Case summary

Vedhapuri & his wife Indra who belongs to Adidravidar Community looking after the Goat Farm for around 11 years for a monthly salary, the farm which is owned by Ramesh who is living in abroad and he belongs to a Naidu Community. Vedhapuri and Indra had a friendly relationship with the Ayyapan and Sivagami Family who is residing nearby for around 15 yrs and belongs to vanniyar community. Vedhapuri had given some 50,000/- to a person called Dharani through Sivagami. After that, Vedhapuri asked sivagami to get 50,000/- loan to him for his son marriage expenses. Vedhapuri was paying the loan amount monthly but due to his family financial crisis he couldn’t pay for 2 months and when sivagami asked back the loan amount to Vedhapuri, he asked her to get amount from Dharani which he gave her through sivagami earlier. Sivagami asked about this to dharani to give back the money gave by vedhapuri. But dharani denied that she got money from vedhapuri and both dharani and sivagami went in to arugument.

After this, On 14.07.2022, Sivagami and his son Ardhal, along with Ajith, Murugan, Annamalai came to the vedhapuri’s house when vedhapuri was not in home and they were asked money to vedhapuri’s wife and scolded and fought with her. On 15.07.2022, around 6.00 PM Kannan (F/O Ramasamy), Ajith (F/O Ramasamy) from Aarasur village and Ayyappan (F/O Subburayan), Sivagami (H/O Ayyappan), Ardhal (F/O Ayyappan, Murugan (F/O subbrayaan) , Annamalai (F/O Subbrayan), Anitha (F/O Velu) who all belongs to vanniyar community came to vedhapuri’s house and asked the money back. When vedhapuri replied to him that to get that money from Dharani which gave by him through sivagami. Immediately Ajith beaten vedhapuri with stick and spoken abusive words along with their caste names and threatened him that they are going to kill him. When Vedhapuri’s wife came in between them to save vedhapuri from their attack. Then they removed the Indra’s saree and tored her blouse and sexually harassed her in front his husband itself. Then they brutally attacked them and poured Domaicron pesticides on vedhapuri’s mouth to kill him. Then somehow, they both escaped from them and meanwhile Ramalingam, Gopal, Kannan, Manikandan who were working in nearby agriculture land saw this and came to the incident place and saved vedhapuri and his wife Indira from them. They both were severely injured.

At that night they couldn’t go to the hospital since the people who attacked them were roaming outside to attack them again. So, Vedhapuri did phone call to 100 and also for ambulance but nobody came. Then the next day morning 16.07.2022 at 7.00am got treatment as an outpatient and then they went to Thellar Police Station at 10AM and gave a complaint. But the police told them to go now and come when they call.

On 17.07.2022 around 6pm vedhapuri and his wife Indhira went to police station after they called. But they both made to wait for long time and sent back again by saying that the Police Inspector went out for an emergency work. So, when they came out Annamalai F/O Subbarayan who were one among the group attacked them that day, he met both and spoke abusive words on his wife and went to beat them, then immediately when vedhapuri’s wife scared and shouted he ran away from that place. Then from there when they were on the way to their house nearby Kamaraj nagar pillaiyar kovil street Annamalai, Magesh, Kannan stopped vedhapuri and his wife Indira, then Magesh who abusively scolded and used derogatory words on them and Kannan with the blade scratched on both of them near their chests they got severely injured.

On 18.07.2022, Vedhapuri’ s wife gave a complaint in Thellar Police Station from her side for sexually harassing her. The Police Inspector Sonia and CBCID Uthhaman forced Indhira to not include the words in complaint which about abusive words along with caste names that spoke by the perpetrators. Also, CBCID uthhaman threatened them to withdraw the case.

 Thereafter, only on 25.07.2022 police filed the case under SC/ST Act on vedhapuri’s complaint but not on her wife Indira complaint. And there was no further action taken place, the accused were not arrested even after filed under SC/ST Act. Vedhapuri and his wife Indira met SP and reported about this, and he immediately urged DSP to conduct enquiry and for further action. Therefore, DSP came to the incident spot and made an enquiry, while enquiring vedhapuri and his wife, he was totally speaking in supportive manner of perpetrators and also verbally abused the victims both vedhapuri and his wife by saying “Am I your home servant? To come here immediately after you gave complaint?” then while vedhapuri and his wife explaining about the incident that “they were been brutally attacked and removed Indira’s saree and sexually abused, and with the blade perpetrators scratched on their chests, they said, then after hearing this, the DSP threatened Indira that “first you need to arrested, and he asked her to remove her dress and show where they got hurt.”

 More than 52 days gone, after filing under SC/ST act on accused but so far, no arrest made and there was no steps taken on Indira’s complaint on Sexual Harrasment. Therefore, we recommend to file case on DSP, CBCID Uthhaman, Police Inspector under SC/ST Act since they were all supportive to make this case to be closed soon and involved to save the perpetrators. Also, the perpetrators should be arrested immediately and lodged in jail until the case investigation complete. Additionally, the steps need to take immediately on Indira’s complaint on Sexual Harrasment. Under SC/ST Act, Justice, Protection and Rehabilitation should be provided to the victims without delay.
