Murder of a Human Rights defender

  • Summary:: The Tamilnadu government acquired land for housing of Arundathathiyar community of Thaneerpandal village of Avinasi Taluk, Tiruppur District in the year 1996. These lands were acquired from the dominant communities. The Arunthathiyar families were living in that land for eight years. But the government did not measure, and allot the housing sites for the dalits so the dominant community in 2011, burned all the houses and bulldozed them using JCB machines. The dalit people gave a complaint to Thasildar, District Sessions Judge and SC/ST commission on 01.06.2011, 22.09.2011 and 16.12.2011 respectively. The social activists and Human Rights Organizations staged a dharna in Sevur Kaikatti. Complaints were also sent to Chief Secretary and Adidravida Department. So far no action has been taken on the officials who neglected their duties or on the people who were involved in destruction of the dalit village.

Brutal Attack on Dalit youth in Alandurai

  • Summary:: Santhoshkumar aged 24 years, S/o. Palanichamy residing in new colony of Nathegoundanpudur of Coimbatore District. He was a construction worker and belong to Arunthathiyar Community. On 25.09.2011 on the way to his home he was having tea sitting on the moped near R.K. Bakery. During this time Manikandan belonging to Udayar Community shouted at him stating that how dare you, Scheduled Caste fellow having tea sitting on a moped. A quarrel took place between himself and Manikandan. The people gathered and compromised them. He went back to his home. Around 9.30pm on the same day Manikandan and six others belonging to Udayar and Goundar Community attacked Santhoshkumar. His mother Selvi (45) who came on the way was pushed down. The doors were broken. his uncle Nanjappa (75) was also brutally attacked. They also threatened to kill him. His mother was injured seriously. A lawyer known to him informed the police station. He also called the ambulance and took both of them to the Government Hospital. His mother was admitted as inpatient. The police filed FIR under IPC sections and not under SC/ST Act. Only four persons were arrested. Then they were released on bail. Charge sheet has been filed.

Rape on a Dalit Girl Kalol

  • Summary::

    The village named Thod falls under the taluka of Kadi of district Mahesana. It consists of population around 10,000. Patles and Thakors are in majority as there are about 300 families of patels and equal to that of Thakors, hence they are said to be dominant class in the village. Sarpanch belongs to Thakor community. There are approximately 50 families of Raval community, 50 families of Vaghari. There are about 75 families of Dalit community which includes Valmiki, Rohit and Vanik Brahmin. The village is situated at the distance of around 15 K.M. from the Taluka place. Dalits are mainly dependent on a hard labour work in the land of patels and Thakors. Very few are having government jobs. Some of the youths of the dalit community are working in a factory nearby places. Patels are well to do in the village.

     

    Gitaben Laxmanbhai Senghal, resident of village Thod, Ta- Kadi, District Mahesana belongs to scheduled caste. Victim of the incident was working in a tube factory at Adhana, where the accused also was a worker. The accused Babubhai Raval made friendship with the victim and slowly made her to fall her in love with him. Thereafter, the accused gave a false promise to the victim that he would marry her, in spite the fact that he was married already. After taking her into confidence, that he would marry her, the accused took her away and rape her time and again against her will at different places like Dabhva Panjara Pol, Patan Gusest, House, Rajasthan Gusest House, Surat, Anand and other places, Name of other places not known to victim When she became pregnant he refused to marry her and threaten her that he would kill her if she complaints to anybody. He also forced her to take medicine to abort a child, to which she resisted. After some days she was left by accused. Finally the victim filed FIR against the accused and police registered the offence under section 376 and 506(2) of the IPC and section 3(1) (x) and 3(2) (v) of the SCST Prevention of Atrocities Act.

