Kidnapping a dalit boy

    Bablu  Ku Ravidas(17) s/o- Sajjan Mochi is the resident of village Nagamba in Sadar PS of Hajaribagh Dist.

     

    Accused Bajan Mehta had small business in Delhi; he asked and convinced Bablu’s parents to take him to Delhi to work for his business. They agreed to send him to Delhi with a condition that Bajan Mehta will give Rs.1000/-per month. He took Bablu to Delhi since then Bablu has never contacted his parents. The accused also have never sent the money to them. When they asked him to send Bablu back to home, he did not send and abused them. Till now Bablu has not come back.

     

    Legal Standard Breached:

     

    1.       Punishment for voluntarily causing hurt- Whoever, except in the case provided for by voluntarily causes hurt, shall be punished with imprisonment of either description for a term, which may extend to one year, or with fine which may extend to one thousand rupees, or with both [sec. 323, 334 IPC].
    2.       Everyone has the right of life, liberty and security of person [Art. 3 UDHR and Art. 5(b) CERD].
    3.       General recommendation 19 of CEDAW relates to gender-based violence and recommends amongst other things that states should take all legal and other measures that are necessary to provide effective protection of women against gender-based violence including effective legal measures (including penal sanctions), preventive measures (including public information and education programs) and protective measures. 

    2.      Voluntary Causing grievous hurt – whoever, voluntarily causes hurt, if the hurt which he intends to cause grievous hurt [sec. 325 IPC].

PUSHPA – PHYSICAL ASSAULT AND SEXUAL HARASSMENT

    Brief Details of the Incident:

    Ankuri Pushpa (20), D/o. Krishnaveni SC Madiga by caste is native of Chintapalli (M), Nalgonda District. She pursued her studies till 7th standard. Later she joined as servant-maid on 13th September 2003 in G.N Agarwal (60) a retired Major Colonel’s house at H.No. B-206, Sainikpuri, Hyderabad. Pushpa used to cook and look after household works and stay there itself. For a year everything went on well. At that time there were two other girls staying in the house. The harassment to Pushpa started once the other girls left. G.N Agarwal used to often harass Pushpa to satisfy his sexual lust.  He black mailed her by showing her nude photos taken without her knowledge. As he was old, he forced Pushpa to message his sexual organs and later forced her to satisfy his lust. Likewise he continued his sexual assault on Pushpa by threatening her of dire consequences. G. N. Agarwal’s brother B. K. Agarwal resident of Calcutta also used to forcefully have sex with Pushpa in the same manner as he used to come frequently to his brother‘s house. Whenever Pushpa refuses to do so and say that she will go away, they used to blackmail her with her nude photos and beat her. 

    On 23.04.10 morning, B.K. Agarwal came from Calcutta along with another girl and told Pushpa to teach her about the manner in which she does sex and also told her that she will be moved to Culcutta. As she refused, both G. N. Agarwal and B. K. Agarwal beat and punched her with fists in delicate parts, caused her bleeding injuries and kept her in a room. Pushpa escaped with the help of the girl from Culcutta. Later she called the police over mobile phone and the police rescued her immediately.

    Based on her complaint a case was registered in Kushaiguda PS on 23rd April bearing Cr No. 273/10 U/s 376,324,506 of IPC and 3(1)(12) of SC/ST (PoA) Act. The victim was sent to Gandhi Hospital for treatment and was discharged on 24th April. 

     ACP- Malkajgiri being the IO has recorded the statement of the victim i.e. On 26th April and has taken the victim to the house of Agarwal, but failed to search his house. The police have done good job. The victim has stated that almost all the rooms are fitted with close circuit cameras; the computer is loaded with films shooted through the cameras. As stated by the victim a big sex scandal is going on, therefore immediate raid be conducted to procure the evidences.

    The village Thigalvad is located in Karjan taluka and Vadodara district, which is 8 to 9 K.M. far from Taluka place Karjan. Darbar community is powerful and dominant caste in the village. There are 10 to 15 families of Vankar community and two to three families belong to Rohit community.Vankar and Rohit community are the schedule caste. The village has got a primary school up to 4th class.

     

    The victim Radhaben only eight years old is studying in standard 4th. She was disturbing her mother so she asked her to play outside the house at that time the accused came there and offered her biscuit and took her away at the lonely place and raped her. When the family members of the victim came to know about this, she was taken to the hospital and then FIR was registered under section 376 of IPC and section 3(1)(11) and 3(2)(5) of SC/ST Act

Mass attack & destruction of property when a dog of Dalit barked at Jat youth- Mirchpur

