A Dalit Burnt Alive over a Land Dispute

  • Summary:: Budh Parkash (45) s/o Ramphal, the resident of Jamai Pura, Gautam Puri Mohalla, Kotwali-Dadari, Greatar Noida, (UP), belongs to Dalit community-Chamar. He was living with his wife, two daughters and son in Jamai Pura, Gautam Puri Mohalla, Greatar Noida, (UP). Originally Budh Prkash is the resident of Chandawaly Village (Dankor). He had a piece of land in Chandawaly Village (Dankor). He was the sole earner of the family. Basanta, the cousin of Budh Parkash asked for the land for many times. But he sold that land to another person and migrated to Jamai Pura, Gautam Puri Mohalla, Kotwali-Dadari, Greatar Noida, (UP). Basanta was very angry on Budh Parkash in this regard. And so he conspired against him to teach a lesson. On 16/06/07 at night Budh Prkash’s cousins Basanta along with his two sons- Inderjeet & Dharampal and his brother-in-law Rajendar (Dalits) residents of Chandawaly village (Dankor) went to Budh Prkash’s residence in the night. Budhparkash and Basanta had Drink together at the time of dinner and after that all went to bed. Budh Parkash slept on a cot, and due to consumption of alcohol Budhparkash had gone deep sleep. In the midnight at about 12:30 a.m. Budhparkash was tied with cot and set on fire. The neighbours immediately informed the Police at night. 90% of the body was already burnt while the police reaching to the spot. In the critical condition the police took Budhparkash to Navin Hospital in Dadari, however the doctors referred him to GTB Hospital Shadara, Delhi, where he was declared dead. Before he died, Budhparkash mentioned the names of Basanta, Rajendar, Dharam Pal and Inder Jeet to the police, involved in this incident. First, the FIR was registered u/s 34 of IPC in Darai police station on 17th June’07 but after the death of Budh Parkash it was filed u/s 307 of IPC. Police has arrested two culprits Dharam Pal and Inder Jeet but other two are absconding.

  • Summary:: This incident took place in Jamai Pura, Gautam Puri Mohalla, Kotwali-Dadari, Greater Noida, (UP). The Victim, Budh Parkash (45) s/o Ramphal belongs to Dalit a community-Chamar (Jatav). He was living with his family members (wife, two girls and one son) in Jamai Pura, Gautam Puri Mohalla, Greatar Noida, (UP). Budh Parkash’s younger daughter (13yrs) has committed suicide on May 14, 2007 because she had a fighting with her elder sister. She felt insult and ate poison. After one month of this incident on 16 June 2007at night Budh Prkash’s cousins Basanta along with his two sons- Inderjeet & Dharampal and his brother-in-law Rajendar (Dalits) residents of Chandawaly village (Dankor) came to Budh Prkash’s home for “condolence” of his younger daughter’s death. Originally Budh Prkash was also the resident of Chandawaly Village (Dankor). Budh Prkash has a piece of land in Chandawaly Village (Dankor). Basanta asked Budh parkash so many times to give his land to him. But Budh parkash sold his land to other person and came to Jamai Pura, Gautam Puri Mohalla, Kotwali-Dadari, Greatar Noida, (UP). Basanta was very angry on this why Budh Parkash has not given this land to him. Basanta wanted to teach a lesson to Budh parkash so he and other three (Basnta’s brother-in-law- Rajendar and Rajendar’s two sons-Dharam Pal and Inderjeet made a plan against Budh Parkash. There for these four arrived at Budhparkash’s home on 16/06/07 in the night. Budhparkash and Basanta had taken Drink with dinner together. At that time Budhparkash’s wife and his son and daughter went to sleep on up stair (roof). At night after taking drink and meals Budhparkash’s cousin Basanta and other three had slept down. Due to consumption alcohol so much Budhparkash had gone deep sleep. Around at 12:30am in the mid night Budhparkash’s wife saw so much bright light coming from down to up. Lots of light and a transient objects came outside, seeing it many neighbors reached immediately Budhparkash’s home. Neighbors had seen that Budhparkash had been tied with cot and many burning cloths putting on his chest. Neighbors called Police immediately at night. In the crucial condition the police had taken Budhparkash to Navin hospital Dadari but the doctors referred him to GTB Hospital Shadara, Delhi. After some time Budhparkash was declared dead but before dying Budhparkash told the names (Basanta, Rajendar, Dharam Pal and Inder Jeet) of those who were involved in this incident to the police. Police has arrested two people Dharam Pal and Inder Jeet but other two people are absconding. Police has raid many places but other two perpetrators Basanta and Rajendar have not found yet.

