A Dalit Murdered and His Body Thrown Into a Well for Having Major Share in a Partnership

  • Summary:: The village Pura Nisf Pansari under Makhi police station is situated 15 kms from the district headquarter Unnao. The village consists of almost 2000 populace in which Pasi, Gondiya, Chamar, Dhobi, Brahmins, Thakur, Yadavas, etc. live. Dalits do not own their land for the cultivation and therefore they work as daily wage labourers in the fields of Brahmins, Thakurs and Yadavas mostly and for which they get Rs. 30/- as their wage. However, the victim late Nanhu Pansari owned 6 Biswa of land which was not enough for their livelihood. Therefore, in partnership with the accused Pappu Gondiya (25) s/o late Bhagoti, Kanha (22) s/o Chhiddu and Rajan (22) s/o Bhagoti belonging to Backward Class of the same village had bought water fruit (Singhara) in which the victim had put Rs. 12,000/- as capital. That became the largest share in the partnership and became the cause of his murder. On 11.1.2007, in the night the accused had called late Nanhu from his house to guard water fruit. Nanhu asked his daughter Jyoti for a veil to cover his body. Later he left his house leaving the responsibility of taking care of his house on his brother Shivkumar. He then did not come back to his house till 11 am in the next day. And so, Jyoti went to the house of the accused to inquire about her father. They told her that they did not know about him. The family of the victim looked around for late Nanhu till late night on 12.1.2007 but did not find him. That process of finding him out continued on 13.1.2007. Shivkumar (brother of the victim) saw a pair of slippers floating into a well at Harisiddhi Temple. Doubting the death of his brother he toed into the well and found a dead body which happened to be his brother’s (late Nanhu) body. In the evening Siyaram and Shivkumar sons of late Brijlal had gone to give a written complaint in the Makhi police station where they were made to sit in the police station whole night and on 14.1.2007 in the morning the police together with both of them came at the well. The police took out the body and sent the body to Unnao for the postmortem. Later on the same day the police handed the body to late Nanhu’s family for the last ceremony. Despite, the postmortem confirmed of murder, the police did not register the FIR on 14.1.2007. Siyaram and Shivkumar had given a complaint to SP and DM, Unnao on 18.1.2007 and finally on 26.1.2007 with their direction the case was registered against the accused under sections 302 IPC and 3(2) (v) SC/ST (PoA) Act, 1989. The case is investigated by Circle Officer, Sadar. No compensation has been paid to the affected family as late Nanhu was the sole earning member in the family. Not even the protection is granted to the family. Spot investigation conducted by D.S.P. Mr. A.K.Srivastav. Case is under investigation by C.O. Sadar. All accused arrested and bailed out. Case is under trial in Special Court –District Unnao. Charge Sheet yet not filed. Compensation of Rs. 1, 50,000 as per SC/ST (PoA) Rules 1995 has been given to the victim

    Case in Brief

    Ms.Jalali Jangamma, age 35 years, w/o Yesurathnam, Sc Madiga by caste and r/o Chevella Village, Ranga Reddy District was working as sweeper in gram panchayat. She had been living in Chevella Village after deserting her Husband. Her eldest son stays with her, daughter is married and the youngest son is working in a hotel in the near by town and stays there it self. 

     

    She was appointed nine months back.  She had developed extra marital relation with Mr. uduva Narasimhulu r/o Chevella, Caste: Padmashaali (BC), Occ: Road side Sweets vendor. 

     

    Since it was Sunday on the day of the incident, Ms.Jangamma went to her younger brother’s house and spent some time there from 9am to 2pm. After that she was found dead by the other sweepers of the panchayat who came for cleaning in the pond beside Venkateshwara Temple on Monday morning. It was noticed that her neck was strangulated to death with her “mangalasuthram”.

     

    The DSS team reached the spot, did fact finding and discussed with the police officials. The dog squad was brought into action; it went twice and stood in front of to the house of C.Narasimhulu. Later the police took three persons including C. Narasimhulu in to custody and interrogated. Later Narasimhulu admitted that he has strangulated her to death as he was unable to bear that she had extra marital relations with other men.

