  • Summary::

    Rakhama Bansode is resident of Malkavatha village under Mudrap police station in Dakshin Solapur Dist., belongs to scheduled caste community. Rakhama is a daily wage labourer. On 21 Sept, 2007, she went to fetch water from a well which is out skirt of the village, a man from Muslim community, caught hold of her, pushed down and raped her.

     

    A rape case was registered in Mudrap on 21/09/2007 against the rapist as No.73/07, u/s 376,506 IPC & 3(1)(xi), 3(2)(v) of SC/ST (PoA) Act. The case was investigated by SDPO Mr. Purushottam Karad. Charge Sheet in the case is filed on 23.11.07, No.82/07, u/s 376,506 IPC & 3(1)(xi), 3(2)(v) of SC/ST (PoA) Act. Victim has received compensation Rs. 25,000/- after the medical examination. Accused arrested but bailed out.

Dalit Family Robbed and Gang Raped

  • Summary:: On the night of 14th September around 12 in the night Chandan Singh along with 11 armed men with country made pistol and knives burgled in the house of Ram Charan. Everyone in the house was sleeping at that time. The gang asked Ram Charan and his sons Jhuri lal and Chote lal to hand over all the valuables and cash or to face dire consequences. Then they locked all the male members in one room and females in the other room. In the mean while Chandan Singh asked Shashi Kala wife of Chotelal to come out to have a word with her. Terrified Shashikala who had a baby of 15 days came out and Chandan Singh raped her in the hut while his aides were busy in robbing the house. Then the other members dragged Sangeeta w/o of Kamlesh and d/o Ram Charan in the hut and three persons raped her and again locked her in the room along with the other family members. The other members dug the two rooms in order to search for the jewelry. One of them was continuously guarding all the activities. After that Chandan Singh and his gang robbed all the cash, jewelry and 3 quintal food grains. They did not even leave the clothes. After the gang went away the family members of Ram Charan somehow managed to come out of the room by breaking the window and raised an alarm but by that time the miscreants had already gone. On 15.9.07 the terrified family went to the police station but the police did not take any action. On 19.9.07 again the victims went to the police station and lodged the complaint and police caught hold of perpetrator Chandan Sing and put him in jail but released him next day. During November private complaint was filed in the court. On 04.5.08 Charge sheet was filed in the court by the police by saying that there is no evidence of rape and robbery. Charge sheet submitted on 16th May 08 that says no Prima facie. Charge sheet is challenged in the court by the victim. No compensation as per SC/ST (PoA) RULES 1995till date. Perpetrators yet not arrested. Victims are under continuous threat by the perpetrators.

    Case in Brief

    Badugu Vani, D/o B. Satyanarayana, aged 20 years, resident of Baduguvaripeta, Uppalaguptam, East Godavari district.  She belongs to Scheduled Caste. Madhura Swamy Naidu, aged 22 years, resident of the same village used to harass Badugu Vani, by saying that he is in love with her.  She refused his proposal saying that she is not interested.  He threatened saying that he would kill her, if she doesn’t love him.  He promised that he would marry her and ultimately succeeded. He put Thilakam on her forehead saying that they were married.  And he gradually developed a physical relation with her.  She conceived and informed the same to him.  He refused to marry her as she is economically backward and married another woman of his caste. The Victim delivered a baby. DNA test was done. 

     

    On 13th September 2007 a complaint was lodged by Vani in the Uppalaguntam PS against Madhura Swamy. FIR was registered u/s 417, 419, 493, 506 r/w 34 on the same day.

10 Dalit Youth Lynched on Theft Allegation

  • Summary::

    Dominant Caste Villagers of Dhelpurwa village near Hajipur in Vaishali District of Bihar State attacked 11 Nats by alleging them as thieves and lynched 10 of them to death. (Nats come under the SC Category in this State) on 13th September. One seriously injured was hospitalized in Patna Medical College Hospital. The victims were identified as residents of Tajpur block of neighboring Samastipur District. This horrible news was carried by all Local and National Dailies and TV Channels.