Denial of Temple Entry Rosanai

  • Summary::

    Vitlapuram is a village located in Villupuram District, Tindivanam Taluk in Salavathi Panchayat under the jurisdiction of Rosanai Police station, there are nearly 1500 families are living there, among 800 families are scheduled caste (SC) and rest of them are Kounder and Naidu (Caste hindus). There is a Hindu public temple called “THRUBATHI AMMAN” and ther people have tbeen celebrating the religious festival ever year in the month of june and Aani (Tamil Month). This festival will celebrate for ten days in every year and many of them being participated and sacrifice their religious oath dring this festival. 

    This year the festival has decided to celebrate from 08.06.2007 to 17.06.2007 and its began at 08.06.2007. In between on 17.06.2007 they roganized holy fire walking cermoney at the temple the kounders wereparticipated on the ceremony, the Dalits people were tried to enter into that temple to worship the God when the Dalits were forbidden into the temple by the caste Hindus and they threatened them by stated that you stupid pariya how would you enter into this temple, Para Thayoligala, if you too audacious you entered the temple” if not vacate from this place we will burn and kill you alive. The Dalit people were frightened and they returned to their hamlet after twenty minutes unfortunate one dalit student named Vignesh (16) went near to the temple by that time the Kounder people got angry and they assaulter very badly then Vignesh hardly escaped from that attack with sever injury and ran to the Dalit hamlet, this incident came to know by the Dalit people and some of the elder Dalit leaders tried to enquire and they end further nuisance. On the way to the Kounders area these Dalit elders were brutally assaulted by the Konders with lethal weapons. After the incident the has been admitted in the Tindivanam Government Hospital and they referred to the Pondicherry Government Hospital.

    The next day 18.06.2007 morning the people came into hamlet and raided the village to arrest the people who were involved in the above incident by the time the police were used lathi charge over the Dalit women  and children . Then the police were arrested the innocents and minors named Susai, Parthipan and five who belongs to dalit community and they kept as a half naked in the Rosanai police station and remanded in the prison. On this incident Mr. Ayyappan belong to Dalit community went to police station and lodged the compliant following that police has been registered the case.

Gang Rape of a Dalit Woman at Pali

  • Summary::

    Pali is located 303 km from Jaipur and 3km from the District Headquarter. Laxmi’s husband Hemant used to work in night shift in a mill. Subsequently, she was left alone at night with her son and daughter. Kamal Kishore Yadav, taking advantage of the situation, one night (21/12/2006 approx) entered her home, forcefully raped her whilst covering her mouth and threatened her that if she tells anyone about it, he would kill her husband. As a result, she did not tell anyone out of fear.

     

    20 days after the first incident (10/01/2007 approx), Kamal again entered the victim\\\'s house with Sharwan Singh, and both of them brutally raped her. The brutality was so severe that one of the perpetrators even stood on her hair in order to pin her down whilst the other perpetrator raped her on the floor. After that they threatened Laxmi not to open her mouth; otherwise they would kill her husband. She did not tell anyone out of fear. 10 days after the second incident (20/01/07 approx), Kamal again turned with Sharwan Singh & Fateh Singh at around 10:00 P.M and again raped her.

