at home. Rajpati never went to school due to their poor economic condition and discrimination done with her by other caste people. She stays at home and helps her mother in daily household chores like cleaning, dusting, washing clothes, bringing fuel & fodder from jungle etc. On 7th February 2008, Rajpati, with her mother went to their fields to get some fodder for the cattle. At around 2 pm, when she was coming back from the jungle with a bunch of fodder on her head, the perpetrator namely Sumaan Singh came there from backside and caught her in his arms and dragged her in the mustard fields.  Rajpati was frightened with this sudden attack and started shouting. Sumaan Singh clutched her mouth with his hand and stripped off her clothes, opened his pant and raped poor Rajpati.

     

    Meanwhile her aunts Meena and Santosh were picking leaves nearby; they heard some noise and when tried to locate the place from where it was coming, they saw foliage waving. They rushed to the side where they saw Sumaan Singh lying over Rajpati. When Sumaan Singh perceived the two ladies coming towards him, he ran away leaving Rajpati in miserable condition. Her aunts made her wear clothes and brought to her grandparents on their way narrated everything to them. Rajpati came home with her grandparents and mother. This incident spread out like fire in the village. With the help of some villagers, Rajpati’s parents on the same day registered FIR No- 55/08 under section 376 IPC and 3(1)(xii) SC/ST Act against the accused. Local police registered their case and next day Rajpati was sent for medical examination. Police was informed that earlier also Sumaan Singh has been involved in these kinds of crimes with other women. When Sumaan Singh’s family came to know about the registration of FIR, they threatened Rajpati’s family to compromise and not to take further legal actions. After few days, when Rajpati’s mother Mrs. Son Dai was going to her farm, Sumaan Singh’s mother and sister threw stones over her and challenged her to do what they can. On 18th February 2008, Sumaan Singh was arrested.

     

    Police registered the case and sent the victim for her medical examination for age and rape. Police arrested the accused on 18th February 2008. The accused was also sent for medical examination, where his age came out to be between 16 and 17 years. Clothes of victim and accused wore at the time of incident were also seized as evidences and were sent for FSL testing.  Challan no.35/08 was submitted under court on 3rd march 2008. Victim’s sentence was recorded under section 164 of Cr.P.C.

     

    After the incident, culprit’s mother and sister blocked Rajpati’s mother’s way and threw stones at her and abused her in the name of caste but police was unable to take any action in this regard as the culprit was not arrested after a long period of the incident, thus culprit’s family forced the victim’s family to compromise and withdraw the case. They mentally and physically tortured and pressurized the victim’s family to compromise in the case. Police when informed about it did nothing in this regard and failed to provide safety and security to them. Administration provided her with a monetary compensation of Rs. 50,000/- for which she was eligible and entitled under the rule 12 (4) of SC/ST Act, 1989.

     

    The superintendent of Police ordered to arrest the culprit as soon as possible. If the culprit is not found, then his family members should be arrested. He assured the victim to help her in any case. Medical examination was done and the officer said that no opinion can be given regarding rape and counted on FSL report. Medical for examining the age of the culprit was done where his age was found to be between 16 and 17 years. The culprit’s family when informed about the incident by the villagers was terrified and instead of reprimanding the accused, blamed the villagers and abused them and threatened them to kill. After some days of the incident, culprit’s mother and sister blocked Rajpati’s mother’s way and abused her and threw stones on her. Victims alleged that culprit’s family made him to run away from there.

     

    Due to this incident, victim is in trauma. Now she is so threatened that she does not go out of her house. She has confined herself in home. She considers herself to be wholly responsible for what happened with her. Her family is very much tensed about her future. The case is still pending for hearing.

Rape of a Dalit Girl Alwar

    Alwar District is vastly populated with Ahir community. Raath Nagar is situated 172 kilometers from Jaipur, 12 kilometers from district Headquarter, Alwar and 2 kilometers from Shivaji Park Police station. Manju Devi is a married woman and has two children-a son and a daughter. She has been living in Plot No- 17, Raath Nagar, Alwar with her family. Her husband, Jai Dayal Singh has been working in military laundry for 11 years. He used to go in the morning at 7 and come back at 6-7 P. M. in the evening.  One day Manju was suffering from fever, her husband was not at home so she went alone to the clinic situated nearby her home across the road. Satish Kumar who is not a qualified doctor was running that clinic. After examining her, Satish told Manju that he will come to her home and give her medicine. Counting on his words, innocent Manju came back. At round 11:30 am, Satish came to her home, checked her fever and told her that she needs an injection.  As Manju was unaware about his ill intentions, she agreed for injection. Satish injected some sedative drug and soon she started losing her consciousness. Then Satish stripped off both of their clothes and raped her and took her nude pictures to blackmail her. Manju tried to protest him but due to intoxication she couldn’t. He threatened her to kill her husband and son and to expose her nude photographs if she will speak out about this incident and went away from there. Thus she did not tell anyone, not even her husband about it.

