    Case in Brief

    Roninki Lakshmi, aged 29 years is wife of Roninki Appala Naidu.  They have two children Yesebu(13) and Gnyanu(11).  Appala Naidu works as Conservency Safaiwala in Station Head Quarters Cell (EO) – AMC Regiment at Langar House near water tank.  Appala Naidu has two elder brothers Roninki Simhachalam, aged 40 years and Roninki Jaddanna, aged 39 years.  They lived in Langer House for 20 years.  His mother Roninki Eeramma bought house site of 130 sq. yards bearing RS No. 118 in Lakshmi Nagar and built a house where whole family lived together.  She registered the same on the names of Appala Naidu and Simhachalam, 65 sq. yards each.  Appala Naidu borrowed Rs.80,000/- from various sources and repaired the house.  Later his mother repaid the principle and interest amounting to Rs.1,50,000/- with the amount she got after her retirement.  Later Appala Naidu agreed to pay back Rs.35,000/- to his brothers as they asked for share in the amount received by his mother.  Lakshmi along with her family shifted to a rented house unable to bear the nuisance created by her brother-in-laws.  Ultimately they landed into debts to a tune of Rs.2,00,000/- from private money lenders to meet the rental and domestic expenditure.   As they were unable to repay the debts, the money lenders started abusing Lakshmi with filthy language, likewise Erukala Mallesh and Biswas beat up Appala Naidu.  Satyam used to send his people and forcibly take Appala Naidu to his shop and harass him.  All the money lenders threatened him of dire consequences which intimidated Appala Naidu from attending his duties.  He even lodged a complaint in the Langer House PS.  

     

    As he failed to repay, the harassment from the money lenders increased, thus, Lakshmi along with her family shifted to Janawada, Shankarapalli (m), Ranga Reddy.  As there was no income, to feed the family, they have again borrowed Rs.24,000/- from Narsamma of Jonnada.  Unable to bear the harassment of Biswas, Narsamma, Swami and his wife, Lakshmi left to her parents.  

     

    Appala Naidu was forced to sign on the sale deed of his house in the presence of the local elders Ravindra Reddy and Narsinga Rao, stating that all his debts shall be cleared and paid Appala Naidu Rs.20,000/-.  But to his pity, no debts were cleared apart from the payment made to Sardar and Asif.

Mass attack on Dalits for trying to enter into temple- Vashishat village

  • Summary:: This incident happened at Vishist village of District Kullu in H.P. This village is very famous for Shiv Mandir where every year people celebrate Navratra Pooja. During the time, the villagers practice a very old ritual i.e. a tree to be planted next to the temple as a symbol of temple flag. In the pit where the tree is to be planted; a Dalit will be asked to get into the pit before the tree is being planted. Then the temple priest along with some dominant caste people start planting the tree and at the at the same time the Dalit has to immediately come out from the pit, if he is unable to come out on time he is mixed with the soil and tree is planted over him. The villagers belong to Kholi (Harijan), Bhramins and Rajput caste. During the time of Navratra, Bhikam Ram went to Shiv Mandir to offer his prayers. He was about to enter into the temple, the temple priest pushed him away and restricted his entry because he belongs to an “untouchability” scheduled caste (Harijan). When Bhikam Ram protested against the priest the temple committee also got involved in between; they also ordered him to leave the premises immediately. Bhikam Ram narrated the incident to his sons and neighbors. Together they went to Tehsil Manali police station to register an F.I.R. The next day the temple priest and 17 other committee members were arrested. Victim not received any compensation. Case is running in District court of Kullu.

Rape and Murder of a Minor Dalit Girl Sahar

    Diseased Piniki Kumari (15) d/o Raghab Paswan is the resident of Koran village, P.S Sahar in Bhojpur District of Bihar. She belongs to Scheduled Caste (Pasi) community and professes Hindu religion. Diseased Piniki Kumari was the student of standard 6th in the village Sahar Middle School. Soharab Alam (18) s/o Mustaf Alam, the Perpetrator from the same village also was studying in the same school. Soharab and Piniki kumari fell in love and they had sexual relation too. Soharab Alam used to insist Pinki to have sex with his friend Mohd Khalik s/o Jannat Hussain, however Pinki opposed to it. Soharab made a plan that she should have sex with his friend Mohd Khalik.

