Case No. 37 Abduction of Dalit Minor Girl

  • Summary:: Resham Singh S/o Karam Singh, R/o Village- Tharajwala, tehsil-Malout, District- Mukatsar. He belongs to Scheduled caste. Resham Singh filed a writ petition against the State of Punjab and officers of the Punjab Police in the nature of habeas corpus for directing them to release or produce in the Hon’ble High Court the detenue namely Satvir Kaur daughter of writ petitioner Resham Singh from the clutches of the accused persons. The High Court called up the Respondent Viz SSP Mukatsar to be present in the Court. Respondent Senior Superintendent of Police Mukatsar appeared before the Hon’ble High Court and filed an affidavit stating therein that there is a strong party faction in village Tharajwala and the named persons were living peacefully in the village and have no role in the disappearance of elopement of Satvir Kaur. FIR was registered in connection with the abduction of Satvir Kaur d/o petitioner Resham Singh. A reply was filed by the respondent SSP Mukatsar mentioning that “Investigation at this stage indicates that Satvir Kaur has eloped with Constables Jasmir Singh and Gurtej Singh gunmen of President Punjab Youth Congress of Guru Har Sahai, District- Ferozepur. She was last seen at PCO of Gurmej Singh at Moga while leaving for meeting Constable Gurtej Singh.During the pendency of above mentioned writ petition, the respondent Resham Singh filed Crl. Misc. NO.213 of 2007 in Crl.Writ Petition No. 629 of 2006 (L&M) U/S 482 of Cr.PC, directing the respondents to hand over the investigation of this case to some independent agency like CBI. Single judge of Hon’ble High Court was pleased to pass the following under:- “In view of inability of Punjab Police the DIG, CBI, Chandigarh is directed to produce the detenue with in four weeks from receipt of a copy this of order. The DIG shall, if it comes to his notice that the police have intentionally not produced the detenue, proceed against them as per law” Hence the C.B.I. filed a petition under Article 136 of the Constitution against the interim order dated 23.7.07 passed by the High Court of Punjab & Haryana at Chandigarh in Criminal .writ petition No.629 of 2006 (O&M). As the State level politician is involved in this case therefore, neither police nor does CBI show interest to trace the girl. The case is still pending.

    Case in Brief

    Shilpa was playing with other children in a house under construction, near to her house.  Sri Ramulu habitually comes to that village for gambling.  On 6th November 2007, he was consuming alcohol and sitting near Sri Rama Temple where Shilpa was playing.  He called her towards him saying that he would give chocolates and took her inside the house which was under construction.  There he removed her clothes, made her lay down and raped her.  Meanwhile, the owner of that house, Auto Subbarayudu happened to come there and on seeing that incident, he shouted at Ramulu for what he was doing.  Ramulu pushed him and escaped from that place.  Shilpa was already bleeding and was crying.  He immediately went to the place where her parents work and informed them.  They came home and saw that the genital organs of the girl were bleeding and the girl was shocked of the incident.  The villagers searched for Ramulu and found him hiding in the godown in the village.  They caught hold of him and beat him.  He did not answer to any of the questions and the villagers and parents of Shilpa lodged a complaint in the Kamalapuram PS and handed him over to the police.  An FIR u/s 376 r/w 511 of IPC and u/s 3(1)(xi) and 3(2)(v) of SC/ST (PoA) Act was registered.  The SI sent the girl in ambulance to RIMS hospital for medical examination.  The accused is arrested.

     

    DSS Intervention:

    • DSS on receiving the news from newspaper, immediately conducted fact finding and represented the case for alteration of section to the commissions

A Dalit Abused for Objected to Dumping Excreta in Front of His House Premises

    Yellabelli Eswara Rao (35) s/o L. Appanna, Salapuvanipalem, Parawada Madal, Vishakhapatnam District belongs to Scheduled Caste (Madiga) and lorry driver by occupation was abused by his caste name and beaten mercilessly. The accused Marepudi Apparao s/o Sanyasi Sandi belonging to Kapu caste has a piece of land and adjacent to the house of the victim Yellabelli Eswara Rao. The accused was transporting gravels to the field in front of the victim’s house. As a result, the canal at the east of the house was damaged. Thus, there were pits in front of the house and the rain water stagnated there that breeds the mosquitoes.

