Gang Rape of a Minor Dalit Girl Dausa

  • Summary::

    In general, Dausa district is constituted by majority of Meena, Rajputs and Brahimins community. These communities are more powerful and have enough means to exploit Dalits to any extent. Seema (Koli, Schedule caste, 14 years), her father Mohan Lal Koli (42 years), mother Shanti Devi (34 years) and her two brothers Kamal Kumar (20years) & Hari Singh (18 years) are landless and earn their livelihood by working as a daily wages laborer. 

     

    Seema was a student of class 8th in State Government Girls Senior Secondary School in Mahua. At the day of incident on November 1, 2006, she was going to her school and the accused namely Pawan Kumar and others were standing beside the Ganesh Temple. Suddenly they caught her and put a handkerchief with some anesthesia on her face, soon Seema fell down unconscious. Pawan took her to some deserted house and raped her. Seema was unconscious while all the accused raped her. They left her there and ran away. As Seema regained her consciousness she found herself in naked position in some house and felt so much pain and blood was oozing out of her genital parts. 

     

    Somehow Seema wore her clothes and went home. Seema informed her parents about the whole incident. Her father went to Pawan’s home, who raped her and talked to his father but instead to help them out, Pawan’s father abused them in the name of caste and said that lower caste people deserve this kind of humiliation and threatened them not to tell anyone about this incident otherwise it will tantamount to be fatal to them. Seema’s father was a gentleman and because of fear of defame in society, he did not go to the police station to register F.I.R against the accused. But next day with the help of some villagers, Seema’s father went to the police station to register F.I.R but the accused and his miscreant followers caught him on the way and brutally beaten him up with arms and sticks which  caused grievous injuries and fracture in his left leg.

    But Seema’s father didn’t give up and somehow reached the police station and registered an F.I.R against the accused. After registering his F.I.R, Seema’s medical examination was done. Soon accused and their community members started pressurizing victim’s family and called Panchs of Koli community to pressurize her family to settle the matter outside the court. The Panchayat of Koli community called Seema’s father and suggested him to compromise with the families of the accused in spite of the tears of Seema for the injustice done with her which spoiled her whole life; and she was oppressed to live with a stigma that she had filed a false allegation against the accused just for money and compromised for money. At last unwillingly they changed their statement before the court and compromised with the accused.

     

    In this case, police registered the case under section 376, 323 & 328 Indian penal code read with section 3(1)(xii) of the SC/ST (PoA) Act 1989. Next day of filing FIR, medical examination was done but on the other hand local police of Dausa failed to provide safety and security to Seema & her family which resulted in compromise besides the crying of Seema for evenhandedness and Justice. Although medical examination was done next day of F.I.R but it was already delayed. The overall report reflected that when the miscreant established illegal relation with the victim, she was unconscious. 

     

    The administration did not provide compensation to the victim not even a single penny was given to Seema in the name of compensation. The challan was submitted before the court charged under sections 363, 366 A, 376 (2) IPC and section 3 (2) (v) of SC/ST Act, 1989 and soon accused was released on bail but during trial, Seema and her family due to pressure of the accused and their community changed their statement and denied the occurrence of Rape. On the basis of their statement the presiding Judge, Gordhan Lal Meena discharged the accused from the charge and pronounced the judgment on 21-02-07 in the favor of accused. Seema’s family compromised with the accused.