    Shardhabai Althae, Ramesh Vaman Althae, Sham Ramesh Althae is r/o Masla Village, Gadhawad Bhisewagholi-Tahsil, District Latur. On 07/01/2007, while the victim working at their farm, the perpetrator and his fellow caste people from same village drove the tractor into victims land, assaulted them with axe, sugarcane sticks and bamboos and uttered caste based abusive words, because the perpetrator wanted to grab victims land illegally.

     

    A case registered on 14/10/2007, as No.93/07, u/s 143,147,148,149 IPC & 3(1)(v) of SC/ST (PoA) Act., in Murud police station. The accused persons were arrested. Perpetrator got bail from Court. The victim has received Rs. 6250/- & 2500/- as compensation from administration on 15/07/2008. Investigation was done by SDPO Mamilwad. Case is pending trial and is on the stage of charge framing. Adv. Bhosale is looking into the matter. On 23/06/08 Charge framed and process is finished.

    Case in Brief           

    Ghanta Sirisha, aged 14 years, D/o Ghanta China Venkateshwarlu, R/o I Ward, Bapujinagar, Gudivada, Krishna district, Occ: Student, SC Mala by caste was studying 7th Standard in Navodaya Convent which was located in Mubarak Centre, Gudivada, Krishna District.  On 4th January, Sirisha was found dead at around 01:30 pm.  

     

    On 4th January 2007 Sirisha has come to school.  Sirisha’s father Ghanta China Venkateshwarlu has taken the lunch box and went to school and gave it to her at around 12:30 pm.  Then the Principal Tangella Rama Mohana Rao, 50 years, OC Brahmin by caste called Venkateshwarlu and asked about the fees due to be paid and also informed that Sirisha is not attending the tuition classes regularly.  Later Venkateshwarlu left the place.  When Venkateshwarlu was having lunch at his home at around 01:30 pm, two men came on Scooter and informed that his daughter is dead.  When he went to school, he found his daughter hanging to a raft in one of the classrooms.  There was no one except few very young students and a teacher Krishna Kumari.  The villagers gathered and organized a dharna with a suspicion that it was a murder till 11:30 in the night.  At around 01:00 am of 5th January 2007, the dead body was taken down and then the people around there noticed blood stains on the legs of Sirisha.  The body was sent for post mortem. 

     

    Sirisha joined in Navodaya Convent in 6th standard.  Until then she studied in Telugu medium.  She has come to 7th standard.  Sirisha has been complaining her mother since 2 months that her principal is talking in an abusive way to her and beating her.  Her mother persuaded her saying that she would join her in another school for 8th standard.  Sirisha refused to attend the tuition classes conducted by the principal in the school, but her father forcefully took her to the classes.  On 4th January 2007, Sirisha was not on menstrual periods.  But there was bleeding from her private parts.  There is no possible way for her to hang herself from the raft in the given short period of time according to the narration of the school staff.

Dalit Woman Denied Public Passage and Attacked

    Smt. Kiran Devi (27) W/o Mangal Raajk, resident of Sakin-Mujapur village, GP/Po Dih-kushumbha, P.S Korma, Dist-Shekhpura, Bihar, hails from Scheduled Caste (Dhobi) community. She is a housewife and her husband is a marginalized farmer. Agriculture farm of the victim is located adjacent to the land of Shravan Hahanto, belongs to BC (Dhanak) community. There was a passageway stuck between the land of Shravan Mahanto and the victim family, which the people from the neighbouring villages used to pass through. Conversely Shravan Kumanr blocked the path, therefore the public found out another way, which crossed through the land of Kiran Devi. Consequently she had to put up with gross loss of corns from the farm.

     

    Therefore Kiran Devi removed the blockage from the way in order to make way for the public This act Kiran was very irritating to Shravan. On 31.12.06 Shravan Mahanta S/o Muna Mahanta, Bilo Kumari D/o Muna Mahanta, Ingoli Kumari D/o Shravan Mahanta abused her with filthy language, Caste name and brutally beat Kiran Devi and her sister-in-law (Gotini in Bihari language). Due to the attack Kiran Devi became unconscious.

     

    On 05.01.07 Kiran Devi and her husband went to Munger P.S to lodge complaint. The P.S Incharge registered the case u/s 342/341/324/504/354/447/448/379/34 IPC & 3 (1) x SC/ST Act on 8.01.07 and it was sent to Korma P.S for investigation. The culprits have not been arrested yet; even the victims have not received any compensation by the administration.