  • Summary:: The population mix of the village ‘Mirchpur’ is very much uneven against the Dalits of the village. Out of around 8,500 population of the village, only around 500 Dalit populations consisting of 150 Valmiki and 350 Chamar, makes the Dalits of the village practically insecure. Added to that, the Dalit population is also economically depended on the Jat population for their regular livelihood based on milking and farming. The hatred between the two communities of ‘Mirchpur’ viz. Jat and Dalits can be tracked back for many years. Dalits in this village have experienced caste-abuse and atrocities for years. The recent incidence was sparked when on 19th April 2010, 3 to 4 drunken Jat youths were passing through the Dalit hamlet. As usual some dogs barked at these drunken youths to which they retaliated by pelting stones at the dogs, which was objected by the owner of this pet dog. The Jat youths first threatened them by saying, ‘Don’t you know who we are?’ A tussle broke out and as a consequence two Dalits, Shri Karan Singh and Shri Vir Bhan had to be hospitalized. The police denied registering F.I.R. of this case. Next day, on 20th April 2010, at least 20 to 25 youths from different village were seen roaming around the Dalit hamlets, threatening of burning the houses of Dalits. The Dalit villagers got frightened and several phone calls were made and even some of the Dalit went to the ‘Narnaund’ police station to complain. As a result some policemen on jeep came to the village patrolling around the dalit hamlet. As a result the gang of Jat youths dispersed and was not seen. The next day, on 21st April 2010, a sizeable police team of 20 to 25 policemen, in 4 – 5 police van, including the ‘Tehsildar’, Shri Jagiram, under the leadership of the SHO of ‘Narnaund’ police station, Shri Vinod Kumar Kajal. The police called all the Dalits, for a gathering at the ‘Valmiki Chaupal’ for compromise in the case. The SHO was over-heard to have told on the phone to someone, “I am giving you one hour to finish everything”. At around 10 am, while most of the people from the Dalit community gathered at the ‘Valmiki Chaupal’, huge gangs of people from the Jat community attacked the dalit hamlet from different directions. The police instead of trying to stop the attackers slowly dispersed from the village. The attackers consist of 500 to 1,000 people including at least 30 – 40 women, who were armed with petrol, kerosene and gel. Some of the attackers were also carrying pistols.For 3 – 4 hours the attackers looted the selected houses of Dalits, who were a little well-off. They also gutted at least 18 to 20 houses on fire. Another 14 houses were looted of the valuables, their furniture was broken and many of the dalit villagers were beaten. One girl named of around 18 years old, Ms. Suman who was polio-stricken, and thereby immobile, who was studying in +2 standards, was burnt alive by the gang. Her father, Shri Tarachand, around 70 years old, tried to save her, but was locked inside a burning room. Thereby he also was burnt alive. Many other Dalit villagers are also injured in the attack. Frightened by the attack and utter non-action by the police, most of the dalit villagers are running away from the village. Even on 24th April, 3 days after the mass attack, a ‘Maha-Khaap-Panchayat’ is being organized by the Jat community. Most of the Panchayat leader attending this Khaap-Panchayat shouted ill-words against the victimized Dalits, and demanding retaliation and social boycott against the Dalits. Ultimately threatened by the actual situations in the village, the villagers started a dharna in front of Mini Secretariat at Hisar demanding their security, proper punishment of perpetrators and enough rehabilitation. In response, the government officials forced them back to their village stating that the condition is normal in the village. When the Dalits reached back to Mirchpur, although another Khaap- Panchayat announced that the two communities will live together peacefully, they experienced a total Boycott by the dominant community both economically and socially. Only 48 accused have been arrested. Trial of the Case is pending disposal before Session Court Hisar. 10 accused released on bail due to lack of evidence. PIL filed in Supreme Court. Out of 150 families, only 100 families are living in that village with fear. The people who are living in the Mirchpur face Social boycott. The victims of Mirchpur are under threat

Sexual Exploitation of a Dalit Girl Women PS

    Kasthuri Devi (29) D/o Andavar, is a resident  of Pachamalai, Gopichettipalayam, Erode District, belongs to Dalit Valluvan community. She studied upto 10th standard as a regular student and then continuing her education, she completed B.Com through correspondence and now pursuing MBA through correspondence. Since 1997, after completing 10th standard, she worked as an accountant under an Auditor namely V.S. Somasundaram. Somasundaram, belongs to dominant caste hindu Kounder community. He sexually exploited Kasthuri Devi since 2007, exploiting the  poverty and critical condition of her family. On the promise of marriage, he had sexual relationship with her for the last 3 years. Once Kasthuri compelled him to marry her, he gave lame reasons and avoided her. Hence Kasthuri reported their affair to his wife.  Soundari w/o Somasundaram, told that she knew their relationship from the beginning and said that she will no allow him to marry her. Soundari verbally abused her, referring derogatory regarding caste.

    Kasthuri filed a complaint with the Gopichettipalayam Women police station, alleging the sexual exploitation of Somasundaram. But the Police department failed to take action against the culprit. On 25/01/2010, while Kasthuri was on his way to home, Soundari and Somasundaram verbally abused her, and they slapped her repeatedly with their slipper. As a final resort, she filed a complaint with the DIG, Coimbatore. Finally acting on the complaint, Gopichettipalayam woman Police station, registered the FIR on 23/02/2010 and arrested both the perpetrators on 24/02/2010.
