A Dalit Attempted to Murder for Access the Right to Employment

    Avula Sreenivas, belonging to Mala (SC) caste regularly attends the works of Poli Papi Reddy, Poli Narsimha, and Poli Narayan Reddy daily. He gets Rs 50/- per day. Recently he got the work under National Rural Employment Guarantee Scheme (NRGES). It fetches him Rs 100/- per day. Therefore he stopped working at Narayana Reddy and went to NRGES work. For this Papi Reddy got angry and abused him. After that Papi Reddy, Narshima Reddy and others forcibly entered into the house, took him to the centre of the village, made him half naked and tied him to the pillar of the Sita Rama Swamy temple beaten him severely so that he became un conscious and vomited blood and beaten him with rod and sticks and gave hard blow on his head, which made him unconscious.

     

    A case was registered under section u/s 147, 148, 307, 342, 324, 323 r/w 149 IPC 3 (2) (v) 3 (1) (iii) (ix) (x) of SC/ST (POA) Act. The counter case is filed under Cr No 52/07 u/s 379 IPC Manur police station filed against the victim Avula Sreenivasulu was referred as false as on 31/07/07. There are 11 witnesses in the case. 11 victims were paid an initial compensation of Rs. 6, 250/- each i.e. total of Rs. 68,750/-. The case was dismissed and the accused were acquitted because the victim turned hostile before the court.

    Case in Brief

    Chintala Vijaya, aged 38 years and Chintala Paidaiah, aged 45 years are married and have two daughters Chintala Durga, aged 20 years and Chintala Nookaratnam, aged 18 years. They reside in Tarakaramanagar, East district.  They belong to SC, Chachara caste.  Vangala Yesu, Konda Kapu by caste, resident of same village, habitually harasses women.  He is married and is having extra-marital relation with two women.  One day, Yesu has seen Durga while she was going to market and said that he would marry her.  She refused and said that she would complain to her elders about that.  Since then, Yesu started harassing Durga sexually.  Durga complained to her mother Vijaya.  Vijaya immediately approached Yesu and asked him not to harass Durga.  Yesu did not bother her words and replied carelessly.  This made her angry and she admonished Yesu.  Yesu felt insulted that a dalit woman has scolded him.  He planned to take revenge on Vijaya and her daughter Durga.  On 2nd June 2007, he attacked Vijaya’s family.  He hit Vijaya on her cheek so hard that blood came from her eyes and also broke her leg.  He also beat her husband and daughters and abusing her in the name of caste.  

     

    This incident was complained in the Tuni PS on the same day.  They registered a case u/s 353 of IPC r/w 34 and 3(1)(xi) of SC/ST (PoA) Act but only Vijaya is included as victim.  The accused was arrested and released on bail.

A Dalit Dies in Road Accident due to S.I’s Failure to Act

  • Summary:: Late Balakram (40) resident of 61/3, Street No. 3, Ambedkar Vihar, Sector 37, Noida, belongs to Schedule caste (Chamar) community and profess Hindu religion. He was in the habit of going to Shani Mandir for worship every Saturday early in the morning around 4:00am to 5:00am with his neighbor Gopal since last three years. As usual on 02-06-07, Late Balakram and Gopal early morning around 3:00am went to Shani Mandir by bicycle. At about 4.00 a.m. Ishwari (35yr) w/o Late Balakram was informed over phone by the police that her husband met with an accident near Sec.38 A- Centre Stage Mall near Yamuna Bridge and he has been admitted in the Vinayak Hospital, Sec.27. Ishwari and her brother-in-law and children went to Vinayak Hospital and found R. K. Rastogi, the police Inspector and two constables- Rathi and Sirohi in the hospital. The police informed to Ishwari that your husband met with an accident near Sec.38 A- Centre Stage Mall near Yamuna Bridge and we admit him in the hospital and further they assured them that the police would arrest the perpetrator as soon as possible. Ishwari states, “My husband was badly injured only on his head and blood was flowing from his ears but not any part of his body, his accompanier had not been injured” At round 11:00 am the Doctors of Vinayak Hospital declared Balakram dead. The police handed over the dead body to the family members after the postmortem. The family members met all the expenses Rs. 22,000 towards treatment. After one week of the incident Ishwari along with her bother in law and children went to the Police Station-Sec 39, to enquire about the action taken by the police against the Perpetrator that the police had assured, for immediate action against the perpetrators. However the police personnel had hardly taken action the perpetrators. Finally on 10-6-07 Ishwari met to DIG, SSP and DM with a complaint against the inaction of the police personnel. After that FIR had been lodged against the unknown person on 02/06/07, u/s 279/338/304 A, IPC. During the interrogation with the victims and witnesses, it came to light that the accident took place in the presence of S.I, who was on duty, but neither he arrested the culprit nor initiated action against the culprit. Police is doing investigation in this case to arrest the accused. In this case no compensation has been given to the victim’s family. Even the treatment expenditure in the private Vinayak hospital has not been refunded by the administration.

    Case in Brief

    Dr. P. Anitha Rani, d/o Late Pullanna , aged 30  years, Working as Medical Officer, at SURABHI, KADAPA DISTRICT, since 25-05-2005. She has one elder brother who is married and resides in Chittor. she belongs to SC Madiga community.  Her subordinates Ms.Jayasree and Ms.Venkata Laxmi are non dalits and one of her is the relative of Surabhi Surpanch. They are harassing Dr.P.Anitha Rani and not cooperating in fulfilling her duties in the Primary Health Care Centre. They are even abusing her in the name of Cast by using filthy language and causing her mental agony. They do not care for her; behave recklessly and fail in discharging their duties includes not giving injections to the patients properly so that the patients blame Dr.Anitha.

     

    Mr.Chalapathi Yadav and Mr.Anjaneyulu are running Vijaya Laxmi Medical Shop there. Mr Subbaiah and Mr.Nagabhushanam and Mr.K.Ramachandra Reddy are the local leaders of Surabi and best supporters of these Medical shop owners. They are pressurizing her to write prescriptions to out side, and also threatening her to be under their control.  

     

    She has already complained to DM & HO Dr.Pichi Reddy, The Collector T.Krishna Babu, and the sectoral officer M. Prabhu Dasu over phone, but in vain. They are also supporting her subordinates and the local leaders. When she approached them and requested for transfer by explaining her inability to continue there due the prevailing conditions in the Hospital, none of them have neither taken proper action nor transferred her. More over they escaped by shifting their responsibility in discharging their duty.

     

    On February 2nd 2007 when Dr.L.Vijaya Kumar i/c of P.H.C got transferred Dr.Anitha Rani was suppose to get the in charge, but the D.M & H.O. instead of giving the in charge to her handed over the responsibility to Dr.B.Sreenivasulu who is already a regular Doctor to an other PHC in Gaaliveedu, who belongs to BC . 

     

    Being a dalit women Dr.P.Anitha Rani is facing lot of discrimination, harassment and non cooperation at her work place. She is just unable to perform her duties properly due to the deliberate insult in the public by all the above stated.
