Attempt to Rape of Minor Dalit Girl & Attack Family

    Village Khedali Pichnot is situated about 28 kilometers from District Headquarter, Alwar; 184 kilometers from Jaipur and 6 kilometers from Malakheda police station. Sunita is younger child of her parents. She has an elder brother who is studying in 9th class. She also studies in class 6th. Her father is a daily wages laborer. On 22nd August 2008 at 8 pm she went to the field of Balveer Singh Sarpanch to freshen up. In the meantime, she saw four people coming towards her. Seeing them she got up and when they came closer, she recognized them as Nepi Singh, Upendra Singh, Rajpal Singh Thakur and Munni Ram Meena. All four of them were drunk. Then Nepi Singh clutched her hand and asked her to lie down otherwise she will be killed and pushed her on the ground. Sunita got scared with this sudden attack and tried to escape. In this event, she fell down and her dress was torn. She started shouting. Her uncle’s house was nearby the field where her aunt namely Imarti Devi was cooking. She heard her voice and called Sunita’s father Tika Ram Jatav and said that some child is crying there in the field. Tika Ram and other colony members rushed towards the field, till then accused ran away. Tika Ram saw Sunita crying and asked her the matter. She told him the whole incident. When Tika Ram and others went to Sarpanch Balveer Singh’s bore well, there they saw the culprits. When asked, they denied of any misdeed done by them with Sunita. Late night at 10 pm the accused came to Tika Ram’s house equipped with weapons; abused them in the name of caste and threatened them to kill if they will dare to register a case against them. Next day, Panchayat was held. To ask Sunita about the incident, two people from the village, Ramdhan Meena and Ramswaroop Jat went to her school. When she narrated the truth in front of headmaster, Mohan Singh Rajput, he got angry and started abusing her and her community. Then next day, on 24th August 2008, FIR was registered in Malakheda police station under sections 376/511 IPC and 3 (1) (x), (xi) SC/ST Act, 1989 and started the investigation. On 27th August 2008 police arrested the culprits and submitted the challan on 16th September 2008. Police did not send Sunita for medical examination. Police did nothing against the perpetrators who were pressurizing the victim. And even did not take any legal action against those who conducted Panchayat illegally.

     

    The administration did not provide full statutory monetary relief to her for which she was eligible & entitled under the rule 12(4) of SC/ST (PoA) Act 1989. Even after this incident, the culprits, without any fear, came to victim’s house equipped with sticks and arms and abused them in the name of caste and threatened them to beat. The court decided the case and gave the judgment on 9th November 2009 in favor of the accused and acquitted all the accused on the benefit of doubt due to controversial evidences and witnesses. After the incident, Sunita was under trauma due to which she was unable to continue her studies effectively. She was not able to live freely in the society. She had to face troubles in her school also due to the incident as in school; she is asked repetitively what happened to her.

Dalit boy tortured cruelly for plucking guava from orchard, Badota village

  • Summary:: Govind (10y) s/o Dalbir belonging to Dalit community (Chamar) r/o Badota village under the jurisdiction of Madhuban Police Station in Karnal District. On 21/08/08 the victim was caught by the perpetrators namely Surjeet (50y) Ram Singh, Sonu (20y) S/o Surjeet Singh and Sonu (Caste- Jat) for plucking Guava from the perpetrator’s tree. He was taken into the house of perpetrator where he was tortured very cruelly. His hands and legs were tied and beaten up mercilessly with lathi. They also stuffed cloth in his mouth for preventing him from shouting. He was beaten continuously till he become unconscious. After he became unconscious he was thrown out into the street. In this attack he became very serious and sustained severe injuries in all parts of his body. On 22/08/08 the complaint was given to the police station. But they did not file any FIR. After the pressure and demand given by the victim the FIR was filed on 02/09/08 u/s 323, 506, 34 IPC. So far no steps have been taken to arrest the perpetrators and no compensation has been given to the victims. The perpetrators are threatening the victims to withdraw the complaint. No protection has been given to the victim.

    Savitat Devi (19) d/o Tanik Ram is resident of Vobhanaur village, P O- Hasapur under Narhat police station in Nawada Dist. The victim belongs to Mushar community (SC) community.

     

    On 19/08/2008, at about 5.00 p.m, the victim went to a field, located in East direction of the village for latrine. Taking the opportunity, Krishnan Yadav s/o Shankar Yadav belonging to OBC community from the same village, forcibly raped her. After the crime, she managed to reach her home and narrated the incident to her parents. The victim’s family went to Narhat police station to lodge complaint against the rapist.