     

    On 13.09.07 there was a overnight Dance Program in the village and it was over in the mid night and these 11 persons came for witnessing this Dance Program and slept there for some hours to take rest as it was midnight   and left around 4.30 am for their houses which is 10 km away from this village where the program was organized. Victims had an altercation with an Auto Rickshaw Driver who demanded more money to drop them at their place of residence, which resulted in the Auto Driver, just raised voice as “Thieves “Thieves” and many slept nearby came running and bashed all the 11 and two out of 11 fell dead immediately and the mob decided to kill the rest to eliminate them as they are the eye witnesses.

     

    The National Commission for Denotified Tribes and Nomadic Tribes and Semi Nomodic Tribes visited the Place of occurrence and came out with a Press Release condemning the Incident and the inaction of the Government. Following are the Commission’s Observations.

     

    This murder was alleged to have been   committed at 4.40 am on the 13th and it was also alleged that around 5000 people chased and caught the Victims. The Local Police of Rajapakad Police Station claims that they completed their Night Patroling by 4 am on that day, and it was surprising that how it was possible for 5000 persons to assemble within 40 minutes time in the place where the Patrolling was also over just a while ago. It is unbelievable that the villagers live in small pockets, scattered around their cultivable lands have assembled    at this wee hours to chase these Victims.  One of the villagers whom the Team met, shared that there was a Overnight Dance Program and it was over in the mid night and these 11 persons would have come for witnessing this Dance Program and slept there for some hours to take rest as it was midnight   and would have left around 4.30 am for their houses which is 10 km away from this village where the program was organized.

     

    There was another saying that the Victims had an altercation with an Auto Rickshaw Driver who demanded more money to drop them at their place of residence, which resulted in the Auto Driver, just raised voice as “Thieves “Thieves” and many slept nearby came running. It was also the version of some that we met that, there was a heated argument between the 11 persons and the Auto Driver and also the others who came running hearing the word Thieves. In the mean time many more joined and bashed all the 11 and two out of 11 fell dead immediately and the mob decided to kill the rest to eliminate them as they are the eye witnesses. It is a mystery how the Local Police Personnel who just completed their Patrolling did not hear about the voices of 5000 people, but came to the spot only around 5.45 am, late by an hour although the Police Station is situated within half a km distance from the place of murder. 

     

    It is also surprising how these 5000 people returned to their homes quietly and the Local Panchayat President, a Lady, did not know all these, although she lives within a radius of 2 kms from the place of occurrence. It was disturbing that the Panchayat President visited the spot at 9.00 am only as she claims that she was informed only around that time. While there was no theft complaint by any one in that area was made with the Police, it was a wonder that the mob handed over some small gold ornaments telling that they collected them from the bodies of the deceased. This seems to be a cooked up story to prove that they are thieves. It is still more surprising that most of the persons except one or two, whom the Team met, shared the same version that the persons killed were “thieves” and all the 5000 people attacked them and also no one knows who attacked them in the close range. It is also surprising how Officials and Media confirmed, carried and propagated an impression that the Victims were “thieves” when there was no evidence to prove that there was a criminal record pending on the victims in the local police station and No complaints whatsoever was made against them. 

     

    It was shocking that how the bodies were cremated deliberately by the Administration and Police much against to the Rules and Regulations dealing with the unclaimed bodies. It is all the more shocking and mockery   to note that a case under Crime Number 138/2007 was registered in the Police Station under section 147, 148, 302, 307 and 358 and no one was arrested till today for the cause of death of 10 persons. But the next Crime Number 139 / 2007 was registered under section 457, 380  under  which the Hospitalized Victim was arrested by the Police, the victim  was discharged from the hospital on 18th  September and sent to Judicial Custody for the stealing of a few gold ear rings.  Also no complaint what so ever was lodged by any one that they lost their small ear rings!

