Village Rojada is located 372 K.M from the capital of Rajasthan, Jaipur & 72 K.M from the District Headquarter Pali. Rojada village has strength of 345 families with 45 Meghwal, 60 Rajput, 150 Devasi, 20 Purohit, 20 Meena, 16 Sirivis, 5 Goswami, 20 Sargara, 15 Kumhar & 10 Nai families. The main occupation of the Dalit families is working as a daily wages laborer; economically they are very weak and are frequent victims of atrocities by the hands of Dominant caste villagers. Lawlessness is prevailed everywhere in Rojada. Meghwal community is too frightened to speak out against atrocities. Rasila Devi has been living near the Forest of Kaluposh for four years with her one year old son. She was earning her livelihood by working as a daily wages laborer and her husband was working somewhere else and used to come occassionally.
On 1-2-07 Rasila Devi was sitting and offering prayers with her family members. Her son was sleeping at home. As she went home to have a look at her son, she found Shrawan & Prakash standing outside her home. Theyclasped her in arms and clutched her mouth with a handkerchief and took her to the forset; flang her on the fence and subsequently raped her. Meanwhile Rasila’s son woke up and started crying. Then her neighbours started looking for Rasila and thus went to the Jungle. The perpetrators threatened her to kill if she will speak out and took her from there. Neighbours heard her voice and followed them. Shrawan threw stones on them and reached to the mustard farm of Prakash. Afterthat Sharvan Singh brought some wine and they both again raped the poor & helpless lady. At last the perpetrators locked Rasila in a room. Rasila begged a lot to let her go and promised not to tell anyone about the whole incident. Prakash thusopenedtheroomand again raped her there. Afterwards,trusting on Rasila, hemade a call to her maternal home and called her parents to pick her.
On 2-2-07 Police registered the case against the perpetrators under section 366,376 (2) (g) of Indian Penal code & 3(1)(xii) of SC/ST (PoA) Act 1989 and arrested both of the accused. The medical examination was done and forced sexual intercourse was found.
On February 2nd, 2007 the local police of Pali registered the FIR of Rasila Devi and started investigation of the case. Soon afterwards, next day of registering FIR, she was sent for medical examination. Next day on February 3rd, 2007 both of the accused were arrested and soon police completed investigation and submitted challan 19/07 on 15/2/07 before the Magistrate with in thirteen days. The administration provided only a partly relief of Rs. 50,000. In total this is violation of the rules.
Medical is the most relevant evidence in case of Rape, it is sufficient to prove whether the intercourse done is with consent or forcefully. Here in this case the medical report was in favor of Rasila Devi which stated that sexual intercourse took place. Although it also stated that Rasila Devi is habitual for sexual intercourse but it focused on injuries which were caused due to rape on the external and internal parts of her body. Rest it counted on FSL report which was also in favor of Rasila Devi because seminal fluid was found on clothes.
Rasila Devi’s statement was recorded under section 164 of Cr.P.C. After submitting the charge before the Magistrate, case was sent to the Special Session Court SC/ST. As the accused were behind bars they pleaded for bail but keeping in view the seriousness of the offence and evidence, honorable Judge rejected their bail application.
