The village Morpura is located in Vadodara district, which is 8 to 10 K.M. far from Taluka place Dabhoi. People of Bariya, Vasava and other communities are living in the village. Untouchability is not practiced openly. There are around 100 to 125 families in the village which includes Vasava and Bariya. The village panhcayat is set up with three villages. The people of the village have to go to Dabhoi for employment.
Nishaben Dineshbhai Vasava belongs to tribal community. The victim is minor. On 31/05/2010 there was a marriage in the village. In the evening they had dance party. The victim came to see the dance party with her father. The accused gave Rs. 10/- to the victim and took her near pond and under the tree he raped her. On coming to know regarding the incident mother of victim Manjulaben filed FIR against the accused and police registered the offence under section 376 of the IPC and section 3(1) (xi) and of the SCST Prevention of Atrocities Act.
Brief Details of the Case:
Divya Sri is the daughter of Vara Prasada Rao and Jayamma, residents of Mangalagunta Palem, Narsapuram, W G Dt. They are agricultural workers. As they did not have children they adopted Divya Sri from a hospital when she was an infant. When she has grown up they came to know that she is mentally retarded. As they have to earn their daily livelihood, they were forced to leave Divya Sri alone at home and go for work. One day Ella Rambabu of the same village mason by occupation came to the house of Vara Prasada Rao’s house for construction of wall. Ram Babu is married and has two children. Having noticed the situation that Divya Sri is mentally retarded, stays alone at home during day time, he sexually exploited her. As Divya Sri had vomitings her parents took her to the doctor. They were astonished when the doctor informed them that Divya Sri was 3 months pregnant. Having come to know that it was Ram Babu, Vara Prasada Rao and his wife Jayamma went to his house and asked him. Ram Babu and his family members reacted seriously and said how dare you come and ask me, abused them on the name of caste. He also said that he satisfied the lust of his daughter on her instigation. He also warned them of dire consequences and said to go and complain with whomever they want.
With the help of DSS, Vara Prasada Rao approached the police and lodged a complaint on 22nd May 2010. The case was registered in Narsapur Rural Police station of West Godavari district.
SVSP Manikkaraja Devar, a self proclaimed Junior Jamin resident of Kayathar Union, Kovilpatti Taluk, Thoothukudi district, practices caste based discrimination and atrocities against dalit communities. Perumal belonging to Dalit community, elected as the Union Chairman was not allowed to function independently. Perumal being a obedient servant of Manikkaraja never complains about the dominance of Manikkaraja. The TATA SUMO provided to the Chairman was taken over by Manikkaraja and used for his personal purpose. Since 2006, he was hoisting the National Flag during the Independence day and Republic Day functions. The District Administration largely ignored this undue practice of him. Even though he practices untouchability in the Kadambur region, Police department never initiated against him. He proclaim himself as the Union Chairman and have his name inscribed as the Chairman in some of the Boards.
Manikkaraja is affiliated to AIADMK Party and he is the party secretary for the Kovilpatti constituency. Raman, belonging to Dalit community lodged a complaint against Manikkaraja accusing his discriminatory. Hence Manikkaraja threatened him and intimidated him to withdraw the complaint. Anti Caste Dominance Federation staged a district level protest movement against the culprit. They have filed a petition with the High Court seeking action against him, with the intervention of the High Court a case was filed against him.
