Dalit Girl Brutal Assault

    Varudhamoothy S/o Muthan belongs to dalit community, reside at pattchapalayam Village, Pallipalayam Union, Thiruchangodu taluk, Kumarapalayam police jurisdiction, Namakkal District along with his wife namely Ms.SAlammal, daughters Nithya (11), Kousalya(6) and son Prasanth (8). He is a coolie worker.

     

    His daughter Nithya (11) was studying 5th standard in the government middle school which has been located nearby her house. On 16.10.2007 she went to Athiparasathi temple where she done a prayer, then she came out form the temple. During that time one boy namely chinnsamy(13) belongs to Gownder community was standing in fornt of the temple. He looked at Nithya and asked her “how did you enter the temple inside Chakkiliya Mundai” in between another boy namely Kavin (12) who is belongs to Naidu community. He also looked at her and asked how did you enter the temple inside “chakkiliya naye(dog)”. He badly scoled her, derogatory referred her caste name and severely beaten her by his left hand on her back side twice. She was not able to bear the pain though she was crying standing near to temple.

     

    During that time her father Mr.Varuthamani was returning from his work and found his daughter was crying on the way. He asked what happen why are you crying. She was narrated they she was brutally attacked and derogatory referred by caste name by the boys namely Chinnasamy and Kavin.  Mr. Varuthamani took her daughter on around 7.30 pm and went to kavin’s home. But before reaching Kavin’s home there Mr.Tanapal, Baskar and other 10 persons who belongs to caste hindu community standing on the way to Kavin’s house. So first he was approached them to seek justice. But they were got angry and told him that how dare are you? You came to us and complying about our boys? You “Sakkiliya” during that Mr.Dhanapal pushed him by putting his hands on his chest. Mr.Varuthamani was fell down then they wrere kicked him on his various parts of the body. He was pleaded them to leave, but they were continued. Then he and his daughter came into their hamlet informed the incident to his brothers. They were shocked and they approached the village leader namely Ramasamy belongs to the Gounder community and narrated the inicdent. He insisted them to compromise. Following that mr.Senthil and other 20 caste hindus casme to the Arunthathiyar hamlet with more angry and they brutally attacked the Arunthathiyar who were standing there namely Mr.Chinnasamy, Maniyan, Sivaraj and Ladha. Mr. Chinnasamy and Mr. Maniyan were severely beaten up by them they  got severed injury on their head they admitted in the Erode Government hospital. Police filed the case and charges were filed on the court but this case was acquitted in sessions court.

Brutal Attack on a Dalit Family and Women Raped Out of Jealousy for Good Business

  • Summary:: Amar Singh (35) S/o Shyam Lal (50) and Sundresh (28) W/o Amar Singh, resident of Nagli Bazidpur village, P.S Phase-II, Noida in the Uttar Pradesh belong to a Dalit community Jatav (Chamar). Amar Singh as well as Mukesh (22) S/o Chander Pal, Anand (25) S/o Chander Pal, Ajay (25) S/o Hari Chand, Chet Ram (22) S/o Hari Chand, Sant Ram (28) S/o Hari Chand, who belonged to Dominant Caste used to trade construction materials from the Factory near the Bank of River Yamuna of the village. Thus, Amar Singh bought a tractor that to make his business convenient and easier. He deposited Rs.10’000/- with the Factory owner to reserve goods for him. His business was running very smoothly and profitably. Consequently, the Dominant Caste people grew jealous and they conspired against him, and did not allow him to continue his business. On 29th September 2007, when Amar Singh reached the factory The Dominant Caste People (Pandit) - attacked him with lathis saying “We will not allow you to work here with us, go back from here and search for other work.” Again on 5th October morning, Amar Singh’s younger brother Gulab Singh (18) went to the factory with “Tractor” to carry goods. The Dominant Caste people suddenly snatched his “Tractor” and damaged it badly; however Gulab Singh managed to run away from the place. On 10th October 2007 at around 9:30pm three dominant caste people (Pandit) named as Mukesh (22) S/o Chander Pal, Babu S/o Vishambhar and Hari chand (50) S/o Ramsaran forcefully entered his hosue and raped his wife Sundresh (28) who was sleeping on the downstairs. The perpetrators viciously beat the victims with lathi as they opposed their brutality. The neighbours and relatives rushed to the spot, having heard the victims shouting. Meanwhile, the perpetrators had absconded from the spot. The relatives and neighbors of Amar Singh and his wife first took them to Police Station-Phase II to lodge the complaint against the culprits. The case was registered u/s 452/393/506 B/504 of IPC and 3 (1) X of SC/ST (PoA) 1989. The victims were admitted in the Nithari Government Hospital. The police have not taken victims statements till today. Proper sections have not been invoked in the F.I.R. On 16.10.07 three culprits out of seven were under arrest and res of them had absconded. Now all the three accused have been released on bail. Police protection has been provided to the victim since 16.10.07. The victims have not yet received any compensation by the Local Government.

Dalit Youth Tortured by Police in a Murder Allegation

    Bhawari Bhai (12) d/o Annaram Meghwal is r/o Vill/P.S Chitalwana in Jalore Dist. The police officials came to the victim’s house and forcibly took the victim to a nearby village school and started inquiring about a murder of Dhook Singh by beating and hitting on her forehead against the walls of the room. Her forehead started bleeding and the child became unconscious. When she gained her consciousness, they again beat and took her to home and threatened her family. She was taken to the hospital by her family members but there she did not receive a proper treatment, as the police strictly instructed the Doctor not to provide medication to the child. They went to Gujrat for treatment. Later on 16/10/07 FIR was registered No. 111/07, u/s 365,342,323,504 IPC & 3(1)(x) of SC/ST (PoA) Act. against the accused only when the father - Annaram filed a petition in the Court and the court ordered the police to lodge FIR.

