The village named Thod falls under the taluka of Kadi of district Mahesana. It consists of population around 10,000. Patles and Thakors are in majority as there are about 300 families of patels and equal to that of Thakors, hence they are said to be dominant class in the village. Sarpanch belongs to Thakor community. There are approximately 50 families of Raval community, 50 families of Vaghari. There are about 75 families of Dalit community which includes Valmiki, Rohit and Vanik Brahmin. The village is situated at the distance of around 15 K.M. from the Taluka place. Dalits are mainly dependent on a hard labour work in the land of patels and Thakors. Very few are having government jobs. Some of the youths of the dalit community are working in a factory nearby places. Patels are well to do in the village.
Gitaben Laxmanbhai Senghal, resident of village Thod, Ta- Kadi, District Mahesana belongs to scheduled caste. Victim of the incident was working in a tube factory at Adhana, where the accused also was a worker. The accused Babubhai Raval made friendship with the victim and slowly made her to fall her in love with him. Thereafter, the accused gave a false promise to the victim that he would marry her, in spite the fact that he was married already. After taking her into confidence, that he would marry her, the accused took her away and rape her time and again against her will at different places like Dabhva Panjara Pol, Patan Gusest, House, Rajasthan Gusest House, Surat, Anand and other places, Name of other places not known to victim When she became pregnant he refused to marry her and threaten her that he would kill her if she complaints to anybody. He also forced her to take medicine to abort a child, to which she resisted. After some days she was left by accused. Finally the victim filed FIR against the accused and police registered the offence under section 376 and 506(2) of the IPC and section 3(1) (x) and 3(2) (v) of the SCST Prevention of Atrocities Act.