     

    This all was unbearable for Laxmi and at last she decided to speak out against the accused. She went to the office of Superintendent of Police and lodged an F.I.R against them.  The local police of Pali registered Laxmi’s FIR with the direction of the Superintendent of Police, Pali. Next day Laxmi was called for medical examination and her thumb impression was taken over the MLC report with a statement stating that Laxmi willingly doesn’t want to go through the medical examination. The main accused namely Kamal Kishore was arrested on May 6, 2007  after 3& 1/2 months from the date of FIR but soon he was released on bail on 20/6/07. Because of compassionate attitude of local police, accused started threatening Laxmi and pressurized her to withdraw the case. Laxmi changed her house to avoid this & begged for safety & security before local police as she was constantly receiving threats to be killed by the accused. Still she has been threatened by all three accused and police is not in a mood to help her as they are keen interested to rescue the accused. The Investigation officer submitted the challan on June 8, 2007 before the honorable MJM court Pali. Still perpetrators wondered around  Laxmi’s house, continuously threatening and harassing her not to pursue the case in the court of law else she would dire consequences. 

     

    The local police of Pali registered Laxmi’s FIR with the direction of the Superintendent of Police, Pali and next day Laxmi was called for medical examination, here police deliberately seemed very devious and indicated in the record that Laxmi does not want to go for medical examination.  She was directed by the police to deny for medical examination as she is not educated and unaware of the law expressing the same and thus her thumb impression was taken over the MLC report stating that Laxmi willingly doesn’t want to go through the medical examination. This illegal act of police was perhaps to help the perpetrators in the court of law and also for denying the victim a compensation of Rs. 1 Lac from Administration. The eligibility for granting compensation of Rs. 1 Lac to the rape victim is provided under the rules after lodging FIR & Medical examination of the victim.

     

    The main accused namely Kamal Kishore was arrested on May 6, 2007  after 3& 1/2 months from the date of FIR but soon he was released on bail on 20/6/07. Because of compassionate attitude of local police, accused started threatening Laxmi and pressurized her to withdraw the case. Laxmi changed her house to avoid this & begged for safety & security before local police as she was constantly receiving threats to be killed by the accused. Still she has been threatened by all three accused and police is not in a mood to help her as they are keen interested to rescue the accused. The Investigation officer submitted the challan on June 8, 2007 before the honorable MJM court Pali. it is learnt that police is harassing the victim and is reluctant to move any application in the court for cancellation of bail of the perpetrators and have not even bound them under section 107 & 116 of Indian Penal Code and sections 3 (i)(xii) and 3 (2) (v) of SC/ST (PoA) Act, 1989.

     

    Accused threatened Laxmi and her family members to kill them and terrorized that they will not let her live in Pali. They openly abused Laxmi by saying that what she can do, this will occur to her again and again and she will not able to do anything. Not only that, but Laxmi Devi was strictly prohibited to enter the mill. Because of their ill will Laxmi Devi is in trouble and helpless. As accused have been released on bail and are quite powerful in terms of money and political approach, their deeds compelled Laxmi Devi to commit suicide or die of hunger. The accused was released on bail. Now the case is pending for hearing.

Police Personnel Tortured Dalit Women On False Charge

    Sindhugarh is a small village, situated 60 km away from Mohanpur police station of Gaya District in Bihar. 35 Dalit families reside over there. Majority of Dalit families are daily labourers. On 12th June 2007 at about 6 a.m Nanda Kishore Singh, S.H.O Mohanpur and other 10-12 police personnel went to the village and tortured women of the village on false charge saying “Sali Harijan! Mushaharini! Tum log apne ghar main Moist Communist Centre (MCC) ke log ko ashray dete ho” you Harijans, giving shelter to the MCC members. The police dragged Gayatri Devi (22) w/o Raj Kumar Manji, Bachia Devi (25) w/o Badri Manji, Chetiya Devi (23) w/o Nageswar Manji & Rekha Devi (20) w/o Arjun Manji, on the ground holding their hair and beat with lathi on their backs and legs. The police personnel tortured them for an hour.

     

    A day after the four victims along with Dher Yadav s/o Devendra Yadav met Amit Kumar Jain S.P and District Magistrate of Gaya District and submitted written complaint against the perpetrators. The S.P and DM assured them to initiate necessary action against the assailants but as of now the administration has not taken any action against them. FIR not registered. No action by Senior Police officer and District Magistrate.