     

    On 3-11-07 at 11 am, the victim asked the accused not to transport the gravel in front of his house. Therefore, the accused got angry with the victim and began to abuse him in his caste name saying “you, Madiga bastard, son of a bitch, who would save you if I beat you now”. While the women belonging to the Dalit community were passing through the field of the accused, he retorted by saying “I will make those bitches naked there itself”. Saying so, he went towards the victim to beat him. The accused Marepudi Apparao and his brother-in-law Gundala Kanna Rao made a fence with thorn bushes across the way abstracting the customary passage. There were Malla Chinna Demudu and Marepudi who actually saw the incident. The victim went to the village sarpanch and informed him about the incident, but he refused to take any action against the accused by saying that he will not listen to me.

     

    After that Yellabelli Eswara Rao lodged a complaint before the police Anakapalli Rural and police registered a criminal case in crime No. 164/ 07 dt. 6-11-07 u/sec 3(1)(ii)(x) of SC/ST (PoA) Act. The police arrested the accused at the investigation stage. Compensation has not been paid to victim and charge sheet not filed.

Attack on Dalit Families & Destruction of Property to Encroach upon Land

    Pannivella Arjunamma & 12 other Dalit families are r/o Lakkavaram village under Chodavaram P.S. in Visakhapatnam Dist. After the land settlement survey, 12 dalit families of Lakkavaram were conferred 5 acres of Subarna Rekha Tank bed land rights bearing plot no 39 to 46; however this was not appealed to Nadigotla Kalyanam Senapathi Sreenu Sarpalli Vermaraju Palle Jagarnthathdam belonging to dominant caste of the same village. Once, the above mentioned persons destroyed the crops of Dalits. Then a complaint was lodged and compensation was paid to the victims in a comprised reached between them. And again the victims resumed the enjoyment and raised banana, brinjjal, sarugudu plantation in the field.

     

    On 28/10/07 at about 8 a.m. the victims Pannivella Arjunamma, Mudi Ramuluamma, Erravarapu Parvathi and Korupalli Pavani, Erravarapu Mahalaxmi, Peddamatla Devudu, Uppmaka Satibabu, Korupalli Yesabu, Latala Chinna Devudu, Eravarpu Shimhachalam went to the field to water the plants. The accused namely Nadigotla Kalyanam Senapathi Sreenu Sarpalli Vermaraju Palle Jagarnthathdam abused by caste name and beat them by saying that the land belongs to them.

     

    On 28/10/07, a criminal case No 128/07, u/s 3 (1)(x) SC/ST (PoA) Act & 323, 324, 384 of IPC was registered at Chodavaram police station. Accused have not been arrested. Compensation not paid to victims. Charge sheet not filed

    Mr.Papa W/o Late.Ganapathy belongs to dalit community, reside at Kasilingapuram, Singathakurichy post, Ellanayakkanpatti Via, Tiruvaigundam Taluk, Tuticorin District. Her husband was died 20 year before. Since she was living with her father, but her father also died few years later. She working as a agricultural daily worker. On 02.11.2007 nearly on 1.00 o’clock puliyampatti police inspector Mr.Vimalganth, Sub Inspector Ms.Gandhimathi and other police officials entered her house. They were abused in filthy words and derogatory referred by caste name. Palli prostitute sold the jewels from lakshmi house. They were brutally attacked her and they asked where is the jewels. They were damaged the household vesicles and they checked jewels in her houses.

     

    They were pull her in to police van and send to Puliyampatti police station. They were tortured her in police station. While torturing she went to unconscious stage. She have several injuries in her body her hand got heavy injuries. Then police were asked villagers to bring her to home. Since they were bring her to government hospital. She was admitted in the hospital. She got several injuries her body since she got treatment in hospital. Police denied to file case in police station.
