    Dilip Reddy and Sharmila were in love.  He had an extra-marital relation with another woman and wanted to marry yet another woman.  He refused to marry the victim.

Dalit girls not served food along with non-Dalit people at a marriage function- Dhanvi

  • Summary:: Meena (22) d/o Mahajan Chand belonging to SC (Domna) community along with her 5 other friends from SC (2 Chamar & 3 Domna) community were undergoing tailoring training at a Vocational Training Centre at Bhoranj in Hamirpur District along with other Rajput and Jat girls. Once they were invited by their colleague Kanchan belonging to Rajput community to attend her marriage party. The girls while eating by sitting in the queue, Ramesh Chand Thakur (Rajput), the uncle of Kanchan, somehow came to know that the girls belonged to Scheduled Caste community, was so angry and went to the girl and abused them by their caste “tum Dumano or Chamar ki okat nahi hai, hamari dawat khane ki tum sab ko shaadi main kisne bulaya” (you chamars and domanos, how dare you are to attend our party? Who called you to come over here and eat?). The girls left the place with much sorrows and cries. Meena informed her father about the Incident and on the next day her father went to District Collector to complaint about the incident. However the DC did not take any action against Ramesh Chand Thakur. The NCDHR team reached the incident place, interacted with victims, witness, perpetrators and lodged a complaint on behalf of victims in DySP in Hamirpur. The perpetrator Ramesh Chand was arrested. However the Dominant Caste people approached Dalits and there was a village panchayat about the incident that Dalits and Dominant Caste people are brethrens and the case was compromised. Case was compromised by village panchayat.

Woman Ward Member Abused In Training Venu

    Sunita Devi (35) W/o Suresh Mochi (40), the resident of Gouriwari village, Gourdah G.P, Salkhua P.S, Saharsa District, Bihar, belongs to Scheduled Caste (Mochi) community. Salkhua P.S, Saharsa District of State Bihar is about 500 kms away from its State capital Patna. On 17th Nov’06 the District administration of Saharsa organized a training program on Panchayati Raj at District Headquarter, Patel ground for all Pachayat representatives of the District.  Sunita Devi, the ward member (ward No-15) from Gourdah Panchayat and her husband Suresh Mochi also participated in the program.

     

    After the training Monoj Yadav H/o Nilan Devo, the Sarpanch of Gourdah G.P, belonging to Dominant Caste was distributing food packets and Panchayati Raj books. When Sunita Devi asked for food packet and Panchayat Raj book to Monoj Yadav he said that being a Dalit how dare you are to talk to me like this? (lkyk gfjtu pekj rqe pekj gksdj gels eqg yxkrk g)    

    In reply Sunita Devi said that food packets and Panchayat Raj books are provided by the administration, it is a right of each member to obtain it.

     

    This statement of Sunita Devi was very much irritating for Lalbahadur Singh; the Gourdah G.P member. He said to the other members of Dominant Caste those who were present there that how dare she is to retort like this being a Dalit woman (Chamar), let us gouge out her eyes. lkyk pekj gksdj bruk cksyrk gS lkys  pekj dks vWk[k fudky yks . Unexpectedly, Monoj Yadav attacked Suresh Mochi with a knife on his left eyebrow. He sustained terrible bleeding from his eyebrow.

    After the incident at 7.00 p.m Monoj Yadav, H/o of Nilam Devi, along with his other 3/4 supporters followed the couple putting mask on their faces while the victim couple were on their way back home. They met the couple on the way in between Salakhua village and Gouriwari village. They slapped Suresh Mochi 3/4 times and snatched Rs 500/- and a watch from him and threatened them with dire consequences if they reported the matter to anyone. The victims went to lodge complaint in the Salkhuwa P.S but the Incharge advised them to solve the matter through Panchayat instead of registering FIR. Later on Suresh Mochi lodged complaint in Saharsa court on 02.12.06. The assailants have been scot-free; the police have not arrested them till now.

Displacement of 40 Dalits families by government to set up degree college- Ustehad

