Case in Brief
Kandikatla Rani, aged 23 years, SC by caste, native of Godarigunta village, Kakinada. She migrated to Singapore in search of livelihood. There she met Abbavarapu Ramakrishna, aged 21 years, BC – D by caste who is native of the same village. Their acquaintance gradually lead to love and they got married in the year 2006. They returned to India and she gave birth to a girl child. Whenever Ramakrishna harassed for dowry, she used to go to her parent’s place to get money. He used to continuously harass her for money. After a child was born, he started harassing her saying that it is not at all a marriage, and if he should continue living with her, she should give him a dowry of Rs.4, 00,000/-. In case she fails to give the demanded amount, he would cause any kind of harm to her as quite a few of his relatives are in police department. Unable to bear the harassment, she complained in the Sarpavaram PS. As the police did not take proper action, she approached DSS.
Interventions:
Ashwini Sham Kasbe is resident of Lave village, Tal.: Madha, Dist.: Solapur, belongs to scheduled caste community. A Boy from Maratha community influenced Ashwini and forcefully raped her with pretext to marriage. However, after the crime, he threatened her to kill if she reveals the matter to anyone. The victim narrated the incident to her parents.
A case was registered in Kurudwadi police station against the rapist on 22/08/2007 as No.101/07, u/s 363, 366,376,506 IPC, 3(1)(xii) of SC/ST (PoA) Act. & 7(1)(D) PCR Act. Compensation of Rs. 25000/- is paid to victim by the administration. The rapist was arrested but bailed out. Charge sheet was filed on 22.08.07, No.77/07, u/s 363, 366, 376, 506 IPC, 3 (1)(xii) of SC/ST (PoA) Act. & 7(1)(D) PCR. The case is under trial.
Chidarla Ramanaiah, 39, S/o Nagaiha had three acres of poramboku land which he cultivated for 14 years. Two years back he lease out the land, Because of his domestic problems, to G. Mahendra S/o Kotaiah and family. After two years of cultivation they neither paid the lease amount nor surrendered the land.to the victim. When the matter was complained to the police, the police instructed both the parties not to cultivate land till further orders. But, on 31.07.07 at about 9 O’clock G. Mahendra’s family entered into fields. Then C. Ramanaiah and his wife C. Suseela objected to them. Accused returned with forty members on two tractors and abused them by caste, attacked them causing grievous injuries. They ransacked C.Suseela’s clothes and injured her head causing bleeding injuries. The accused left that place thinking both the victims were dead. They even attacked on their daughter. The victims were transferred to Kavali government hospital.
A case was registered under Cr.No 63/07 U/s 324, 341, r/w 34 IPC 3 (I) (x) SC, ST Act, before Jaladanki Police Station. The accused were not arrest. Charge sheet has not been filed so far. Compensation has not been paid either. A Petition was filed under 44 Cr.P.C seeking arrest of the accused. Another petition was. Filed under 173(1) Cr.P.C & Rule 7(2) SC&ST (POA) Act. Representation sent to collector & concerned officials. Petition filed under section 310 Cr.PC seeking the inspection of the place of offence by the Magistrate.
