Pali is located 303 km from Jaipur and 3km from the District Headquarter. Laxmi’s husband Hemant used to work in night shift in a mill. Subsequently, she was left alone at night with her son and daughter. Kamal Kishore Yadav, taking advantage of the situation, one night (21/12/2006 approx) entered her home, forcefully raped her whilst covering her mouth and threatened her that if she tells anyone about it, he would kill her husband. As a result, she did not tell anyone out of fear.
20 days after the first incident (10/01/2007 approx), Kamal again entered the victim\\\'s house with Sharwan Singh, and both of them brutally raped her. The brutality was so severe that one of the perpetrators even stood on her hair in order to pin her down whilst the other perpetrator raped her on the floor. After that they threatened Laxmi not to open her mouth; otherwise they would kill her husband. She did not tell anyone out of fear. 10 days after the second incident (20/01/07 approx), Kamal again turned with Sharwan Singh & Fateh Singh at around 10:00 P.M and again raped her.
This all was unbearable for Laxmi and at last she decided to speak out against the accused. She went to the office of Superintendent of Police and lodged an F.I.R against them. The local police of Pali registered Laxmi’s FIR with the direction of the Superintendent of Police, Pali. Next day Laxmi was called for medical examination and her thumb impression was taken over the MLC report with a statement stating that Laxmi willingly doesn’t want to go through the medical examination. The main accused namely Kamal Kishore was arrested on May 6, 2007 after 3& 1/2 months from the date of FIR but soon he was released on bail on 20/6/07. Because of compassionate attitude of local police, accused started threatening Laxmi and pressurized her to withdraw the case. Laxmi changed her house to avoid this & begged for safety & security before local police as she was constantly receiving threats to be killed by the accused. Still she has been threatened by all three accused and police is not in a mood to help her as they are keen interested to rescue the accused. The Investigation officer submitted the challan on June 8, 2007 before the honorable MJM court Pali. Still perpetrators wondered around Laxmi’s house, continuously threatening and harassing her not to pursue the case in the court of law else she would dire consequences.
The local police of Pali registered Laxmi’s FIR with the direction of the Superintendent of Police, Pali and next day Laxmi was called for medical examination, here police deliberately seemed very devious and indicated in the record that Laxmi does not want to go for medical examination. She was directed by the police to deny for medical examination as she is not educated and unaware of the law expressing the same and thus her thumb impression was taken over the MLC report stating that Laxmi willingly doesn’t want to go through the medical examination. This illegal act of police was perhaps to help the perpetrators in the court of law and also for denying the victim a compensation of Rs. 1 Lac from Administration. The eligibility for granting compensation of Rs. 1 Lac to the rape victim is provided under the rules after lodging FIR & Medical examination of the victim.

The Investigation officer submitted the challan on June 8, 2007 before the honorable MJM court Pali. it is learnt that police is harassing the victim and is reluctant to move any application in the court for cancellation of bail of the perpetrators and have not even bound them under section 107 & 116 of Indian Penal Code and sections 3 (i)(xii) and 3 (2) (v) of SC/ST (PoA) Act, 1989.
Accused threatened Laxmi and her family members to kill them and terrorized that they will not let her live in Pali. They openly abused Laxmi by saying that what she can do, this will occur to her again and again and she will not able to do anything. Not only that, but Laxmi Devi was strictly prohibited to enter the mill. Because of their ill will Laxmi Devi is in trouble and helpless. As accused have been released on bail and are quite powerful in terms of money and political approach, their deeds compelled Laxmi Devi to commit suicide or die of hunger. The accused was released on bail. Now the case is pending for hearing.
Sindhugarh is a small village, situated 60 km away from Mohanpur police station of Gaya District in Bihar. 35 Dalit families reside over there. Majority of Dalit families are daily labourers. On 12th June 2007 at about 6 a.m Nanda Kishore Singh, S.H.O Mohanpur and other 10-12 police personnel went to the village and tortured women of the village on false charge saying “Sali Harijan! Mushaharini! Tum log apne ghar main Moist Communist Centre (MCC) ke log ko ashray dete ho” you Harijans, giving shelter to the MCC members. The police dragged Gayatri Devi (22) w/o Raj Kumar Manji, Bachia Devi (25) w/o Badri Manji, Chetiya Devi (23) w/o Nageswar Manji & Rekha Devi (20) w/o Arjun Manji, on the ground holding their hair and beat with lathi on their backs and legs. The police personnel tortured them for an hour.
