Brutal Assault and Denial of Civil Right Malaipalayam PS

    Eichampalli Keeramadai village is in Modakurichi Union, Erode Taluk, Erode District. This village is home to nearly 150 Arunthathiyar families. Around their village, dominant caste hindu Kounders are in majority and they owns all the agricultural lands. Most of the dalit Arunthathiyar families are working as daliy wage farm labourers in the agricultural fileds owned by the Kounders. They lack basic facilities for their decent survival. Due to scarcity of housing land, some of the Dalits built thatched houses in the government poromboke land adjacent to their village. On noticing this Senthilnathan Kounder raised objection to this occupation and threatened to burn the houses if it is not removed. But the Arunthathiyars rejected his objection and insisted to stay in the poromboke land. Senthilnathan and Chinnasamy said that they are going to built a park over here and asked to move out of the occupied land. Hence on confirming that this land belongs to government, they filed a petition with the District Magistrate seeking provision of housing patta for the newly built houses. But the District Administration is negligent to fulfill the request of the Dalits. In the mean while, Chinnasamy filed a petition with the District Administration seeking denial of housing patta for the Arunthathiyars over this land. 

     

    On 29/03/09, around 10pm Senthilnathan, Chinnasamy, Sakthivel, Selvan, A. Sengappan, V. Mani, K. Karthick, A. Velusamy, Chinnappan, R. Bhupathi, Vishwanathan, M. Kuppusamy, Tailor Kumar, M. Shanmugam, M. Anandhan, K. Duraisamy -  belongs to dominant caste hindu Kounder community, burnt the five houses of the dalits, which were built in the government poromboke land. As the 5 houses were burnt, Mayilsamy, Bahavathy, Velusamy, Rajchitra and Moorthy families rendered homeless. A case was filed against the perpetrators, but the police arrested only two of the perpetrators namely, Senthilnathan and Duraisamy kounder.

     

    On 30/04/09, Palansamy Kounder, Jagadeesan, Saravanakumar, Thangavel, and Ganesan belongs to Kounder community, who were in support of Dalit Arunthathiyars were brutally assaulted by Suryamurthy, Murugasen, Dhanasekaran, Senthil and others. Hence police arrested 3 of the perpetrators. Palanisamy Kounder who sustained severe injury, is in coma stage.

     

    Later the District Administration provided Rs. 150000 as compensation to the victims. The case was dismissed in the Erode Sessions Court.

    Victim Bhikhan Das is a school teacher in Amruta village and belongs to Dalit community. Manoj Ku. Ray is the ex. school teacher and both Ranjan Kumar and Dhiren Sen Gupta is bank employee. Amount of Rs.5 lakh and40, 000 had been sanctioned to the school for class room building. But three of the accused are involved to mismanage the money.

    Legal Standard Breached:

     

    1.       Everyone has the right of life, liberty and security of person [Art. 3 UDHR and Art. 5(b) CERD].
    2.       General recommendation 19 of CEDAW relates to gender-based violence and recommends amongst other things that states should take all legal and other measures that are necessary to provide effective protection of women against gender-based violence including effective legal measures (including penal sanctions), preventive measures (including public information and education programs) and protective measures.

CHEATING AND DESERTION OF DALIT WOMAN Nallakunta

    Anantula Padmavathi, SC Mala by caste married Dr. Kandula Srinivasa Gupta, OC- Vishya resident of Nallakunta, Hyderabad on 8/12/2000 in the presence of his and her friends at his house when his family members were not there in the house. He convinced her to stay in a hostel and promised her to take her home after financially strengthening and convincing their parents. In 2002 he married another girl of his caste. When Padmavathi questioned him in the presence of her parents, he told her that his parents warned him that if he denies marrying the girl of their choice, they will kill both or else they both will die. He assured Padmavathi’s parents that he shall take good care of Padmavathi.

    Due to the pressure of her parents he took a rented house for her. They stayed together for one month and from then on he started harassing her for a dowry of Rs 30 lakhs to take care of her. Even her in-laws abused her over phone and warned her of dire consequences. They also forced her to give Rs 30 lakhs as dowry.

    In March 2009 he took away marriage photos, certificates, her diary, money, gold and has not come back to home. He hardly answered her calls and used to say that he was under spying and not to meet him. She also said that Srikant Muralidhar- CMD, Homeocare International has warned him to get rid of her or else he shall cancel his partnership. She was left in a helpless state,  thrown out of house due to nonpayment of rent and couldn’t get a job as her certificates were taken away by Gupta.

Murugan Murder Case Kovilankulam PS

    Caste Hindu Communities Yadhavas, Chettiyars and Dalit Devandrakula vellalar  Community are residing in Senthatti Village, Shankarankoil Taluk, Trinelveli District. All these three communities are worshipping and conducting Puja at  Lord Muppidariamman Temple. In 2007 Caste Hindus yadhavas and Dalit Pallan community were jointly conducted puja festival. This leads to enmity between Chettiyars and Devandrakula vellalars. In this scenario, in the month of March 2008, Devanrakula vellalar community people were celebrating their community God Arulmehu Sudalaimada Swamy festival. During the festival some youths belongs to yadhava community disconnected the power connection and pelted stones on the Dalit community people. In sequence to this on 06/03/2009 evening Paramasivam (27), Eswaran (55), belongs to Dalit, were attacked with sickles and were murdered.

    Thus on 08/03/2009, Kallavandaan (40), Kottaisamy (51), Subbaiah alias Durai (35) and Shanmugaiah (41) were arrested and cases were filed against these perpetrators in Kovilaankulam Police station.

Illegal Occupation of Dalit’s Land

    K. Mariappan, resident of Kallampalayam, Susaipuram Post, Tiruppur District, belongs to Dalit Arunthathiyar community. In 1978, he received 0.98 cents of land from P. Ramasamy Kounder in Kararpudur village. He is cultivating in this land since then. P. Devaraj, P. Kumarasamy, Shanthamani w/o Kumarasamy, all belongs to one family, resident of Aarumuthaampalayam and belongs to dominant caste hindu Kounder community tried to occupy the land illegally. They inistigated one Rangasamy and asked him to forge the photo and sign with the Register office and changed the  ownership of the land to themselves. On knowing this, Mariappan enquired about this forgery. The caste hindus Devaraj, Kumarasamy and Shanthamani, who could not tolerate the assertion of a Dalit, trespassed in to his land and destroyed his crops. They verbally abused him referring derogatory regarding caste and threatened to kill him. They were harassing him since then and used to abuse him. Mariappan filed a complaint with the DSP Kamaraj. But the police department failed to take action against the perpetrators. Noticing the negligence, Mariappan filed an appeal with the Supreme court with the help of a social activist Mr. Selvakumar. Supreme court directed the DSP to take action the perpetrators and the police arrested Devaraj and Kumarasamy.
