Rape and Murder of a Minor Dalit Girl

    The deceased 13 year old Rekha Kumari d/o Rambhaju Manjhi belonging to Musahar community, at Karmauni village, Dobhi Ps and Taluk, Gaya district in Bihar was raped and killed brutally on 15/12/2004 at 9.00am. She was a decent girl in the village and she believed to have respect for her family. She was living with her father. Her father worked as a wage labourer. On 12/12/2004 the perpetrator Surendra Kumar Yadav had once tried to molest her but she boldly opposed him. On that basis he had threatened her.

     

    On 15/12/2004 in the morning at 9 she had gone for the collection of the cow dung. The perpetrators Surendra Kumar Yadav s/o Shivalal Yadav, Uday Yadav s/o Jhaman Yadav, Mahendra Yadav s/o Mahadev Yadav and Arun Yadav s/o Hiravan Yadav went after her and caught hold of her, raped her and fearing their actions to be brought to the notice by her, they killed her attacking with bricks on various parts of her body. Her cheeks and breasts were cruelly crashed. Her head was badly injured. The flesh of her face was chopped. People found very difficult to identify her body but the father of the girl recognized her with her clothing. An evidence of the perpetrators was found in the place of the incidence i.e. a shawl.

     

    On the same day on December 15, 2004 the father of the deceased filed the FIR no. 202/04 and the body was taken to Anugraha Narayan Medical College and Hospital for the postmortem report. But in FIR the police had written no names of the perpetrators. Charge sheet has been presented in the court. No compensation has been given to the family. The case is under trial. The police had taken Rs. 10,000 to subside the case. The Charge Sheet has been submitted in the court.

Musclemen Demolished Houses of Dalits to Encroach upon Land

  • Summary:: Ramesh Gupta with his brothers Santosh and Ashok, 25 labours and a few musclemen indulged in demolishing the houses of the Dalits without any prior information. This act was opposed by the land holders and other Dalits. They did not want their houses to be demolished and so they started fight against the work. There was a total commotion in the place. The labourers of Ramesh ran away from the place. Learning the fight in the place the perpetrator Ramesh Gupta came with the police again. The police too joined hands with Ramesh and illtreated the plot holders. They pulled the hair of the women and assaulted them. Ramesh pointed his gun at the children of the Dalits. Looking at this act Shashikala and Sobhavati fell unconscious. People thought that they were dead and the victims jammed the road. After a great difficulty the SHO of Manduadih could clear the jam giving some assurance. It was learnt through the neighbours that on 1.6.1967 the grandmother of Ramesh Gupta, late Parwati Devi, had asked Ramadhar s/o Mangru to declare the plot no. 21/1 measuring 13 dismal as public property and plot no. 21/2 measuring 3 dismal of her own. It so happen that on 17.12.1986 Lekhpal, Tahsildar, Medical officials and a few First Aid officials organized a camp for Family Planning program in Vidyapeeth bloc. Five of the Dalit women (Rajkiran, Sobhavati, Shashikala, Chandravati and Kamla) got operated under Family Planning and they were allotted 3 dismal plot of land each to five of them from plot no. 21/1 with the help of the then SDM on 12.12.1986 and gave to the ownership of the land. That happened to be the reason for the demolition of the houses own by the Dalits. No FIR was registered in the police station.

Brutal Tortured of a Dalit on Theft Allegation

    R. Srinivasulu, S/o. Shakru Nayak, Age 30 years, Caste : ST (Lambadi).  On 6-12-2004 at 4-30 a.m. the S.I. of Police Lingala by name Raghava Rao along with his staff went to the Mugdumpur and wake up the victim R. Srinivasulu and the police took him into custody and brought him to the Police Station in Jeep. Without any reason the police beat him. The S.I. Police abused taking his Caste name as “Orai Lambadi Lanjakodaka... neevu dongatanam chesinavani complaint vachindi...” And S.I. Police forced the victim to agree the theft, otherwise, the S.I. threatened him ‘I will see your end’.  S.I. tortured the victim along with his constables by hitting on his toes and different parts of his body.  Abused as ‘your caste people were theives your livelyhood is thefting’ and beat him again.  Upto evening they have tortured like this.  Receiving this information victim’s brother Kanna Nayak, villager Sudhakar and other villager Seelam Balaswamy, Tulcha Nayak came to the police station and requested to release the victim.  At 5-00 p.m. the S.I. of Police released on condition of attending the P.S. for 3 days, otherwise he threatened that ‘I will see your end’.