     

    Although the Culprits and the Police know pretty well that the murdered persons are the Tribes living in 10 km distance, it is surprising that this case No: 138/2007 did not invoke sections  3(1) (x), (xv), & 3(2) (i), (v) of  SC/ ST (POA) ACT 1989. It is abominable that the District Administration even after 10 full Days of this gruesome murder claims that they were not able to trace out the families of the Deceased and also the Police did not arrest even a single person for this   murder. It was highly disturbing that No adequate effort was made by the District Administration to trace out the Families to offer Relief and Rehabilitative measures spelt out under SC/ST (POA) Rules 1995. No action whatsoever was initiated against the Village Panchayat President who did not care about what had happened in her village and simply sat quite as if it was a very ordinary incident while the lives of 10 Human Beings were brutally taken away by some miscreants. No penal Action against  the erring Police and Administration Officials was initiated under section 4 of the SC/ST (POA) 1989 except the DM and the SP were transferred and the another 4 lower level officials were suspended.

     

    This type of inaction and the lethargic attitude of Police and the Administration will give a free hand to the Non Dalits to Harass and Kill the Dalits in future also as they will be left scot free. 

    When Indian Police and the Administration is capable enough of nabbing even Terrorists and Militants within hours of the incident, it was shocking that  why they were not able to arrest the Culprits and also why they were not able to trace out  the Families of the deceased even after 10 full days of this occurrence. It is evident that the CM and the Council Ministers have not given adequate importance to activate the Criminal Justice Administrative System to perform their Legal responsibility except by organizing a meeting of Officials. Even after that the status quo remains the same as No arrest was made till date. The impunity being enjoyed both by the Non Dalits and the Bureaucrats   was not checked and cracked by the Political Rulers of the State.

    It appears that there is no Political or Administrative will to render justice to the Victims. Nowhere in the Legal Jurisprudence that the “Vigilance Justice” was allowed to take place in our country where Rule of Law alone reins.   

     

    PIL No. 14624/07 was filed by the NCDHR in Patna High Court with the prayers for implementing the SC/ST (POA) ACT and Rules 1995. Same was admitted with the final orders to the state government to implement the same as early as possible. All Victim got Rs 10,000/- on October 07 and Rs 1,00000/- on November 07. 12 accused were arrested but bailed out. Investigation was done by CID Police Inspector, CID DSP.

Attack on the Dalit Activists while they were demanding the land for the landless Dalits

