Case summary

Mr. Prabhakaran is resident of Nedimozhiyanur Village of Tindivanam Taluk of Villupuram District and he belonged to the Scheduled Caste. He is residing with his wife Amutha and has six children and he is working as daily wage labourer.

On 25.08.2021 at around 01.00 pm his eldest daughter Kaliammal, W/o Murugan is cultivating peanuts for lease. As his sister Kaliammal was going to her mother's house in Kalladikuppam village for urgent work, she told Amutha (Prabhakaran’s wife) to take care of the peanuts planted in the land. His wife Amutha went to see the land and since his wife did not return home Prabhakran’s eldest daughter Nithyasree went on searching her. As she was standing near Jay's land which is located near the bank of Sentiyambakkam River a man named Kathirvel, S/o Ganesan Gounder of the same village (belonged to the most backward caste)

As soon as the noise was heard, Nithyasree got scared and ran away from there. And her leg got blocked and she fell down. Kathirvel, who came later, slapped her on the back with a whip. Unable to bear the pain of beating she cried, fainted, and fell down. When Abirami, Pradeshwaran, Jayamala, and Mariammal from their area went to fetch firewood, they saw Nithyasree was beaten by him and told Amutha that Nithyasree was fainting and told her to leave immediately. When his wife went to the scene in shock after hearing about the incident, rushed to the spot and carried the unconscious girl.

Prabhakaran had gone to work outside and then his wife Amutha told him to come home immediately after the incident and he left work and came home at 4.00 pm. When he came home and was shocked to see that his daughter Nithyasree was badly injured in the back and was being treated at the Mundiyambakkam Government Medical College Hospital and the doctor admitted her as an inpatient. Later at around 7 pm, he had lodged a complaint at the Periyadatchur police station. Since there was no bed facility for further treatment and he was being treated as an outpatient as the doctor had negligently told him to lie down on the floor.

The next day, on 26.08.2021, at around 5.00 am, he was told that Kathirvel had been brought to the police station. When Prabhakar went to the Periyadatchur police station at around 01.00 that afternoon, there were more than 20 people in support of Kathirvel. Later Villupuram Deputy Superintendent of Police immediately sent Kathirvell's supporters to Periyadatchur police station inspector Mr. Vinayagamurugan and told them to keep only the girl Nithyasree, her father Prabhakaran and Kathirvel. Later they interrogated Nithyasree.