     

    The police submitted charge sheet 23.12.07, No. 39/07, u/s 365,342,323, 504 IPC & 3(1)(x) of SC/ST (PoA) Act. in the case.  The Chairperson of State Women Commission Tara Bhandari visited the office of District Collector in the month of October 2007 regarding the case but no action was taken by the State Women commission also.

A Dalit Shot Dead Under Theft Allegation

  • Summary:: Though the Pasi community constitutes 50 households which are highest among other communities the village named Munnu Kheda is still being dominated by Pandits and Thakurs. It is just because Dalit communities depend on them for their livelihood. Some Dalits even run piggeries for their living. The family of the victim too has piggeries and owns a few furlongs land. The victimDeceased Ramcharan alias Duwar s/o late Kallu Pasi, (60) - was an electrician. He a few days ago had done wiring in the house of the accused Ravinesh s/o Ramlal at Mall who runs a medical shop and was not yet paid for the work. It so happened that the grandfather of the victim Ramcharan Shri Sarju fell ill on 5.10.2007. Consequently, Ramcharan had gone to buy medicine for his grandfather at Ravinesh’s Medical Shop. He got the medicine and asked Ravinesh to adjust money from his work but Ravinesh forcefully took Ramcharan into house, together with his son Abhinandan beaten the victim and shot a bullet on his forehead resulting in death. In order to hide their act, the accused threw his body out of their campus backside of their house. They took their neigbhourhood at their confidence and tactfully alleged Ramcharan of attempting theft and Savita w/o Ravinesh registered the FIR NO-178A/07 457/380/511/307 IPCdate-7/10/07 at 3:20 pm against Ramcharan alleging him of theft. Meanwhile Ravinesh had taken the victim to the local hospital in Mall and escaped from there. The police had informed the family of the victim in the night. On hearing the incident, the mother of the victim went to the spot where the body was thrown but she did not find there. Then she went to the hospital and was informed that Ramcharan was shifted to the Balrampur Hospital. Since there was no vehicle available at night she went to Balrampur in the morning on 6.10.2007. There in the hospital she was informed that he was transferred to the Trauma Centre (Chhatrapati Sahuji Maharaj Medical College) in Lucknow. Thus she found Ramcharan admitted in the Trauma Centre. She found him crying and trying to explain her about the incident. From there Rampyari went back to her village to arrange some money for his treatment. On 7.10.2007 at 8 am she went to the Mall police station to register the FIR but the police could register the FIR only at 12:20pm After the registering the FIR she again went to Lucknow and found that Ramcharan was no more. The relatives and villagers had blocked the road taking the dead body of Ramcharan and were demanding that the police would register the case against Ravinesh and his family for they had lodged a false complaint alleging of theft against the deceased victim. In spite of the proven case of murder, the police had given protection to Ravinesh’s family rather than arresting them. Later Ravinesh was arrested and sent to the jail by Abhinandan is yet to be arrested. The FIR is registered against the accused in Mall police station. FIR no. 178/07 Sections 307, 504 IPC and 3(1)(x) SC/ST (PoA) Act and after the Postmortem Report Section 307 IPC was converted into 302,504 IPC and section 3(2)(v) were invoked. No compensation was given to the family of the victim and no medical expenses were given so far. Spot investigation was conducted by DSP on 7.10.07, Investigation conducted by DSP - Vinay Chandra. Accused arrested and bailed out. Charge sheet filed. Case is under trial before the court of Sudha Singh, special SC/ST Court of Lucknow. Compensation is not paid under SC/ST (PoA) Rules 1995. TA/DA under SC/ST (PoA) Rules 1995 not paid. Abhinandan and Rabinesh threat the victims.

Dalit Student Abused in School by Caste Name for Eating Non-vegetarian Meal

    On 04/10/07, Uday singh Verma, -victim was attending a lecture. The lecture was delivered by the accused Pramod Sharma in the School. The perpetrator was delivering lectures related to vegetarian and non- vegetarian appetite. In the middle of the lecture he said that that those who eat non vegetarian food are worse than a devil. Then he asked non vegetarian students to raise their hands. Subsequently some of the students whispered that one of the students namely, Uday Singh often takes non vegetarian meals. Perpetrator also asked Uday singh as to why he takes non vegetarian food. Uday Singh replied that since all his family members and ancestors are non vegetarian, he is also a non vegetarian.

     

    Suddenly, the teacher scolded him by saying that since his ancestors were ‘chammar’ by caste and used to work as shoe makers; he should leave his studies and go for the shoe weaving. In reply the question victim - Uday Singh Verma, cross questioned the perpetrator and said that since ancestors of ‘Sharma’ caste –Brahmin used to beg for wheat and rice he should also leave teaching and go for begging. Hearing this perpetrator became angry and started slapping him in the classroom itself. He took the victim to the staff room and called, Iswar Dutt Sharma and Madan Mohan Sharma. There, they all started abusing the victim in name of his caste and beaten him mercilessly .The victim got severe injuries. Meanwhile, other students called victim’s uncle, who immediately rushed to the school and took the victim to the hospital. On 7/10/2007, uncle of the victim lodged an FIR in Kotwali Police station as FIR No- 429/07 u/s 323, 347 IPC and 3(1) (x) Sc/St (PoA) Act 1989.)

     

    Police did not investigate the case properly and produced Final Report (No 133/07 dated- 31/12/07) thereby, giving clean chit to the perpetrators. The victim filed a protest petition before the Session Court of Sawai Madhopur, but no action has been taken so far.