     

    On 13.02.07 at about 10 p.m Phula Devi w/o Mujarik Ram, the resident of the same village requested Pinki to give her accompany in the night because her husband was not at home. In the morning at about 6 a.m Buch Devi, the mother of Pinki went Phula Devi’s house to call Pinki. But Phula Deve said that she does not know about Pinki. Having shocked by her statement Pinki’s mother started searching Pinki. Finally at about 8 a.m she found her dead body lying near by the wheat field, after being. She was gang raped and her throat was slaughtered. On 14.02.07 at about 3.30 p.m complaint was lodged in the Sahar police station and the case was registered u/s 302, 376, 34 IPC. Police arrested Phula Devi w/o Mujarik, Soharab Alam (18) s/o Mustaf Alam and Mohd Khalik s/o Jannat Hussain. SC/ST Act not invoked in FIR. Accused in the jail. Victim did not get compensation. Charge sheet not filed till date

Failure in Love Caused a Minor Dalit Girl’s Hand Cut Off

  • Summary:: Anju (14) D/o Lal Singh, resident of Nagla Chinta Village, Post Achhalda, P.S- Achhalda, Dist- Oraiya, Uttar Pradesh, hails from Scheduled Caste (Kanjad-Ahirbar) community. She has been brought up in a very poor family. Viresh Singh Yadav (25) S/o Man Singh is the resident of Achhalda village, which is 1 km away from the neighboring village Nagla Chinta, His father is a Government employee and they are caste minded and violent. Viresh Singh fell in love with Anju, despite the fact that she is a Dalit girl; nevertheless Anju did not show reciprocal love to Viresh. Thus he was crazy after Anju. He used to pass comments, staring at her, driving Motorcycle by her side very fast, even he was putting many attempts to talk to her, but his all efforts went vain. Thus Anju, was upset by his conduct and way of approach to her, she was unable to remonstrate against him, because he was very rude in nature. Having not found any other way, she left for her elder sister’s home in Firozabad and stayed for 15-16 days, thinking that he would not go there to disturb. Unfortunately Viresh Singh went to Firazabad, where Anju was staying with her sister by his Motorbike and repeated the same comments. Anju, notwithstanding the matter, complained to her sister’s mother in-law, Sarada Devi. She protested against the nature of Viresh. As a result they had very irritable argument among themselves for 20-25 minutes. Viresh warned her while going from the village that “Ek din a Sali konjoriya ka ghomond jarur chur kar dunga, Sali hamari beijati ki” one day or the other day he would see to Kanjariya (Sub Caste) as she disgraced him. After some days of the incident Anuju came back to her village. On 11th Feb’06 at about 4 p.m Anju went to Achhalda village, which is 1 km away off from her village, in order to buy some vegetable from the market. On her way back home, on the bank of river Ganges, close to Puliya, Viresh Yadav, having handled an edged weapon Viresh came to her frontage along with two of his friends. As she was going, they obstructed her way and took hold of her. The assailants outraged her modesty. After many attempts, as she was managing to escape from them, Viresh attacked with a sharp weapon, which cut off her right arm completely. Anju became unconscious and fell to the ground. The rapist escaped from the spot. Some passersby from her village saw Anju lying on the way, after being seriously injured. They sent massage to her parents. Her parents and some of her relatives came to the spot and took Anju to Achhalda police station in that same condition. She regained her consciousness in the police station and narrated the whole incident; however FIR was not registered in Achhalda police station. Then they took Anju to Etawa Hospital from Achhalda P.S, where she was given first aid treatment. Doctor advice them to register the complaint in the police station first, and then she would be admitted in the Hospital. So they went to S. P of Oraiya District, but he did not listen to their plea instead shouted at them saying “Bobal banakar laye ho, bhag jao yanhase, nehi to sabko band kar dunga” get lost from here or else I will put you in the lock up. The next day on 13.02.06 they met to D.M of Oraiya, he gave his Car and sent 2-3 persons from his office along with the victims to admit Anju in Kanpoor Hospital. She did not receive quality treatment in the Hospital. Many press reporters went to meet Anju and news had been published in many newspapers, and thereafter she received quality treatment. Bahujan Samaj Party of U.P extended support of Rs 1’000/- to victim family on 13.02.06. The Governor also gave to the family Rs 25’000/- towards Anjus’s treatment on 15.02.06. The victim family has not been given protection by the administration yet. The case has been registered u/s 326, 354 IPC & 3(1) X SC/ST Act on 13.02.06 by M. P Singh, Station Officer, later the case was investigated by Bipuna Ramvilash Yadav-Circle Officer. Perpetrators have not been arrested yet. Compensation has not been given to victim as per SC/ST Act & Rule. Charge sheet has not been discharged yet. Victim’s family has not been ensured security.

Attempt to Rape of a Dalit Woman Nandgaon

    Rekha Vasudeo Ingale (26) is resident of Sawaner village under Nandgaon Khandeshwar Tahsil, in Amravati Dist., belongs to scheduled caste community. On 10/02/2007, Rekha went to a well of accused to fetch water. On her way back the accused came from her back, caught hold her breast with both hands and molested. The victim screamed out for help. On hearing, the women who came to fetch water, rushed to the spot to rescue her but the accused escaped.

     

    A case was registered in Nandgaon police station on 26/04/2007 against the accused as No. 09/07, u/s 354,342,506 IPC & 3(1)(xi) SC/ST (PoA) Act. The case was investigated by Deputy Superintendent of Police. Charge sheet in the case is filed on 17/05/2007. Case is under trial. The accused person arrested but bailed out. Now the victim is under threat and harassed to compromise the case. Compensation to victim granted. Case was compromised & perpetrator acquitted.
