Wrongfully occupied the land of a Dalit woman in Lakhan Saraya village

  • Summary:: Banarasi Devi (40) w/o- Suresh Paswan is a dalit belongs to dusadh community and a resident of village Lakhan Saraya village in Vaishali district in Bihar. Banarasi Devi’s grandfather in law was given a land for free by Village head Kamal Pandey. But Kamal Pandey’s brother Rameswar Pandey had sold the land to Mahesh Saha. On 29.11.2005, when Banarasi Devi was working at home, Mahesh Saha and Bhanu Saha came with spade to the field of Banarasi Devi to plough the field. Then Banarasi Devi objected them to plough the field and said I will allow you to do anything after government order only. Then Mahesh Saha started to abuse her in the name of caste and Bhanu Saha tried to hit her with the spade. By the time Renu Devi a relative of Banarasi came to her help and held the spade and she got hurt in the stomach with the spade.(Renu Devi was 8 months pregnant and doctor said the baby inside her moved down because of the attack so she has to be under supervision till the delivery). Mahesh Saha then put Banarasi down on the ground and hit her severely when she became unconscious Maheseh was taking her. Buy the people reached there and protested so he left her on the ground and left. When Banarsi Devi regains her senses she went and filed FIR. But the accused is threatening the victim to kill them.

    Banarasi Devi, 45, w/o Suresh Paswan, 50, belonging to Dusadh(SC) caste, at Lakhan Sarai, Patpata PO, Lalganj Ps., Vaisali Dist., Bihar was a politically conscious lady and strong supporter of LJP( Lok Janshakti Party). Her village is dominated by the Non-Dalits esp. Bhumihar, Pandit, Yadav, Kurmi, etc. She fought for her right to have land because and her family lived there for many years. The ancestors of Suresh Paswan stayed there hundreds of years ago in the same land.

     

    The Non Dalit village members mobilized Kamal Pandey (Teli upper caste) who was a landlord, against Banarasi Devi. And so the main accused, Kamal Pandey had sold the plot of land to Mahesh Sah (Bhumihar caste) very cunningly because he was the supporter of theBJP(Bhartiya Janata Party). He did not like her to live there. And so there were a number of quarrels occurred. Mahesh Sah and his son Bhonu Sah, 20, did not want her to stay in the village. 

     

    On 29/11/2005 while Banarasi Devi w/o Suresh Paswan, was busy doing her household work, Bhonu Sah and Mahesh Sah came to plough the plot of land. Bhonu Sah started digging the ground with a spade. When the victim tried to stop him doing so till the order from the government comes she would not allow them plough the field. He abused her for being a prostitute. He started destroying her hut, by then Renu Devi, her sister in law who was pregnant for seven months came and on the process of stopping him, got hurt in her stomach with the spade. She ran back home. Then Bhonu Sah striked Banarasi Devi down and put his knee on her breast and started beating her. As a result she fell unconscious. Then he tried to carry her away to rape her but stopped by the villagers. In spite of that he managed to run away with the three of her he goats and two hens.  On the same day when she came to the consciousness, she went to the police station and filed the FIR no. 246/05 under the sections 147, 148, 447, 323, 392 IPC and SC/ST POA ACT section 3 (10). Arwind Kumar Shahi, SI, inquires the case in Hajipur police station. No compensation has been given. The case is being inquired. No charge sheet and case diary are presented to the district court.

CHEATING Anaparti

    Case in Brief:

     

    Anaparti mandal of the East Godavari District is the adobe for Reddy.  People from this caste dominate all other castes.  Their main occupation is finance.  They go to any extent to extract interest from the debtors. 

     

    Tetali Radha Reddy, brother of Tetali Rama Reddy, local MLA, has control over all the issues in the mandal.  The accused, Tetala Rajesh Reddy is relative of this MLA.

     

    Details of the Case:

     

    Oleti Satya Kala (19) is the victim in this case.  She has come from a poor family.  Her father is an agricultural labourer.  Of the three daughters, Satyakala is the youngest.  Her elder sisters are married.  She was studying staff nurse training in the GBR College.  The accused, Tetala Rajesh Reddy, second son of their parents, was studying B.Com 2nd year. 

     

    He always tried to talk to her and get close to her.  Soon he was well acquainted with her.  He always threatened that he would attempt suicide if she denies his love.  She tried to persuade him a lot but in vain.  On November 16th, 2005, he came to her and said that they should elope and get married.  He also said he brought money from home.  She did not agree in the beginning but he threatened that he would attempt suicide in front of her college if she did not come with him. 

     

    Then they went to Rajahmundry and from there they went to Bhadrachalam and got married in a temple on 17th November, 2005.  Next day they went to a rented house.  Both of them worked in a retail shop.  Later he found a job as supervisor in a hotel for Rs.2, 000/- and asked her to discontinue her job. 

     

    They lived happily for all this while, but his friend, Shiva Reddy, who kept visiting Bhadrachalam on business matters, happened to meet Rajesh Reddy.  Since then Rajesh Reddy started to continue contacts with his parent.  They always wanted him to come back and get rid of his wife for she belonged to SC caste and moreover he would have got more dowries if he married a girl from their community. 

     

    Once the victim tried talk with the accuser’s mother on phone. His mother abused the victim and threatened her leave her son.