Social Boycott of Dalits at sadharnpur

  • Summary:: The root cause of the social boycott in Village- Sadharpur, Seun Kath and Badshahpur is related to the landlords employing the local Scheduled castes as bonded labourers. It would be clear from the following complaints filed by the boned labourers to the Deputy Commissioner of Patiala District:- That Amarjit Singh S/o Gujjar Singh aged 55 years R/o Village- Sadharanpur, tehsil and District- Patiala had submitted following facts through affidavit for the release of his sons and brother. 1. That his brother Baldev S/o Gujjar Singh and sons Jassa Singh ald Lakha Singh were working as “Siri” with landlords Jarnail Singh S/o Bakshish Singh R/o Village- Seuna Kath, Post office-Badshahpur, tehsil-Samana, District- Patiala for last 29 years. 2. That landlord has agreed to give Rs.11,000 to the labourers which has been given by landlord to their previous landlord Amarjit Singh S/o Chanan Singh R/o Village- Seun Kath District- Patiala. 3. That the landlord has fixed salary of these three labourers @ of Rs.7000 per annum but were not paid any regular wages instead of that they were given just Rs.100/- or Rs.200/- per month. 4. That they were not allowed any leave, they had to pay a fine of Rs.100 per day and night for their absence. Therefore they left the job of above landlord for last two months. 5. That the landlords demand Rs,1,28,700/- from all these three labourers as the outstaying debt and forces them to work if they could not repay the amount. 6. That because of the compulsion of the landlord and nonpayment of their due wages they did not want to works with this landlord. Joginder Singh S/o Natha Singh, Village- Seun Kath, District- Patiala 10. Jagir Singh S/o Bakshish Singh, Village- Seun Kath, District- Patiala 11. Dalvir Singh S/o Bakshish Singh, Village- Seun Kath, District- Patiala 12. Partap Singh S/o Hardeep Singh, Village- Seun Kath, District- Patiala 13. Gurbachan Singh S/o Gujjar Singh, Village- Seun Kath, District- Patiala The announcement of their social boycott was made from village Gurudwara. Following these they were harassed and were not being allowed to go to the fields even to answer the call of nature. The social boycott call was extended to fifteen adjacent villages. The dalits had made series of three complaints to the District Administration during September 2002. The Deputy Commissioner Mr. Tejbir Singh also said that DDVA activist Kesar Singh of village Jhambo met him and complained to him about such a boycott. He ordered SDM Samana to go to the village along with the Deputy Superintendent of Police to find the facts. (Times of India, September 11, 2002).The dalits also had filed a case in the Labour Court for payment of their wages. In lieu of this the SDM, Samana had stated that since the matter is in court, he can not intervene

Dalit family brutally assaulted- Loharbada

  • Summary:: This incident is of Loharbada village; dalits in the village are unprivileged and have less land so they go out for work. The village is mostly Jat populated. The victim Prem Devi w/o Lt.Hardev Regar is belongs to dalit community. She lives with the second wife of her husband and her two children. On 15th August 2012, Prem Devi was going to her field, on the way she had to pass Raisa Khan w/o Rasid Khan. Raisa saw Prem Devi going to field she started abusing her in the name of caste, and tie her with her duppata and pulled her to her house and injured her on the head also beaten her severely. Two of the neighbor Ramdev s/o- Sohon and Prabhu s/o- Ugma saw the incident and came to save Prem Devi and helped her to file FIR. Reason behind the act of violence is that acused Raisa’s children studies in the same school where Prem Devi’s children are studying. On that day the children had fight in the school, which prem devi had no idea but Rasia was very on the victims family and took revenge. According to the victim, in May 2011, Raisa had beaten Manbhar Devi, the second wife of Prem Devi’s husband. The injury was so severe that she was taken by ambulance and was admitted in hospital. FIR was filed regarding that but because of pressure the victim agreed for compromise with Rs.10000/- and five kg ghee. But till today the accused has given only Rs.5000/- to the victim. Now it’s the second time that the accused troubling the victims, witness of the incident are Ramdev and Prabhu, but now Prabhu is afraid to give his witness in the court. Legal Standard Breached: 1. Whoever is guilty of rioting, being armed with a deadly weapon or with anything which, used as a weapon of offence, is likely to cause death, shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both (sec. 148 IPC).
