Dalit Houses Arsoned and Attack on Dalit

    Pasuvapatti village is in Chennimalai Panchayat, Perundurai Taluk, Erode district. Thiruvalluvar Nagar of Pasuvapatti is home to around 130 Arunthathiyar family. Thiruvalluvar nagar dalits were denied burial path by the caste hindu Nadar community people. Hence Dalits staged a protest and got the government approval to use the burial path. Hence on 28/09/2010, intolerant caste hindu mob attacked the dalits and destroyed the Adi Tamilar Name board. Regarding this case, dalits lodged a complaint against Ice Murugan belongs to Nadar community. But the police were negligent to arrest the perpetrator. Being emboldened by this police negligence, Ice Murugan decided to take revenge on Dalits.

     

    On 10/12/2010, Ice Murugan lit fire and arsoned two dalit houses belonging to Sarojal and Palanisamy. But the people considered this as an accident. On 11/12/2010, while Devaraj, resident of Pasuvapatti and belongs to dalit community,  was standing near the main street, Ice Murugan who was drunken state, verbally abused Devaraj referring derogatory regarding caste name. He abused him saying.” you sakkili prostitutes filed a complaint against me, but nothing happened”. you sakkilis can’t do anything and even yesterday I arsoned the houses and you sakkilis can’t do anything regarding this”. When Devaraj raised objection to this abuse, Ice Murugan kicked him down and assaulted him. Dalits of the village, on noticing this assault, came to the rescue of Devaraj. Ice Murugan escaped from the place of incident. Later Devaraj and other Dalits filed a complaint with the Sennimalai Police station regarding the assault and the house arson case. Ice Murugan was arrested and interim compensation of Rs.6250 was provided to Devaraj.

     

    Legal Standard Breached:

     

    1.       Whoever is guilty of rioting, being armed with a deadly weapon or with anything which, used as a weapon of offence, is likely to cause death, shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both. [Sec. 148 of IPC].
    2.       Causing grievous hurt with dangerous weapons is an offence punishable under section 324 IPC, and any person who commits any offence under the section 324 IPC shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to five years and with fine. (sec. 3(2)(v) SC/ ST (PoA) Act).
    3.       Voluntarily causing hurt to and assault or another person is an offence Sec.323, 326, 342,355, 34 of IPC
    4.       Whoever  commits,  the  offence  of criminal  intimidation  shall  be  punished  with imprisonment of either description for a term which may extend to two years, or with fine, or with both. (Sec. 506 of IPC).
    5.       A person, who is not a member of a Scheduled Caste or Scheduled Tribe, who intentionally insults or intimidates with intent to humiliate a member of a Scheduled Caste in any place of public view, is guilty of an offence under the Act ( sec. 3(1)(x) SC/ST (PoA) Act).
    6.       Whoever wrongfully occupies or cultivates any land owned by, or allotted to, or notified by any competent authority to be allotted to, a member of a Scheduled Caste or a Scheduled Tribe or gets the land allotted to him transferred; shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to five years and with fine. [Sec. 3(1)(iv) of PoA Act].
    7.       Whoever wrongfully dispossesses a member of a Scheduled Caste or a Scheduled Tribe from his land or premises or interferes with the enjoyment of his rights over any land, premises or water; shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to five years and with fine [Sec. 3(1)(v) of PoA Act].
    8.       No citizen shall, on grounds only of religion, race, caste, sex, place of birth or any of them, be subject to any disability, liability, restriction or condition with regard to - (a)  access  to  shops,  public  restaurants,  hotels  and  places  of  public entertainment. (15 (2)(a,b) of IC-FR).
    9.       Whoever, being a public servant but not being a member of a Scheduled Caste or Scheduled Tribe, willfully neglects his/her duties required to be performed by him/her under this Act, shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to one year [sec. 4 SC/ST (PoA) Act].
    10.   No one shall be deprived of his/her right to life or personal liberty except according to procedure established by law. No one shall be subjected to arbitrary detention or imprisonment [Art. 21 IC-FR, Art. 9 UDHR, & Art. 9(1) ICCPR].
    11.   Everyone has the right to life, liberty and security of person [Arts. 3 UDHR, Art. 6(1) ICCPR & Art. 5(b) CERD].
    12.   No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment [Art. 5 UDHR and Art. 7 ICCPR].

A Dalit Labourer Attacked for Unable to Attend Work

    Niranjan Manjhi s/o Prakash Manjhi Narayanpur village under Tarapur police station in Munger Dist., belongs to Musahar (SC) caste. Niranjan is a daily wage labourer.

     

    On 10/012/2010, Anil Singh, Sunil Singh, Amit Singh sons of Gobordh Prasad Singh belonging to dominant caste group from the same village asked Niranjan to work in their field but during the time he was pre-engaged in the field of a landlord Umesh Singh of the village, so Niranjan told them his inability to attend their work. Thus, the accused persons annoyed with his statement dragged him out and brutally beat him with lathis. The accused persons also abused victim’s mother and wife when they intervened in the attack. The attack resulted in fracturing of victim’s head. The victim was admitted in a P.M.C.H. After a long stay in the hospital he was discharged.             

