S. Madurai Veeran (37), resident of Kalugumalai, Kovilpatti Taluk, Thoothukudi District, belongs to Dailt Arunthathiyar community. He is married and father of two girl children. Eldest daughter is studying 12th Std and the second daughter is studying 9th std. He is owning a foot wear shop and he is also a cobbler. On 11/12/2009, while Madurai veeran is working in his shop, Madasamy (65), belongs to dominant caste hindu devar community, came to his shop and threw his chappal at Madurai veeran and asked him to stitch it. Madurai Veeran, who could not tolerate this humiliation, asked Madasamy to give the chappal to his hand with due respect. Madasamy who could not tolerate this assertion of self respect by a Dalit, slapped him repeatedly and verbally abused him referring derogatory regarding caste. Ms. Bathali w/o Gurusamy, belongs to dalit Arunthathiyar community, cried for help. On lookers prevented Madasamy from making further assault. Madasamy threatened to kill Madurai veeran. Madurai Veeran with the help of Mr. Suppan, filed a complaint with the Kalugumalai Police station. FIR was filed against the perpetrator. Then the Police Sub-Inspector immediately located Madasamy and arrested him. After three days victim and the perpetrator compromised and the victim withdrew the complaint.
V. Seetha,(17), D/o Velmurugan, resident of Harijan Colony, Bharathiyar Nagar, Gopi Taluk, Erode district. She studied upto 8th standard and working as a Helper in a Garments company namely HighTech Company located in Nambiur. She used to work during the night shift. Selvaraj (33), married and father of two children, belongs to caste hindu Muthuraja community, was working as a Contractor in the company. Contractor Selvaraj used to drop Seetha after the shift around 1pm. One day after the end of the shift, when all the workers were leaving the company, Selvaraj asked Seetha to stay back. After dropping her co-workers, he came back and seduced her to have sexual affair. Without her due consent, he had sexual relationship with her and asked her not to reveal this to anybody. Promising to marry her, he repeatedly had sexual relationship with her. She left the job as the company was shut down due to loss. Since then Selvaraj ended the contact with her. She got pregnant and as her parents was busy looking after their son for medical treatment, her parents were ignorant about her pregnancy. They came to know her pregnancy, when they took her to the hospital for her illness. After the episode she revealed that she was forced in to sexual relationship by Selvaraj in the pretext of marriage. Then her parents reported this sexual exploitation to the Nambiur Police station. Selvaraj was arrested regarding this.
Selvaraj (45), resident of Arunthathiyar colony, West Palladam, Tiruppur District, belongs to Dalit Arunthathiyar community. He is a casual labour in a handloom company. He was paying premium in a chit fund to Murugan, belongs to dominant caste hindu Kounder community, resident of Aaluthupalayam, in return for festive sweets and snacks. Even after the completion of the premium, Murugan failed to pay festive sweets. Since Murugan had not given the festive sweets, Selvaraj asked Murugan to repay the amount. Give lame excuses Murugan kept on postponing the repayment. When Selvaraj asked him to pay the money, Murugan asked him to come to his Owner’s Real Estate Office located in Palladam.
On 07/12/2009, Selvaraj went to Balu’s Real Estate office where Murugan is working. He enquired about Murugan and reported to Balu that Murugan is cheating him and postponing the repayment. Balu and his brother Mani asked Selvaraj to come inside the office. As soon as Selvaraj got inside the office, the closed the entrance and brutally assaulted him with Iron rods and verbally abused him referring derogatory regarding caste name. Selvaraj sustained severe injury in his chest, thigh and over his back. after he fell unconscious, perpetrators threw him on the pedestrian way of the road. Selvaraj managed to come back home. Then he was admitted in the Palladam Government Hospital for three days for medical treatment. While he was in the hospital, even after a report of the doctor to the police department, police have not visited him to receive the complaint. On 17/12/2009, case was filed against the perpetrators, but the police was negligent to take against the perpetrators and have not arrested them regarding this atrocity. Selvaraj was not provided any money relief in this regard.
Later this case was dismissed as MISTAKE OF FACTS by the DISTRICT VIGILANCE AND MONITORING COMMITTEE.
Sakthivel (16), s/o Senniappan, resident of Harijan Colony, Nahalur Pudur, Bhavani Taluk, Erode district, belongs to Dalit Arunthathiyar community. After completing 10th standard, he is working in a Brick kiln. On 06/12/09 around 3.30pm while returning alone from work to his village through the burial path, P. Chandiran (50) belongs to dominant caste hindu Nayakkar community, stopped him and asked why you son of Sakkili prostitute coming by this way?.Sakthvel replied that since it is burial ground he came by this way. Intolerant Chandiran told that this burial ground and path belongs to Nayakkar community and dalits should not come by this way. Sakthivel politely said that he won’t come by this way anymore and started moving. But Chandiran asked to come with him to the Kangaroo court to discuss regarding this. Sakthivel tried to run away, but Chandiran chased him in his TVS 50 and brutally assaulted him. Sakthivel sustained severe injury, in his leg, face, neck and head. K. Madaan, belongs to Dalit Arunthathiyar community, who came along the way, interrupted and rescued him. He left Sakthivel on his home. On their return from home, after knowing the incident, Sakthivel parents admitted him at the Anthiyur Government Hospital. Considering the severity of the injuries, he was shifted to Erode Government Hospital. After four days he returned home. Again admitted to the private hospital since his leg bone sustained a crack.
Anthiyur Police received an affidavit and registered FIR against the perpetrator. As the police was found to be negligent to arrest the perpetrator, Dalits of the village, Aathi Thamilar Paeravai and other Dalit solidarity groups staged a protest seeking the arrest of the perpetrator. This case was acquitted at the Erode Sessions Court.
