S. Sachuthanantham (15), s/o Sekar, resident of Thenkolapakkam, Mailam Union, Tindivanam Taluk, Villupuram District, belongs to Dalit Paraiyar community. He is pursuing 10th std in Nehru Matriculation School, Mailam. He is Ist rank holder in his class and he is a bright student in the class. In the school, the class teachers take leave frequently without the consideration of the students education. Teachers are accused for being lethargic and as the public examination gets closer, they used to torture the students to study well and to uphold the reputation of the institution. Students are subject to severe corporal punishment to score good marks in the examinations.
On 03/03/2011, Student Sachuthanantham was caught hold for copying in the Revision test conducted in the class by the English teacher Chinnadurai. Hence Chinnadurai threatened him, saying, “if you continue to do so, you will be suspended for three years and your education will be in jeopardy”. Sachuthanantham fearing the teacher and his parents, left the school. He roamed around Villupuram and then to Chennai. His father Sekar and the teacher Chinnadurai searched for him. As they were not able to find him, they lodged a complaint with the Mailam Police station. His parents searched for him in Chennai and in the nearby areas. Later he was found in Chennai. But he failed to appear in the 10th public examination for the calendar year 2010-2011.
Legal Standard Breached:
The village consits of 6000 population and main castes are Patel, Bharwad, Thakor, Vaghari (Tadvi), Muslims and Dalits. Dalits includes sub castes of Vankar, Rohit and Valmiki. The total number of dalits families is approximately two hundred to two hundred fifty. Sarpanch belongs to Thakor community. Bharwad community is dominant in the vilage.
The complainant of this case is Samubhai Bhojabhai Parmar. He is a member of sheduled caste. The nehhew of complainant Rakeshbhai Parmar had some quarrel with the accused and three other persons as the accused and three other persons were cutting trees in the field of dalit and their animal destroying the corps. Therefore they were told not to cut trees. On denial the main accused Arjanbhai Bharwad had attacked with stick and he was bleeding. The accused also used abusive words regarding their castes
The victim was taken to the hospital and then information was given to the police and the police registered FIR under section 323, 324, 504, 114 of IPC. And Section 3(1) 10 of SC/ST Act
CSI Boys Higher Secondary School, it is a residential School, located in Ellis Nagar, Tarapuram Taluk, Tirupur District. Around 600 students are studying in this school and there are about 30 Teaching staffs in this school. Kannan, Dinesh, Vinodkumar, Aravind, Gokula Kannan, Hari and Nagaraj are studying 8th standard in this school. On 02/03/2011, Teacher Shanthi, instigated the above mentioned students to file a complaint with the police station about lack of water facilities, hygiene and lack of sanitation. Hence the Police visited the school hostel to investigate about the allegation and conducted an enquiry with the students and the teachers. Hence on 03/03/2011, infuriated Teacher Mr. John Wesly, spanked the students with the cane. A case was filed against John Wesly and he was arrested and remanded under police custody. The injured students were admitted in the Tarapuram Government Hospital for the medical treatment.
On 25/02/2011, Teacher Shanthi implicated the students to water the trees surrounding the class room for the first two periods. Hence Head Master Vedamani, asked Shanthi to conduct the class and asked her to direct the students to attend the class. Having provoked by this Shanthi verbally abused the Head Master. When Peon Arasakumar and Record Clerk Jeyaseelan raised objection to this, Teacher Shanthi verbally abused them.
After the thoruough fact finding mission, it was learnt that the Teacher Shanthi was affiliated to the Hindu United Front, which was against the Christian Institutions and the Dalit teachers. Hence Shanthi instigated the students to file a complaint with police, to damage the reputation of the Christian institution. She was accused of non-compliance with the direction and guidance of the school management. As per the school direction, issues concerning the sanitations are suppose to be reported to the Head Master/ Secretary/ Bishop. But she misguided the students to file the complaint with the Police.
Teacher leveled false allegation against the Christian institutions that the institutions is persuading the students to convert to christainity. Hindu United Front which found to be working against the Christian Institutions, made false allegations against the New Life School, Mulanoor and Luthern Eye Hospital, forcing their closures. Now the Front is eyeing on the CSI School to bring an end to this school, jeopardizing the education of nearly 500 students.