A day after the four victims along with Dher Yadav s/o Devendra Yadav met Amit Kumar Jain S.P and District Magistrate of Gaya District and submitted written complaint against the perpetrators. The S.P and DM assured them to initiate necessary action against the assailants but as of now the administration has not taken any action against them. FIR not registered. No action by Senior Police officer and District Magistrate.
Vimala (13) d/o Purkharam, resident of Mandir Suratgardh, Ganganagar hails from a Scheduled caste (Nayak) family. She is a physically challenged girl and lives with her family.
On 10th June 2007at around 11 p.m. Vimala was alone at her home. Her parents had gone to attend the marriage of their relatives at Gamandia village and her brothers went to their neighbor’s house to watch TV. Dhebhusingh (30), a resident of the same village who belongs to Sidu Jat, came to the house of Vimala and enquired whether anybody was at her home. After she replied that nobody was at home, Dhebhusingh came along with Premnath and Mohannath, entered into her house and gang raped her. She did not disclose this incident to her parents. After this incident Vimala became pregnant.
On 4.08.07 Mohannath’s wife invited Vimala to the market, but rather than taking her to the market, she brought her to Surtgardh Manju Nursing home where Dr. Manju Bhargav performed DNC. After this Mohannath wife dropped Vimala at her home and warned her not to disclose this incident to anyone else. Seeing her condition, Vimala’s mother questioned her and Vimala narrated everything to her. On 5th Aug.2007 her parents registered a complaint against the perpetrators. The charge sheet No. 369 was filed on 24.09.07 and the case is pending trial at Ganga Nagar court, but the perpetrators are pressuring the victims to compromise this case.
Charge sheet No 369/07 u/s 302 IPC & 3(2) (v) SC/ST (PoA) Act 1989 has been filed on 24/09/07. Compensation of Rs. 5 0, 000/- under SC/ST (PoA) RULES 1995 paid to the victim. Trial of the Case is pending disposal before Ganga Nagar court.

Mundlapalli Subbamma was learning tailoring in Sarva Siksha Abhiyan Centre Residential Bridge Course Camp. Subbamma was suffering from dehydration since three days and on 15th May 2007, Bala Venkata Reddy who runs the institute said that he would leave her in her home and took her on two-wheeler. He took her in wrong route and when she questioned, he said that it is short route to her village. He took her to an abandoned building near Airport and raped her. Then he left her near her village and went away. She informed about the incident to her brothers and they complained in the police station at 12:00 hours on the same day.
Case in Brief
Pothula Nagalakshmi is 30 years, native of Gundepudi village, Allavaram mandal, SC Mala by caste. Her husband Appa Rao is a social activist. They have a son. Their village is dominated by the non-dalit community Raju, Kapu, Setti Balija. All the dalits stay united. In the recent Panchayat Elections, the village panchyat was reserved for SC Women. Nagalakshmi won the election with huge majority as sarpanch against the candidate supported by the non-dalit community. Since then the non-dalits wanted to take revenge on Nagalakshmi and her supporters. They started opposing in all the developmental activities for the village. The non-dalit community willfully closed the way to the burial ground which caused inconvenience to the dalit community. This lead to rivalry between the dalit and non-dalit community and the village secretary made a compromise between them. The non-dalit community used to threaten and harass the village secretary though he is a government employee.
A proposal was made in the village meeting to construct a drainage system in the village. But non-dalit community opposed it. Though it was approved, Gunturi Sitarama Raju, Gunturi Sivarama Raju, Kotturi Ranga Raju opposed the activity saying that it is their land. Nagalakshmi said that the land belongs to panchayat. The accused abused her in the name of caste saying that “Amey Mala lanja neekenta dhairyam, maakee eduru cheptaava?” (You mala bitch, how dare you oppose us?) Finally they stopped her from constructing the drainage system.
She complained in the Allavaram PS and the police registered an FIR u/s 7(1) (d) of PCR Act. When the DSS team asked to include SC/ST (PoA) Act, the police said that they did not register it because she was not attacked.