From the day first the accused and his family started threatening Rasila Devi and her family to compromise by hook or by crook. They offered her Rs. 2 Lac to withdraw the case against them. Rasila is living with her family although her family accepted her but sometimes disgraces her and does comment on her. Challan has been presented before the Court and case is pending there for trial. She has been granted a monetary compensation of Rs. 50,000/-
Case in Brief
The Victim Suloju Krishnaveni is a resident of Rajavommangi and her uncle adopted her since her parents died during her childhood. She is studying in Asrama School at Kottapalem village from 3rd Class and at present she was studying 6th class and staying in the hostel. The accused was Chintha subrahmanya Sarma, Telugu teacher is also staying in the same hostel in a separate room. On 29.01.2007 at about 1.00 AM accused was drunken state went to the girls’ hostel and instructed Krishnaveni and other girls who attained puberty to come to his room. She along with pallala Pottemma, Chapa Syamala, Kadhyla Ganga, Kadi Bennayamma and some others went to his room. Then he enquired with the girls about who will sleep with him and all of them refused. Then he asked Krishnaveni to sleep with him on his cot and threatened her that he will beat her and sent her away with T.C out of fear, she slept on his cot along with him. The remaining girls slept in the side room. At about 3.30 AM, he woke up and went out side and came back and laid his hand on her waist. She removed his hand. Later he laid his leg on her, she also removed it. When she slept facing towards the wall, he kissed on her back and pressed her chest with his hands. She questioned him out of fear “Why he was doing like that“. Then he asked her to sleep with him for that night and promised her to purchase what ever she wants. She got out of his bed and went to the side room and informed other girls. The next day she informed the same to Nurse Gomu Ramayamma and on Wednesday to the H.M. Then she represented the matter to her uncle and filed a report in Addateegala police station and requested for necessary action.”

Case in Brief
Bangaru Lova Rathnam, aged 20 yrs, Caste Relli, d/o Simhachalam eloped with Mr.Ponnada Lova Raju, age 25 yrs. S/o Ponnada Surya Narayana. R/o Rekha Vaari Paalem, Tuni Mandal, E.G. in the year 2004 and got married in Annavaram Temple.
Victim’s father Mr.Simhachalam lodged a complaint on 28-02-04 in the Police Station, Tuni. The Police traced out and brought them to the Police Station and performed marriage once again in the police station. After the birth of a son the accused started discriminating the Victim in the Caste Name. And he deserted her along with his son. He is refusing to continue marital relationship with her saying that she is a dalit.
The victim lodged a complaint and the case was registered at Tuni police station U/s 3(1)(X) of SC/ST PoA Act. The sections were altered to 3(1)(XI) of SC/ST PoA Act with the intervention of DSS.
DSS Intervention
Lalitha(21) d/o Chunilal (56), resident of Talete Village, Dist- Sirohi, Rajasthan, hails from a Scheduled Caste family. Her father is a retired army personal. After his retirement he started to work in a hotel at Mount Abu. Lalita had 2 sisters and a brother. Her brother who had worked in a hotel was lost four years ago. FIR was registered in this connection but no action was taken by the police. After this incident, Lalitha and her family members shifted their residence from Mount Abu to Taleta. Lalitha worked at Shantivan in Taleta. She used to carry a uniform along with her. During her duty hour she used to wear the uniform.
On 28/01/07 morning, Lalitha, as usual, went for work. At about 7.00 P.m Gopal came to the house of Lalitha and asked her parents whether she reached home. The parents of Lalitha said that she has not come. He informed them that she was missing from the factory from 10.30 a.m. The members of her family started to search for her and also complained to the police. The police started to search and finally reached the dam, where the dirty water stagnated at the backside of Shantivan. They found Lalitha’s slipper floating in the water. Since it became dark they could not search further.
Again on 29/01/07, Assistant In charge of Police and a police man started to search for her in the dam. They had put an anchor in the water and also made a person to dive in the water, but they could not find anything. The police brought 4 pump sets and started to drain all the water from the dam. At about 12 p.m the water was completely drained out from the dam but nothing was found. Since the family members of Lalitha were tired they returned home. After they reached home the police went to the house of Chunilal and brought them back near the dam and showed the dead body of Lalitha clad in ununiform. The parents were shocked to see the dead body of Lalitha with bleeding in her nose, injuries on her face and the body did not swell, it was normal. When the sister of Lalitha wanted to see the Duty In charge the employee said that he was sick and did not allow her to meet him.
The Parents of the Lalitha suspects that she should have been raped and later murdered by the employee of Shantivan. On 30/01/07, Post- Mortem was conducted by 3 doctors and certified that the death was due to drowning. The Perpetrator has not been identified. FIR has not been filed and the Police want to squash this case by saying that she must have committed suicide.