     

    After the discharged, the victim lodged complaint in Tarapur police station; however the police did not register FIR.  After 15 days of struggle the case was registered on 25/12/2010, as No. 44/10, u/s 341, 325, 504, 34 IPC & 3(1)(x) SC/ST (PoA) Act., but the perpetrator were not arrested. Though the Superintendent of police issued a notice for immediate arrest of accused persons and suspension of the concerned S.H.O of Bath police station for the derogation of duty, neither of the action was executed. Charge sheet is not filed. The victim has not received any compensation from the administration.

Brutal Assault on Dalit Woman Nambiur PS

    Saroja W/o Mailan, belongs to Dalit Arunthathiyar community, is a resident of Nambiur, Gopichettipalayam, Erode District. On 25/11/2010, she went to Venkatachalapathy Kounder farm field, to collect fodder for her goats. At that time, Venkatachalabathy verbally abused her saying, “sakkili prostitute” and brutally assaulted her. He dragged her by pulling her hair. On noticing that Murugesh is witnessing this atrocity, he left her and absconded from the scene. When Saroja reported this atrocity to the Nambiur Police station, the police officials refused to entertain the complaint given by Saroja and refused to file the FIR. Saroja was admitted in the Gopichettipalayam Government Hospital and was receiving treatment. The Nambiur Police men were found to be in bias in favour of the perpetrator. Police were negligent in filing the complaint and delayed to file the FIR and they enabled the culprit to go scot-free. 

     

    DSP investigation is also found to be biased in favour of the accused. He refused to register the witness statement given by the main witness Mr. Murugesh. DSP is speaking ill about the character of Saroja and accuses her as an immoral womam and as an flirt. Negligent DSP is making false accusation that the Dalits are misusing the Act to implicate innocent caste Hindus. The victim and the witness life is in danger due to the threat of the perpetrators and the biased police men.

Mass Atrocity in Dharapuram

  • Summary:: Jeyakumar Aged 19 year’s s/o. Chinnadurai of Kuppachipalayam of Tiruppur District, He belongs to Hindu Arunthathiyar Community and he was a construction worker. On 18.11.2010 around 7.15pm he went to meet Raju a dalit in the adjacent village of Nanjiampalayam. On the way he had to cross the dominant community’s housing and the milk society owned by Murugesan from Goundar Community. While he was crossing the milk society my two wheeler was stopped by Murugesan. He was angry and shouted at him using fowl language. He also questioned as to how a dalit can ride a two wheeler in the caste Hindu area. Murugesan and his workers took the key of his two wheeler. Immediately he called his relatives and went to his society. The Goundar along with Murugesan, attacked around eight Arunthathiyars Jayakumar (19) s/o Chinnadurai, Ashokkumar (25), Mayavan (28), Ranjith (20) s/o Mukesh, Suresh (28) S/o Paulraj, Sakthivel (20) S/o Ayyavu, Saravanan (25) S/o Velusamy, Duraisamy (30) Kuppanan and injured them. Then he went to the Government head Quarters Hospital and got admission as inpatients. On 19.11.2010 the police came to the Hospital and our statements were recorded. Based on the statements the police filed FIR under IPC and SC/ST Act. The Goundar community persons also gave complaints to the police station. False cases have been filed against dalits also. The police have not even arrested Murugasen and others but have filed Charge sheet in the counter case. No relief or compensation has been paid to the Dalit victims.

Mob Attack on Dalits Tarapuram

    Jeyakumar (19), S/o Chinnadurai, resident of Kuppichipalayam village, Tarapuram Taluk, Tiruppur District, belongs to Dalit community, is a Mason. On 18/11/2010 when Jeyakumar was on his way to his Head Mason’s house located in Nanchiampalayam Village, a group of Gounder community youths who were in drunken state stopped him in the midst and referred derogatory regarding caste “ Eanda Sakkilya Nayea” how dare you ride a bike in our area before us. The Mob brutally assaulted him and tookaway the bike key. Jayakumar who managed to escape from the attack, on reaching his relative house, he told his relative about the incident. Ashok Kumar and Mayavan, relatives of Jayakumar, went to the place of incident to retrieve the bike with its key. The Vanniyar mob again assaulted the two.

     

    On the same day, on knowing the brutal attack leveled against the dalit youths, some dalit people from the Kuppichippalayam went to the Nachiampalayam place of incident to enquire about the attack. Some 40 caste hindus who were intolerant towards dalit assertion seeking justice under the leadership of Mohan, Murugasen, Balu, Tamilarasan and Eswaran, started attacking the dalits whomsoever seen in that area. Ranjith, Suresh, Sakthivel, Palanisamy, Sathish Kumar, Balusamy, Saravanan, and Duraisamy, all belongs to Dalit Arunthathiar community were brutally assaulted by this mass atrocity. All the injured dalits were admitted in the Government Hospital. Affected dalits fear that the Doctor of the Government Hospital may be biased since he belongs to Caste Hindu Vanniyar community.

     

    FIR has been registered on the next day of the attack, since the perpetrators were not cooperative on the date of incident.