  • Summary:: The incident of displacement took place at Ustehad village, Thesil Bajnath of District Kangda in H.P. In the village there are 40 Dalit families have been living since last 50-60 years. Most of the families belong to below poverty line. The government filed a notice on 5th November 2006 and asked all these 40 families to vacate the area because a degree college is being constructed adjacent to Dalit hamlet. When the villagers objected to the notice of the government, the S.D.M went to Kanta Devi who is the village president and demanded for an N.O.C. but she refused. Among these 40 families few of them have got these houses under Gandhi Kutir Yojna and some of them got through Indra Awaz Yojna. When theses villagers were granted this land to construct their houses, they were allotted measured land but not patta (land document). All the basic commodities like water, electricity etc has been provided by the government. The villagers have been giving house tax, water and electricity bills to the government time to time. The government believes that theses villagers have encroached government land and been living illegally. The villagers approached C.M of the state. They were ready to give away their land with a condition that the government has to rehabilitate them; however the C.M of the state has not given any response to it till now. The 40 Dalit families which are asked to evict the village are living at Ward no. 01, at Ustehad, under Kangra District of Himachal Pradesh since 1962. The pieces of land were given to these families by the state government. The dimensions of the land area was decided/ measured by Patwari. In 1974, the government announced that this land area is given to the 40 Dalit families forever. The 40 families comprise of SC and ST communities. Their economic situation is very bad but the government paid no attention except providing them electricity and a few hand pumps for their drinking water. A few families have even been granted with the Indira Awas. The majority of the Dalit population there depends upon their daily wages. The government has provided the families with no proof of the ownership for their land. It is now therefore seen as unused land area and under the demand for building a Degree College by the local MLA Sudhir Sharma, the govt. granted for the area without doing any survey of the area. In building up of a Degree college, 35 “karnal,” of the land area is needed in which 28 “karnal rakba” is empty and 25 “karnal rakba” contains 40 Dalit families. Since Dalits are given no proof for their ownership of the land, they are ordered for the eviction from the land area. Dalits enjoyed living in the area since 1962. But their happiness was lynched when the notice for the eviction from the place came from the desk of SDM Sandeep Kumar on 15.11.2006 and ordered to evacuate their houses by 29.11.2006. Since then the villagers all SC and ST communities are begging for their livelihood and safety. They wrote their petitions for the exemptions of their houses to various personnel like SDM (civil), the village Panchayat officer at Ustehad, the Tahsildar, panchayat Inspector, etc. but Dalits meted only with discouragements. Only petitions are submitted by the Dalits of the village and no complain is registered yet. The voice of the Dalits are not heard else are asked to evict the place leaving their houses. The college is under construction. The villagers have not vacated and have applied for a stay order, but they haven’t got any stay order.

Police Personnel Tortured a Pregnant Dalit Woman

  • Summary:: Ramshree (33) W/o Mohendra (35) is the resident of Tahirpurwa village under Shahavad P.S, Hardoi District- Uttar Pradesh. On 15th Nov’ 06 at about 7 a. m Radhe Syam from Rengwa village, P.S Majhila, Janpad Hardoi came with Constable Shyam Saran Tiwari, and other 4 police from Shahavad P.S went to her house while she was engaged in manual work. Without warning they kicked the door of Smt. Ramshree open and entered into the house. Shyam Saran Tiwari, the constable kicked and beat harshly to her husband Mohendra. Seeing that Smt. Ramshree asked him for the reason of beating her husband, but unfortunately he turned towards her and kicked on her belly with much strength saying “Sali chamti tu hamse bahes karengi, Sali ka bocha paida honese hi mardo kyunki yah bhi paida ho kar bawal karega” You are arguing with me, kill the child in the womb itself before it is brought up, or else this will also create problem in the future. Ramshree lost her consciousness and fell to the ground due to pain in the womb. The police took her husband Mahendra to the Shahavad P.S and locked him in the Shyam S. Tiwari’s room. On 17th Nov’06 she was admitted in the Government Hospita in Hardoi due to severe pain in her womb. According to the prescription of Dr. Manju Rathode the womb had been perished due to terrible bleeding caused by the police beating. She washed her womb in the Hospital itself. The Doctor advised her to remain for a week in the Hospital, by the time her husband had been left on bail. The fact behind this incident is that, Mahendra, husband of Ramshree was going to Mobeshiyan village carrying with him Rs. 12’000/- to purchase Buffalo from Chameliya Mela on 11th Oct’06 at about 2.00 p.m. On his way to Chameliya Mela at Kumbhrawa Bridge, Radhelal shouldering a license gun and his son Pintu with non-license gun and Puttle S/o Ikshar from Jamush village, Majhila P.S of Hardoi Janpad came out and snatched away all the money from him. Soslam S/o Nathyu and Hobib S/o Imbahim went running to the spot when they heard him shouting for rescue. The perpetrators run away warning him strongly that they would kill him if he complains against them in the police station. Mahendra complained in the Majhila police station, but police did not take action against this. So he lodged complaint against police u/s 156 (3) for negligence of their duty. On 27th Oct’06 again he gave an appeal letter in order to initiate action against his petition. On 5th Dec’06 the Court gave order to investigate the matter. Because of this police officers were against him. Mahendra also lodged complaint against Radhelal and others who looted his money. Though police later summoned to the accused u/s 151, police released him free because he bribed the officers and insisted them to take revenge on him.