Murder of a Dalit in Malpura

  • Summary:: On the evening of 23rd October 2006, around 4pm Kallu Ahirbar(38) S/O-Bithaldas Ahirbar , along with his wife Champa Ahirbar (35), son Ramashankar Ahirbar(13), Sanjay(5), Niraj(3) daughter Roshni (11) , all were in the field .While they were standing near the well of the field, four person Ramakrishna Tiwari, Ramasre Tiwari, Asaram Tiwari and Ranu Tiwari, came to them. They were all with dangerous weapon. Ramkrishna said to Kallu in the name of caste we will kill you today and attacked him with the axe, Ramasre and Ranu beat him with rod and asaram put axe on him, when he fell down they all together attacked on him they cut down his left hand and right leg, they injured him everywhere with axe. When his wife and son Ramashankar came to save him they also attacked him they injured Rama Shankar on the neck and he fell down they injure Champa on the head and Roshni on the face and nose and then thrown the five year old sanjay. And while going from there they said we will kill your brother and went away. Kallu and his family were there and nobody comes to help them up. So Kallu shouted and called for help and then from the neighbor field Harischandra Kusbah came there so I tried to pick up Kallu and he was not able to stand up and he slowly took Kallu to a field nearby the road and left him there and flew away because of the fear. They were laying there till 9pm, at 9 pm police came nearby the place and then they were shouting and calling for help, so police came there. Manoj Tiwari, Sandeep Patriya, Pankaj Patriya, RamKishore Patriya and Ashok Misha came there with the police. Police brought them in the Vehicle to Chhatrapur Hospital and admitted. Whereas on the same day around 4.30pm Jayabai wife of Ramdas Ahirbar.was in field and in her house her husband Ramdas, her son Rabidas ans Mother in law Chaturiaya were there. One boy of the village informed her that they are killing her husband Ramdas. When she ran home and saw that his both eye and intestine was out he said that Ramkrishna Tiwari, Ramasre Tiwari, Ranu Tiwari and Asaram Tiwari had done this to him they shot him in the gun and his intestine came out they took out his eyes with axe and chopped his palm and foot. When she saw her husband in the condition she had her head reeling and fell down oh Ramdas and cried for help but nobody came to her after a while the village sarpanch came there called police and after 2 hour police came and they came to know that the accused also injured Kallu and his family. Police took Ramdas in the vehicle to hospital and he died on the way to hospital. The next day because of not getting timely and proper treatment Kallu Ahirbar‘s son Ramshankar died in the hospital. Kallu and his family are suffering in the hospital and they have not received any compensation. The reason of the conflict is 30years ago Kallu’s father Bithaldas Tiwari had bought 5 acres of land from Nadan Tiwari father of Ramkrishna Tiwari. Bithaldas has died since last 10 years. Accused Ramkrishna and Ramasre had killed their uncle in 86-87 because of land issue and were in jail for last 17 years and had come out before three years. Once the accused came to Kallu’s house and asked to return back their land then Kallu said my father had bought the land from your father and have registered in our name we are cultivating in the land since years so we will not give back. Then the accused abused then in the name of the caste and said you give back the land otherwise we will kill you whole family. They wanted to report the incident to police but people in the village suggested not to report so they did not report. But since then the accused keep on threatening Kallu and his father. With the fear once they tried to negotiate with the accused and offered them another land but the accused did not agree. Again this year before Dusserah the accused had come to the victim’s house and threatened them to give the land back otherwise they will kill them and burn their house. But the victim’s family did not complain about it thinking that they won’t do such thing.

In Connivance with the Perpetrators, Police Tortured a Rape Victim and Her Family

    Nalanda District in the state of Bihar is a hub of rapes and murders of Dalit men and women. The land of Buddha turns out to be the curse to Dalits in Rajgir where Lord Buddha got enlightenment. A newly married couple Harikumar Das (21) and his wife Rimi Devi (18) were happily living there at Rajgir. They had just married on 2.10.2006 in a temple. The new family did not any kind of enmity with others.

     

    However, 17th Oct, 2006 brought a terrible event at their fate. Rajesh Singh s/o Suresh Singh, the perpetrator came with 5 of his friends in their house at 10.30pm when Harikumar Das was fanning himself outside the rented house. When he saw them in his house he boldly questioned them of their being there at late night. This angered the perpetrator Rajesh Singh. He abused him and his wife saying, “you bastard how can you enjoy alone having sex with Rimi?” Harikumar Das responded to him saying that Rimi is his wife and so he has the right to have sex with her. Anyhow they have the consent with each other by oath. Rajesh started beating Harikumar Das and his wife, looted jewelries and 15,000 rupees, dragged them out of the house, and took them to a nearby house and put Harikumar Das and Rimi in separate rooms. They stripped Rimi naked and tried to rape her but hearing her shout Harikumar Das came out of the room and ran to save her. He then was kicked out and brutally beaten up.