     

    One day Satish called Manju and informed her that he is sending an Indica car and called her to Amrit Hotel, Alwar but Manju denied to go there. The culprits wanted to force Manju into prostitution. Then Mrs. Suman wife of Satish and Manisha his sister in-law came at her home and threatened her to obey them or her husband and son will be killed. The perpetrator deployed an Indica Car No- R.J. 02 CA 2636 which followed her every day wherever she went. Manju got depressed with all that and told about that car to her husband but not about the rape. Jai Dayal and Manju both went to the police station to register FIR against the perpetrators and to give the number of the car. But even then Satish didn’t stop threatening her. When everything went beyond her control, Manju told everything to her husband after 1 ½ month from the date of incident. Her husband fully supported her and tried to talk to the perpetrators but to no result. Instead of stopping, Satish and his companions started threatening Manju’s husband while saying that they will abduct his wife and he would not be able to do anything. 

    Finally Manju and her husband took help of the local police and registered a case against the perpetrators. Soon police arrested Satish, but on the other hand Satish’s family still threatened Manju and one day detained her on the way but somehow Manju rescued herself by hiding in Parshad’s house. Satish’s wife and others pressurized Manju Devi and her family to compromise. 

     

    The challan was submitted in the court. The administration provided only a partly relief of Rs. 50,000. Manuj’s statement was recorded under section 164 Cr.P.C. Accused was arrested but later on was released on bail. The case continued for sometime but due to pressure Manju compromised with the accused. Thus the Court due to benefit of doubt, released Suresh and acquitted him of charges. Accused and his family, all were engaged in this heinous crime. They continuously threatened Manju and her family to withdraw their case. They threatened Manju’s husband to abduct Manju if he will take any action against them.

RAPE OF A DALIT WOMAN Guntur

    Mariamma was working as an agricultural worker.  On 04.02.2008, while she was about to go to work, servant of Taapula Rayappa Reddy, aged 57 years, OC Reddy by caste came and said that Rayappa Reddy’s wife has gone to her parents’ place and hence asked Mariamma to clean the utensils.  While she was cleaning the utensils in Rayappa Reddy’s house, he entered the kitchen, bolted the door from inside and raped her.  He asked her to keep quite by taking Rs. 500/- and threatened her that he would kill her husband if she reveals the incident to anyone.  She did not reveal the incident to anyone on that day.  Next day, i.e., on 05.02.2008, she narrated the incident to her husband at around 06:00 am.  He beat her after listening to the incident.  Her in-laws immediately informed the incident to the village elders.  They complained in the Pedakurapadu PS.  Police sent the victim to hospital for medical examinations. Case was registered.

Attack on a Dalit Family and Their House Destroyed

    The incident happened on 02.02.08 at the village of Mahua comes under the jurisdiction of Jumhare Police station in Aurangabad District. At around 5 a.m. Lakshmi Devi w/o Basant Ram and her mother in law Radha Devi w/o Dhaneshvar Ram belonging to Dalit community (Chamar). Krisna Sav, Kunder Sav, Raju Sav, Suresh Sav, Upendra Sav, Sudhir Sav, Balinder Sav, Kanhai Sav, Dileep Sav, Deena Sav, Dinesh Sav, Ramesh Sav belonging to Non Dalit community from the same village started abusing them.

     

    When Lakshmi Devi asked them to leave them alone, Dileep Sav grabed her and tried to rape her. Lakshmi Devi tried to save herself by struggling with Dileep Sav at which point Raju Sav pulled out a pistol and began beating Lakshmi Devi with the butt of the pistol on the arm, shoulder and waist. She was badly injured and her whole side got bruised. The commotion woke Basant Ram s/o Dhaneshvar Ram, Lakshmi Devi’s husband who came to the doorway to rescue her and was also beaten brutally with sticks and abused. In the meanwhile, Upendra Sav brought Kerosene oil and set fire to Lakshmi Devi’s house. Her family ran out and too was beaten badly.

     

    On 09-02-08 F.I.R. was filed u/s. 341,323,225,436 of the I.P.C. and 3(x) of SC/ST (PoA) Act, 1989. So far the victims have not received police protection, and no police officer has begun investigation of the case. No Compensation has been given to the victims.

A Dalit Youth Was Tortured in Police Lock up in a False Charge of Manufacturing Country Made Liquor

    Ladbai (45) w/o Murarilal Kanjar, Aswini Kanjar (25) s/o Murari Kanjar are r/o Vill/P.S. Choth Ka Barwara, Sawai Madhopur Dist. Police officials under the influence of liquor caught Aswini s/o Ladbai and put up him in the lock up. When Ladbai protested against this, a police slapped and tried to outrage her modesty by pulling her saree. Next Day, a group of 100 people from victim’s community went to the Superintendent of police and made a complaint. As a result, Aswini was released but the police did not register FIR.Through the intervention of court the FIR was registered on 17 Jan, 08.  

     

    On 29h Jan, 08, when Ladbai was out for some work, the police took the opportunity to put Aswini in the lock up again and threatened Ladbai by saying that she should compromise or else they would book her son in false case. When Ladbai refused, police booked Aswini in a false case of manufacturing country made liquor.  Ladbai went to the court and got bail for his son.

     

    Victims filed a complaint under 190(1-B) of Cr. PC, Dated 17.1.08. u/s 147, 323, 341, 354, 509,506,451,510,330,149,IPC. No action taken against the police officials by district or State authorities.