     

    Victim R.Srinivasulu belongs to Mugdumpur village.  He is working as Water shed committee Secretary.  He is a sincere & honest worker.  The same villager and water shed chairman Kondal Rao is the Landlord.  Previously Venkataiah working as bonded labour under Kondal Rao.  But he left the work under the Kondal Rao and at present he was working with Victim R. Srinivasulu. As the Watershed Committee Secretary R.Srinivasulu warned Kondal Rao not to use machinery in Watershed works. Keeping this in mind Kondal Rao planned to implicate in false case with his influence of Police. 

     

    On 30-11-2004 Kondal Rao gave a report to police alleging that R.Srinivasulu committed theft of water pipes.  In that connection the S.I. of Police who belongs to the same caste of Kondal Rao take the victim in to custody and tortured the victim.  R.Srinivasulu is educated and he has dared to question in Gram Panchayat who misused the Govt. funds. It is one of the reasons the Kondal Rao developed grudges against him. A counter case was filed against the victim and police arrested the victim Srinivasulu but later on he got the bail.

    On 2nd Dec 2004, approximately at 1.00/2.00 p.m, a Dalit minor girl Salla Yadamma (13) R/o  Jainapalli village, Bibinagar mandal of  Nalagonda district, Andhra Pradesh state,  was attempted to rape in the day time at the cattle field by an elder person Morigadi Shyam (22) who is from same village. Jainapalli village of Bibinagar Mandal of Nalagonda district, Andhra Pradesh state. The population of this village is about 1100 there are SC- 200 people & 35 families, BC more than SC community in this village. It is dominated by Mudiraj & Gouds caste people. One side of the village consists SC community and other side BC’s. There are TDP and Congress political parties in the village. There is practice of two-tumbler system and more over the govt. Schemes are not reaching Dalits. Even till now Dalits are not allowed to enter in the village temple.

     

    Mr. Salla Laxmaiah (40 years old) S/o Mysaiah an agricultural labour from SC Madiga community residing at Jainepally Village, Bibinagar mandal Nalagonda Dist. He is having one son and three daughters. On 02-12-2004 at 10.00 a.m. his second daughter Yadamma aged about 13 years went towards water tank located at the outskirts of the village for grazing the goats. On the same day at about 2-00 p.m, he went to clinic at Bibinagar with his wife who was suffering from ill-health and returned home by 5-00 p.m. Mean while his daughter Yadamma at about 1.00/2.00 p.m. same villager Morigadi Shyam S/o. Narsimha, aged 22 yrs., Caste Gouds, came to her and asked to come aside to have sex with him. She refused and raised hue and cried.  But Shyam caught hold of her and her blouse and petticoat were torn, pulled her and abused her by caste name and as she was screaming he threatened her not to shout. On hearing her shouts Salla Venkatesh her brother, Aunt Ramulamma, supervisor Ranga Rao & other coolies went towards her. On seeing them Shyam started abusing her by caste name and escaped from there. After asking repeatedly by them, she narrated what happened with her. Then she came back to home with her aunt. After Salla Laxmaiah returned home with his wife at 5 PM she informed about the incident and showed them the torn clothes.

     

    On the same day, At 9 PM Salla Laxmaiah lodged complaint at Bibinagar Police station. On-Duty SI N. Narshimha Reddy registered the complaint along with this victims father showed Red colour blouse that was torn from back and purple colour floral petticoat lower back border was torn. The case was booked u/sec IPC 354 & 3(i)(xi) of SC/ST Act 1989. On 4th December 2004, after receiving proceedings in C. No. 6388/C/2004, dated 2nd December 2004 of SP Nalagonda appointing L.W-9 as investigating officer in this case, he took up investigation came to Jainapally village examined and recorded the statement of the witnesses. He has seized blouse and outer petticoat worn by victim at the time of incident from victim house under the cover of seizure panchanama in the presence of witnesses. Thereafter he visited place of occurrence/ scene of offence that is the pastureland located at outskirts of Jainepally village and observed minutely. Since there were no material objects, he didn’t conduct panchanama of it however he drew a rough sketch map of it.

     

    On 6th December 2004, the accused was arrested and forwarded to court for judicial custody. On 15th March 2005 Charge sheet was also filed. Charge sheet filed, crime no. 109/2004 Compensation not paid, the case is pending in Special Court. The police registered the case and did not investigate the matter immediately. The accused were arrested and got the bail immediately. Other officials did not show any interest in the case and till now the victim is not get any compensation.
