Brief details of the Incident:
Shapuram Hemalatha (19) SC, Madiga by caste is the daughter of Lingayya. She is the native of Peddamangalaram village and is a daily agricultural worker. In search of work she used to go to Shapur daily. Dayakar Reddy of Shapur used to send a Tractor daily to fetch the workers and Hemalatha used to go in that vehicle daily. Dayakar Reddy seduced Hemalatha and eloped with her on 13.1.2011. Ultimately she became pregnant. The parents of Hemalatha lodged a complaint in Moinabad PS. knowing about the incident, Dayakar’s wife lodged a complaint against her husband. Having come to know about the developments Dayakar Reddy brought back Hemalatha and has promised to marry her in front of the police. Based on the complaints, Dayakar was sent for remand. As Hemalatha was minor, she was placed in KGBV Home in Hyderabad. Later she delivered a girl child. Later on Hemalatha’s mother has committed suicide due to the harassment of the caste elders for compromise. At present Hemalatha is staying with her old father. Dayakar Reddy is staying with his wife and children.
Chabathina Mounica(18) is the daughter of Vijay and is the resident of Mandavalli (Mandal), Krishna District. She is studying II Year B Tech in NIMRA Engineering College at Vijayawada. Mudraboyana Francis (23) s/o Subba Rao alias Sudharshanam is the resident of Ingilampakalanka, Mandavalli (M), Krishna Dist. Francis is studying IV Year B.Tech in Koneru Lakshmaiah Engineering College, Vijayawada. Francis parents and their relatives run many Churches. Mounica and Francis are friends for years together. In the year 2007, while Mounica was in 10th standard, Francis took her on his bike to his house at Ingilampakalanka and forcibly had sexual intercourse in his room on the first floor. Having heard the cries of Mounica, the parents and grandfather of Francis consoled her and requested her not to reveal to her parents and promised the marriage with Francis. On the pretext of marriage he sexually exploited her continuously and often used not to respond whenever Mounica insisted for marriage.
In November 2010, having come to know that Francis’s parents were looking for marriage alliance to him, Mounica asked his parents and they denied for the marriage saying she belongs to SC community and also are of lower financial status. Mounica informed the same to her parents. In the first week of Dec 2010 the parents of Mounica met the parents of Francis along with caste elders and asked for the marriage. The parents of Francis replied that having sexual relation is not a big matter at all, she belongs to a lower caste and therefore she doesn’t have the status for marrying their son. When the caste elders scolded them, they said that they will put the matter in prayer and requested for some time. As there was no reply from them, on 06/01/2011 the parents of Mounica arranged for mediation at mediator’s house, in which the caste elders and parents & relatives of Francis have participated. During this mediation, Francis accepted that he has sexually exploited Mounica, but has not accepted to marry her as she belongs to scheduled caste. The parents and the caste elders of Francis have said that they are prepared to give some money, but not marriage. The parents of Francis even abused the caste elders on the name of caste. In a helpless situation Mounica approached DSS and lodged a complaint. FIR was registered in Mandavalli P.S with Cr. No 4/2011, U/S 376,420, 417, 506 r/w 34 of IPC and Sec 3(1)(X) of SC/ST (PoA) Act 1989.
Jaishankar, belongs to Dalit Community, is a resident of M. K. Colony, Mandharakuppam, Neyveli, Cuddalore district. He is owning a Cellphone Shop at the Madharakuppam Market Street. On 06/01/2011, 7 rowdy entered his shop and brutally assaulted him and tried to murder him. They ravaged his cell shop and looted cell phones and properties worth Rs. 50000. When Jaishankar lodged a complaint with the Madharakuppam Police station, the police negligent to take action against the perpetrators. Even after repeated complaints, police failed to take action and threatened the victim to withdraw the complaint and compromise with the perpetrators.
The attack was orchestrated after knowing the community of Jaishankar and with community as a motive. Since the perpetrators were attacked on the direction of the influential person of a political party. The political party VIP is persuading the Sub-Inspector and the Inspector to threaten the victim to choose compromise Jaishankar was not provided any monetary compensation for the loss incurred by this atrocity.
Pinki has been living in village Unch with her husband Rajesh Jatav and her in laws. She used to graze cattle in the fields. On 4th January 2011, the day of incident, as per the routine she went to the fields to graze her cattle. As soon she reached near her fields on the calorie way, Mahendra Singh, the accused, who was already hiding in the nearby mustard fields, jumped out and seized Pinki in his arms and dragged her to nearby mustard fields. She tried a lot to set herself free from his hold. Due to this struggle, her bangles broke and pierced in her hand and got injured. He flung her onto the ground and tore her clothes and tried to rape her. She shouted for help but he clutched her mouth. Somehow, she was able to shout aloud. Her father in law, Sukh Ram who was working in the nearby field, heard her cries and ran towards the incident place. Other villagers also accompanied him. On seeing people coming towards him, Mahendra Singh ran away. Pinki went home with her father in law and narrated the whole incident to other family members. Soon the news spread in the village and villagers tried to catch hold the culprit but he ran away.