  • Summary:: While 88 of the Satyagarhis of the Pad Yatra were arrested in Moonak, the rest of the Pad Yatries numbering 165 were determined to complete their incomplete task as per the original schedule. They did not discontinue their Pad Yatra but were full of enthusiasm to continue their Pad Yatra as originally scheduled. In spite of provocations from landlords and police, they continued their Pad Yatra through peaceful and non violence method. Accordingly the Padyatries restarted their Pad Yatra from village- Kahangarh of district- Mansa on 13th to be specially mentioned that the remaining Pad Yatries were all young and youthful. Hence, it was apparently led by youngsters of DDVA activists consisting of Ms.Prabhjot Kaur, Mr.Jagseer Singh, Mr. Jaskaran Singh, Mr. Jagjiwan Singh and Mr. Sukhdev Singh, all within the age group of 20 to 30 years. They stayed the previous night at Majhabi Dharamshala of Village- Kahangarh and started collecting for Pad Yatra near the Dharamshala the next morning on 13th the village main street raising the demands of liberation from bondage and access of land to the landless. They crossed the out skirts of the village and reached the railway crossing near the Mandi (Grain Market). There were large numbers of landlords already collected near the grain market. It was also a festivity day for the local Malwa villagers which they celebrate as “Bhadroduji”(Indicating the intervening rainy month).It may also be mentioned that they were also simultaneously prepared to prevent the DDVA activists from proceeding further. They also started acting violently by pelting stones at the DDVA activists from railway track where abundance of stones were available. In such a planned stone throw many of the youngsters suffered from severe injuries. More than 100 landlords were involved in throwing stones on the Pad Yatries. The local police was a mute spectator to the entire violent scene. There were only two policemen who were present on the scene to control the situation. The landlords were further enthused to continue with their violent activities. Apart from pelting stones they also started beating the Pad Yatries mercilessly with Lathies. The Pad Yatries did not anticipate such violence and in order to protect themselves they ran helter and skelter towards Majhabi Singh Patti Dharmshala of village Kahangarh. The landlords did not even spare destroying the properties of the Pad Yatries including their ration, clothes and other belongings. They also physically caught hold of some Padyatries and kept them under their physical custody. Noteable among them was one woman named Manjit Kaur who was kidnapped by the landlords and was separated from the Satyagarhies for two days. She was forcibly taken away by six adults and locked in a room where she was confined for two days. With great efforts she could free herself from the locked room and reached Civil Hospital Mansa with great difficulties. (Desh Sewak, 16th)In the confrontation deliberately prompted by the landlords of Kahangarh, 18 Pad Yatries were seriously injured and were immediately given first aid in Bareta and Budhlada Primary health centre. The next day that is on 14th Though more than three dozen activists were badly injured, but those who were seriously injured included Mr. Jagsir Singh, Jagjiwan Singh Advocate , Prabhjot Kaur, Pal Singh, Jaskaran Singh, Shingara Singh, Hameer Singh, Sukhdev Singh, Parvinder Kaur,Mukand Singh, Balvir Singh,Maidita Singh, Shingara Singh,Pirdiyal Singh, Gagandeep, Manjit Kaur, Bant Singh. They were admitted in Civil hospital Mansa. he Station House Officer Bareta Mr.Chet Singh reached the spot of the incident. The Pad Yatries requested him for help but he bluntly eplied “I have arranged this attack and I will not do anything against the landlords; you can even go up to DGP; I do not bother about anyone”; later Deputy Superintendent of Police, Budhlada also reached the spot and controlled the situation. Apparently the SHO, Bareta seemed hands in gloves with the landlords and that also appears to be one of the reason for the lack of police protection when the incident took place. The DDVA activists filed FIR at Bareta police station (FIR no: 62 dated 13th 148 and 149 of the Indian Penal Code. DDVA activists had submitted a list of 150 landlords involved in pelting stones and causing injuries to Satyagrahies but the FIR mentions only the list of 13 landlords as listed below: 1. Kishan Singh 6. Bir Singh 11. Kaka Singh 2. Karnail Singh 7. Amrik Singh12. Jassa Singh 3. Raj Singh 8. Sukhdev Singh 13. Gurmail Singh 4. Balwant Singh 9. Tarsem Singh 5. Sito Singh 10. Ranvir Singh All were residents of village- Kahangarh. 36 Satyagrahies were seriously injured due to the attack of landlords. It may be mentioned here that DDVA had adequately informed the Deputy Commissioner, Mansa on 11th administration failed to make adequate security arrangements. The attack on the DDVA activists was an organized attack and was not a spontaneously generated heat on the occasion. That is why the landlords were given free hand and even after reporting of the incident there was not a single arrest of the landlords. The Challan was not presented in any Court.The landlords were not satisfied simply by indulging in violence resulting in severe injuries to the Pad Yatries but they were prepared to take it to a logical conclusion. This is evident from the fact that the landlords of the village had imposed social boycott against the dalits and other weaker sections of the village. The grocery shops were instructed not to undertake any form of economic transaction with the dalits. It was also announced openly from the village Gurudwara loudspeaker that none of the land owner should engage in any social and economic relation with the dalits of Majhabi Mohala. It was like an edict pronounced by the landlords of the village that the dalits should also not be engaged as daily wage labourer by any Jat employer and they should also not provide any fodder for their cattle. In order to give further effect to this, the landlords were asked to contribute Rs.20 per acre for meeting the cost of planned confrontation with the dalits. The press reporters who went to Kahangarh the subsequent day were stunned to find that the Kahangarh village was divided into two antagonistic camps of upper caste land owners versus dalit landless. The announcements in gurudwara for contribution of Rs.20 per acre were also made in the presence of the press reporters the persons injured were discharged from Mansa Civil Hospital and brought to Phillaur DDVA head office for further treatment and assistance.
