Lata Babulal Bansode is resident of Mandwi village in Amravati Dist., belongs to Mahar (SC) community. On 25/10/07 as it was an auspicious day as per Hindu calendar, victim’s mother in law went to neighbor’s house to bring Prasad and victim was alone at home. Taking the advantage of her loneliness, the perpetrator broke into the house, clutched her mouth tightly and attempted to rape her, but she managed to scream out. On hearing the noise, the neighbours rushed there, meantime the accused escape the place.
On 26/10/2007, a case was registered in Chandur Railway police station against the accused person as No. 958/07, u/s 452,354,323 IPC & 3(1)(xi) of SC/ST (PoA) Act. Perpetrator is arrested and he released on bail. The victims received a compensation or Rs. 25000/-. Case is transferred to Amravati Session court, First hearing 20/08/08.
Case in Brief
The accused is a doctor. He raped the victim who came for treatment. With the help of his colleagues he tried to foster the case. As he is member of a political party, he and his followers threatened the dalits in the village not to give witness.
Varudhamoothy S/o Muthan belongs to dalit community, reside at pattchapalayam Village, Pallipalayam Union, Thiruchangodu taluk, Kumarapalayam police jurisdiction, Namakkal District along with his wife namely Ms.SAlammal, daughters Nithya (11), Kousalya(6) and son Prasanth (8). He is a coolie worker.
His daughter Nithya (11) was studying 5th standard in the government middle school which has been located nearby her house. On 16.10.2007 she went to Athiparasathi temple where she done a prayer, then she came out form the temple. During that time one boy namely chinnsamy(13) belongs to Gownder community was standing in fornt of the temple. He looked at Nithya and asked her “how did you enter the temple inside Chakkiliya Mundai” in between another boy namely Kavin (12) who is belongs to Naidu community. He also looked at her and asked how did you enter the temple inside “chakkiliya naye(dog)”. He badly scoled her, derogatory referred her caste name and severely beaten her by his left hand on her back side twice. She was not able to bear the pain though she was crying standing near to temple.
During that time her father Mr.Varuthamani was returning from his work and found his daughter was crying on the way. He asked what happen why are you crying. She was narrated they she was brutally attacked and derogatory referred by caste name by the boys namely Chinnasamy and Kavin. Mr. Varuthamani took her daughter on around 7.30 pm and went to kavin’s home. But before reaching Kavin’s home there Mr.Tanapal, Baskar and other 10 persons who belongs to caste hindu community standing on the way to Kavin’s house. So first he was approached them to seek justice. But they were got angry and told him that how dare are you? You came to us and complying about our boys? You “Sakkiliya” during that Mr.Dhanapal pushed him by putting his hands on his chest. Mr.Varuthamani was fell down then they wrere kicked him on his various parts of the body. He was pleaded them to leave, but they were continued. Then he and his daughter came into their hamlet informed the incident to his brothers. They were shocked and they approached the village leader namely Ramasamy belongs to the Gounder community and narrated the inicdent. He insisted them to compromise. Following that mr.Senthil and other 20 caste hindus casme to the Arunthathiyar hamlet with more angry and they brutally attacked the Arunthathiyar who were standing there namely Mr.Chinnasamy, Maniyan, Sivaraj and Ladha. Mr. Chinnasamy and Mr. Maniyan were severely beaten up by them they got severed injury on their head they admitted in the Erode Government hospital. Police filed the case and charges were filed on the court but this case was acquitted in sessions court.
Bhawari Bhai (12) d/o Annaram Meghwal is r/o Vill/P.S Chitalwana in Jalore Dist. The police officials came to the victim’s house and forcibly took the victim to a nearby village school and started inquiring about a murder of Dhook Singh by beating and hitting on her forehead against the walls of the room. Her forehead started bleeding and the child became unconscious. When she gained her consciousness, they again beat and took her to home and threatened her family. She was taken to the hospital by her family members but there she did not receive a proper treatment, as the police strictly instructed the Doctor not to provide medication to the child. They went to Gujrat for treatment. Later on 16/10/07 FIR was registered No. 111/07, u/s 365,342,323,504 IPC & 3(1)(x) of SC/ST (PoA) Act. against the accused only when the father - Annaram filed a petition in the Court and the court ordered the police to lodge FIR.
The police submitted charge sheet 23.12.07, No. 39/07, u/s 365,342,323, 504 IPC & 3(1)(x) of SC/ST (PoA) Act. in the case. The Chairperson of State Women Commission Tara Bhandari visited the office of District Collector in the month of October 2007 regarding the case but no action was taken by the State Women commission also.