     

    On 19-08-2008 F.I.R. was registered no. 55/08, u/s 376,307, 323 IPC & 3(1)(x)(xii) of SC/ST (PoA) Act 1989. A medical examination was conducted on the victim. So far the victim has not received any compensation from the administration. Charge sheet has been filed in this case. The rapist has been languishing in the jail. The case is under trial.

Gang Rape of a Minor Dalit Girl Sadar

    The village Sainthali is located 25 Kilometers from the District headquarter and 18 Kilometers from the Sadar police station. There are 70 families of various communities. Radha, daughter of Hari Kishan Jatav, resident of Village- Sainthali, Post- Chikaani, Tehsil-Kishangarh, Distt- Alwar. On 16th August 2008, it was a holy day of Rakshabandhan. Radha went to the jungle with her father Hari Kishan, Uncle Manohari Lal and Aunt Anguri Devi to get fodder for animals. At around 12:00 pm her father sent her back to home to keep a bulk of fodder there. Radha came home with fodder; kept it at home and turned back to the jungle to get another bulk. When she was passing by the field of Virender s/o Kanhya Lal, suddenly the culprits namely Hasam s/o Ismile Mave, Mubba S/o Roshan Mave and Arshad S/o Shahbuddin came there and trapped Radha; dragged her in the millet farm. Then Arshad stood out of the field on road to guard and Mubba and Ismail clutched her mouth with a piece of cloth and tied her hands with her dupatta; pushed her over the floor; stripped out her lower wears and Hasam and Ismail subsequently raped her. They had beaten her up so much that her right eye was swollen and threatened her not to tell anyone. Her genitals started bleeding. The perpetrators forcefully gave some sedative drug to Radha by which she became unconscious. She didn’t remember what happened with her after that. Around 10:00 pm when Radha regained her consciousness, she found herself in the field. She got wet as it was drizzling. Radha was very much scared and injured and was unable to move a single step but somehow she got up, wore her clothes and went home. All the family members and other villagers were searching her. Her family members were shocked to see her in awful condition. They asked Radha but due to trauma and terror of the accused she didn’t tell anything. She got very high temperature. Then next day, on 17th August 2008 when she became felt at ease, she narrated the whole incident to her family. As Radha was not well, her family decided to lodge FIR against the perpetrators next day on 18th August 2008.

     

    But on 18th August 2008 the Mave community members called Panchayat of the village in context of this case. Radha’s family was also asked to join the meeting. The Panchayat offered them to take 2-4 lacs and do not register the FIR. The family members of Hasan and Mubba threatened them to kill if they will dare to register FIR against them. On 19th August 2008, when Radha and her family members were going to police station in a tractor, the perpetrators namely Son Singh S/o Nahar Singh Rajput and Kallu S/o Roshan Mave impeded the tractor and asked them to compromise or leave the village. Somehow, Radha and her family members reached police station by a tempo but there they saw perpetrators with some other people already sitting with the police personnel. So Hari Krishan and others went to the court and filed a suit against them. Case No- 310/08 dated 19-08-08 under section 376 (2) (g) IPC and 3(1)(xii) of SC/ST Act 1989 was registered with the direction of the court. After registering the case, local police sent Radha for medical examination. The investigation officer visited the place of incident but the accused were not arrested on time. After two months, accused were arrested, but were released later on as due to pressure from every corner, Radha and her family were compelled to withdraw the case. Radha changed her statement before the court, which resulted in acquittal of the accused in lieu of benefit of doubt due to hostile evidences.

Dalit girl sexually exploited in Thurinjapuram

  • Summary:: Vennila age 22 years D/o. Chinnadurai residing in Thurinjapuram village of Tiruvannamalai District. She belong to Irula tribal community. While she was doing tenth standard she fell in love with Radhakrishnan s/o Rajavel belonging to vanniyar community in the year 2007. In 2008, Radhakrishnan called her saying he will marry her. Since she was a minor they could not register their marriage but lived together in Chennai. She became pregnant and during child birth the parents of Radhakrishnan were with them. After child birth they went to her mother’s house. Her husband went to his home saying that he will return in a few days. Her husband did not return for long time. When she went to his house, his mother said “you go out leaving the child here”. One day her husband phoned her and asked to come alone to a bus stand. He said, he is going for a work and after the work he will leave with her. But he did not do so. So on 07.08.2008 she gave a complaint in the All Women Police Station in Tiruvannamalai. The police did not file any FIR. They only gave a receipt. Now it is already four years and she was living alone.