Victim with her family members went to the police station to lodge FIR against the accused but police initially did not register her complaint and asked them to come later when the Inspector will come. They waited there for some hours and after the inspector came their complaint was registered but not as per the victim. Police filed the complaint as per their own convenience. The victim was sent for the medical examination after 2 days of the incident i.e. on 6th January 2011.
Next day of filing FIR, the accused who was drunk came to Pinki’s home and abused her in the name of the caste and threatened her that this time she was rescued but next time she will not be left. He threatened her to leave the village. When Pinki shouted, villagers and her family members came and they called Police. Police came and arrested the accused. Statement of victim under section 164 Cr.P.C. was not recorded. Soon charge sheet under sections 354, 323, 341 IPC and Section 3(1)(x)(xi) SC/ST of SC/ST (PoA) Act, 1989 for the case was submitted in the court on 11th February 2011. Police did not play an admirable role in this case. When victim with her family went to the police station to lodge FIR against the accused, police denied lodging the complaint and said that when Inspector will come then only the complaint will be lodged. The victims waited there for several hours and when the inspector arrived, their complaint was registered but as per the convenience of police not as per the victim. They did not send her for the medical examination on the same day but sent her after 2 days of filing FIR. Victim’s statement was not recorded under section 164 Cr.P.C. Police also failed to provide safety and security to the victim from the accused. The charge sheet was submitted to the court on 11.02.2011 under sections 323, 341, 354 IPC and sections 3(1)(x)(xi) SC/ST (PoA) Act, 1989.
The administration did not play a responsible role. The C.O., who is supposed to inspect the site as soon as possible, visited the place on 21st January 2011 after 17 days of the incident. Administration did not provide safety and security to the victim in spite of threats from the accused. Administration provided Pinki with a statutory monetary relief of Rs. 50,000/- for which she was eligible and entitled under the rule 12 (4) of SC/ST Act, 1989.The medical examination of Pinki was conducted on 06.01.2011 after 2 days of the incident. The medical officer took Rs. 600/- from the victim for the medical examination which is not according to the rules. Report stated some injury marks sustained by Pinki. Initially, the examination report was not given to the victim but initially they were provided with it.
The charge sheet under sections 323, 341 354 IPC and 3(1)(x)(xi) SC/ST SC/ST Act, 1989 was submitted to the court on 11.02.2011. Now the case is pending in the court for trial. After lodging the FIR, the culprit came to victim’s home and threatened her to leave the house or withdraw the case. He terrified her that she was rescued last time but now she will not be left. Accused family pressurizes the victim and her family to take the case back. The charge sheet has been submitted in the court on 11.02.2011. Now the case is pending in the court of law for trial. After the incident, the victim is in trauma. She has confined herself at home. She is terrified that anything can happen now with her. Due to this incident, women in the village are also terrified. They do not go to remote areas after dark.
Rampyari (40) w/o Lalchand Reggar lives in Harmada village, under Harmada police station in Ajmer Dist. along with her 4 children. She belongs to Scheduled Caste (Reggar) community. Rampyari is the daughter in-law of Naurti Devi, the present sarpanch of Harmada Gram Panchayat.
On 1 Jan, 2011, while Rampyari was preparing food at home in the morning, all of a sudden Kaluram s/o Lal Jat and his other family members went to victim’ house and started abusing her in caste lines. They alleged that Rampyari is practicing witch craft and so she is a Satan, and has a bad eye on Mamta, the daughter of accused Kaluram, one day or the other she would kill Mamta through magic.
The accused persons took Rampyari to a magician named Baluram s/o Rameswar by force, to wash out her magic power from her. They also thrust brutally Rampyari and then took her to Harmada police chowk to hand her over to police. The accused persons spat on her face for several times in front of police and brutally beat her again. Though the attack and humiliation took place in front of police personnel, police did not take any action against the assailants, merely became a mute spectator.
Finally, police released her from the assailants and sent her back home. On the same day, the victim went to Harmada police station to lodge complaint; however the police did not register FIR. However, with the help of CDR, a local Dalit human rights organization, she could lodge complaint on 7 Jan, 2011 and subsequently a case was registered against the assailant case no. 8/11, u/s 504, IPC & 3(1)(xi) of SC/ST (PoA) Act.
When the assailants came to know that a case has been registered against them, they tried their best to pressurize the victim through their mediators to compromise the case.
None of the assailants has been arrested in this case. The victim has not received any compensation from district administration yet. The case is under investigation.