     

    Finally one day the accused said that MLA has a job with attractive salary for him and that he would go first and return in four days and take her with him.  He took his certificates, photos, dresses and all his belongings.  She waited for 3 days but did not get any information from him. Unable to answer her neighbours, incapable to return to her parents; in helpless condition she attempted suicide by consuming pesticide. 

     

    Her house owner saw her and informed her parents.  They came immediately and took her to their village.  When she called her mother-in-law from Bhadrachalam, she abused her in the name of her caste and said that her son would never see her face again and moreover she doesn’t know where her son is. 

     

    After coming to Anaparti, Satyakala with her parents approached the Anaparti Police Station to file a case to find out about her husband but SI Muralidhar refused asking them to take this case to the MLA.  Then they went to the SP and he directed the SI to file the case.  This news was published in the news paper Andhra Jyothi.  Then SI arrested her father-in-law, Tetali China Venkata Reddy, mother-in-law, Tetali Rajyalakshmi and her husband’s friend, Shiva Reddy.

Dalit Woman’s Decomposed Body Found

    This case pertains to a missing woman, the offence having occurred on the morning of 12- 11-2005 at Tellapadu village and reported on 17- 11-2005 at about 10:00 a.m. wherein P.Ramulamma, w/o Late Ankamma Rao, aged about 50 years, Mala by caste is living by doing Coolie work. On the morning of12- 11-2005 left the house saying that she would go to Kavuri Subba Rao of Gadiapudi village and from there she would proceed to contractor Guraviah of Burrepally village along with Subba Rao for claiming her coolie due amount. But so far she has not returned home. The petitioner enquired with all his relatives, but no information came to light. P.S.Maddipadu Police registered a case of missing woman with Crime No. 91/2005 and later altered the case u/s 302 r/w Sec.34 IPC.

     

    This is a case of murder of an aged woman, who went missing on the morning of 12- 11-2005. On 23-11-2005, at 7: 00 a.m. the dead body of the missing woman was found at the Tellapadu fields.  Since the morning of the 12th of November when she went her village for Gadiapudi village to take her coolie from Suspect No. 1, but the dead body of the woman was found in a putrefied at the fields. On the evening of 22-11-2005, under suspicious circumstances, and it is evidentially presumed that the Suspect 1, 2 &3 might have conspired together and murdered the deceased, since the deceased was making propaganda about the illicit intimacy between Suspect No. 1 & 3 and since she became a hurdle to him in his personal affairs.

     

    Even after inquiring with his relatives, the petitioner had no information about his mother; he grew suspicious of her death. According to the complainant, his mother has been doing Coolie work under the said accused for the past 4 years. The said contractor for the last some time stopped his mother Ramulamma as Mestry and his mother had been moving around him since he had to pay Rs. 4000 towards Coolie wages and he has been postponing the same under some pretext or the other.  On reporting to the village elders the employer paid Rs. 2000, but was again evading Ramulamma for the payment of the remaining amount. In the month of October the deceased received threatening calls of murder with a bomb from the accused. ON learning this, Guravaiah was rebuked by the village elders but he paid no heed to them.

     

    On 11-11-2005, Guravaiah called up Ramulamma and asked her to come to Gadiyapydi village to collect her remaining coolie amount. But tragically she never returned. It may be noted that the deceased resides alone at Tellabadu village. Vasu, the petitioner’s relative suspected something foul as the house was locked for 4 days and immediately informed the complainant who works at Hyderabad. Subsequently the complainant and the village elders reported the matter to the Police. The police conducted investigation and recorded the statements of the witnesses. The police intentionally have omitted the inclusion of The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities), Act, 1989 in the FIR.

Dalit Woman Raped and Murdered

    Diseased Vaishali (30) w/o Suresh Ghodeswar lived along with her husband and two children Sneha (8) and Nishant (6) at Badnera – Amravati. She belongs to Mahar (SC) Community and working as a Nurse in the Dr. Arora Private Hospital Amravati. On November 12, 2005 at 8.40 pm Late Vaishali was left out from the hospital, (where she was working) going home. While returning she met Sachin Nalawade on the way (This information got from Sachin Nalalwade, when F.F. Team met him) and they went on a Motor Bike Hero Puck. It was learnt from the statement of Sachin that Vaishali requested Sachin to teach her bike driving. Vaishali while riding bike, met with an accident and seriously injured (Vaishali was not trained so that she could not control the bike and fell down along with Sachin). Sachin called Dinesh Bub, who is a Shiv Sena Shakha Pramukh and corporator and then he went by walking towards Lahoti Hospital. Then Dinesh Bub telephoned ISP Satya Narayan Jaiswal and he told him to send somebody to science core ground.

     

    Then API Sharif Khan from police department went to ground and admitted Vaishali in Irvin Hospital. After checking Vaishali doctor told that she is serious and need to admit in the Nagpur Hospital. Then Dinesh Bub gave ambulance for sending Vaishali to the hospital. While going towards Nagpur Vaishali died. Tivsa PHC doctor told that she is dead. After that body was sent to Amravati Irvin Hospital for the postmortem report. Initially the case was registered against Vaishali about accident case but after Postmortem report it was clear that it was not a simple accident case but a case of serious Rape and murder. Charge Sheet is not yet filed in the court, Atrocity act is not yet framed on Perpetrators, and Case is under inquiry by CID.