     

    Thereafter the perpetrators dragged them to the petrol pump cabin owned by Rajesh Singh the main perpetrator. They all raped Rimi one after the other and ran away from the place leaving them outside the cabin. She was unconscious. When she came to the consciousness, her husband covered her body and brought her home. The perpetrators threatened them that if they make complaint to the police they too will rape her because they are giving petrol to the police free of cost and pay 25 thousand rupees to them every month. They are confident that the police is under their grip. Hence the victim Rimi went to Bakhtiyarpur, her mother in law’s place and narrated the whole incident. Her mother in law Sumitra Devi w/o late Bhola Das who works in the Ganesh High School at Bakhtiyarpur took her to Rajgir police station and lodged FIR. The police over there mentally tortured Rimi asking her not to mention the name of the perpetrator Rajesh Singh. With great difficulties the police registered the FIR no. 364/06 registered on 22.10.2006 u/s 342/ 323/ 379/ 376/ 504/ 34 IPC. On the same day they took her to Civil Hospital, Biharsharif for the medical report. The perpetrator Rajesh Singh is so influential that the doctors gave the reports in favour of the perpetrator. From there she was back to her mother in law’s house.

     

    Till now the police have not arrested even a single rapist instead in connivance with the perpetrators the police are torturing the victim and her family. The father of the main accused, Suresh Singh is constantly defending his son. He states that the victim Rimi is a prostitute. No matter some people might have raped her and she wants to trap his son.

21 Dalit Shot Dead Over Land Dispute

  • Summary:: Village Chamal pur falls under the jurisdiction of Police station Bahariya, Distt. Allahabad. Village is 30 away from the district head quarters. The population of the village is 3700 it comprises of the people from all the caste inclusive of Pasi, Chamar, Dhobi, Masahar, Khatik, Yadav and Kumhar. 500 metres away from the village a piece of Land on PATTA has been allotted for 7 Dalit families of which 4 are Pasi namely , Sita ram , Ram dhan ,Late Ramjatan , Bhuwar and 3 are Chamar by caste namely Banwari, Sahatu, Manik Chand Ruchiram. On the afternoon of 11.10.06 at around 2.30 P.M, Lal Bahadur S/o Mahadev and his family members started constructing a house on the land of Dalit. This reached the Dalits and they immediately rushed to the Sikandrabad Police Station to lodge the report. Instead of lodging the complaint police officials discouraged and demoralized them. From there Dalits came to the land in question and requested perpetrators to stop the work. They also showed them the stay order of the court but the Yadav community started abusing and threatening by way of firing gun shots at them .During this firing 21 dalit got injured. Police officials came after long delay .Police officials are not cooperative towards the victims. Rather they are discouraging the victims. No arrest has been made so far. To the utter surprise only two police officials came to the incidence place. No police official came for the help .No compensation and protection is given by the administration. Victims are still receiving threats from the perpetrators. FIR has been lodged in the case.

Attempt to murder of a Dalit following past enmity- Badera village

  • Summary:: Suresh Kumar aged 21 s/o Boxiram is a resident of Badera village, Thesil Haroli, District Una, H.P and belongs to Scheduled Caste (Chamar) community, professes Hindu religion. On 7th June 2010 he along with his friends went to a nearby village Kangar which is about 3kms away from his village to watch a religious program. Sanju, Vinod and Rajkumar who belonged to Bhati (O.B.C) caste of Kangar Village of his village were also present there. As soon as the three saw Suresh Kumar they started abusing and beating him. On seeing this, the friends of Suresh Kumar went to the spot to rescue him, however within a few seconds Sanju stabbed him with a knife and ran away. The friends of Suresh immediately informed his parents and rushed to a nearby district hospital to admit him. Suresh’s friends lodged complaint in the Thesil Haroli Police Station and an F.I.R was registered u/s 3(2)(i) SC / ST (PoA) Act & 307, 324, 506, 34 IPC. The next day all the three accused were arrested. During investigation it was found that 3years ago Sanju, Vinod Raj Kumar were the class mates of Suresh and they had small school fight which led to take revenge on that day. Victim receive compensation Rs. 1,50,000/-. Case is running in the District Court.
