Police Arrest of Dalit Victims of Assault

    A. Marithangam, resident of Veeramanikkapuram, Thirunelveli district, belongs to Dalit Pallan community. Thommai Michealpuram near to Veeramanikkapuram is home to dominant caste hindu Nadar community. During a cricket match between these community, a Dalit youth while drinking water spilled the water on the Nadar community youth. This leads to a scuffle between the Nadars and Pallans. Nadar community youths who plotted to avenge this incident, on 17/10/09, M. Essakimuthu, S. Muthuraj and Jeyapandian verbally abused referring derogatory regarding caste and assaulted A. Marithangam at the Thombai Michealpuram bus stand. They threatened to kill Marithangam, if he continues to stay in the locality. Marithangam reported this atrocity to his relatives. Hence Marithangam, Mariselvam, Mohandoss and Nagaraj, went to Thombai Michealpuram to meet the people who attacked Marithangam to enquire about this. This leads to a brawl between the two community youths and Mariselvam and Jeyapandian sustained injuries. They were admitted in the hospital. The next day on his return from hospital Mariselvam was arrested by the police. But the police were negligent to arrest the caste hindu Nadar youths. After exerting pressure on the police department police arrested Essakimuthu, Muthuraj were arrested and remanded in the police custody for 15 days. Dalit youths Mohanraj was also arrested regarding this caste animosity.

Denial of Temple Construction for Dalits

    Paethasamuthiram Village is home to nearly 65 Dalit families comprising 300 people. Almost all the Dalits are engaged in daily wage agricultural labour. This village is home to 1200 families of dominant caste hindu Padaiatchy. Almost all the caste hindus are government employees and teachers. Dalits of Paethasamuthiram are deprived of basic facilities for  a long time. Almost all the government poromboke lands were occupied by caste hindus. Caste hindus have two Vinayahar Temples in their area.

     

    In this scenario, Dalits decided to built a Vinayahar temple expecting better fortune for their hamlet. Hence they unanimously arrived at a decision to built a temple at the Natham Poromboke land given by Goernment. But the Padaiathcis raised objection to their move. They verbally abused them and said they should under their dominance and control forever. Being dependent on the Caste hindus for their livelihood, Dalits agreed to accept the conditions set by caste hindus. Hence Padaiatchis told that they will convene a joint meeting to discuss about the temple construction. Padaiatchis kept on postponing the date of discussion giving lame excuses. Even the Government officials who were biased in favour of caste hindus, were negligent to fulfill the demands of the Dlaits. Dalits who were patiently waited for long, unable to bear the humiliation and discrimination, decided to built the temple on their own without the approval of the Padaiatchis. On 01/01/2010, They Kept one Vinayahar diety at the Poromboke land and started worshipping. During the night around 10.30 pm Revenue Inspector, Police department arrived to the place of worship and removed the deity. On 02/01/2010, VAO as persuaded by the caste hindus, filed a false case against the Dalit youths of the village alleging physical assault and criminal intimidation.

Murder of Dalit Women

    G. Saranya (19), d/o R. Gopal, is resident of Eluppampalayam, Mettupalayam Taluk, Coimbatore District, belongs to Dalit Arunthathiyar community. She studied upto 9th standard and then she was working in Keerthilal Kalidoss company. Her Aunt Chinthamani (Mother’s Sister) is residing in Koundampalayam, Kovai city. Mr. Kannan, who is working as a Jail Warden in the Coimbatore Central Jail, belongs to dominant caste hindu Devar community, used to visit Ms. Chinthamani’s house. Neighbours of the locality complains about the illicit affair between Kannan and Chinthamani. Saranya used to visit her aunt Chinthamani house. On seeing Saranya Kannan, decided to have sexual relationship with her. Kannan persuaded Chinthamani, to advise and pressurize Saranya to marry him. Hence with the help of Chinthamani, Kannan married Saranya, without the knowledge of her parents, with the primary motive to sexually exploit her. They stayed together in Central Jail Housing Board. After enjoying her, he decided to desert her. So he started torturing her to get dowry from her parents. Saranya reported about the physical torture by Kannan to her mother. Kannan used to abuse her referring derogatory regarding caste and boasfully feel superior about his caste.

    On 11/10/2009, Kannan brother visited their house. Kannan tortured Saranya to have sexual relationship with his brother. As Saranya denied to this, both the brothers suffocated her to death and hanged her in the ceiling. Noticing that Saranya was hanging, Domestic help reported this to Chinthamani, Chinthamani inturn reported this to Saranya’s parents. She was rushed to the hospital, but she died on the way. After the post mortem, she was buried.

    A case was filed as a suicidal death. Later this case was closed by DISTRICT VIGILANCE AND MONITORING COMMITTEE AS MISTAKE OF FACT.

A Dalit Youth Tortured to Death for Denial to Work

    Deceased Dharmendra Ram s/o Dhaneswar Ram is the resident of Pateiya village, P.O/P.S Madanpur in Aurangabad Dist. belongs to Chamar (SC) community. The deceased used to work as a driver under Vinod Tiwari.

     

    On the incident day, on 11/10/2010, Vinod Tiwari s/o late Rajbalav, a Hotel owner along with Viki Tiwari s/o Nakul, and Dhiraj Tiwari s/o late Arvind from same village went to deceased’s house and took him along with them to the hotel of Vinod, because the deceased did not go for driving the vehicle since Vinod Tiwari, the owner did not give him his wage for several days. Whenever Dharmendra Ram, asked the owner for wage, he denied him by saying that still there is due amount to pay.

     

    Thus, Vinod Tiwari became irritated at his denial to work. The enraged Vinod Tiwari along with Viki Tiwari, Dharmendra Tiwari and Sangeeta caught hold of Dharmendra Ravidas, took him to the hotel, tied to a pole, brutally beat him, pierced nails on his entire body and then applied turmeric and chilly mixed powder on the wounds and face. After that, the assailants also inserted a hot iron rode on his anus and nose. When the deceased asked for water, the assailants gave him wine to drink.

     

    On hearing the news from the village head, the deceased’s mother, went to the hotel and saw the cruel torture of her son by the assailants. On receiving the complaint the Madanpur police reached the spot and rescued Dharmendra Ram and then admitted him in Bharatpur Govt. Hospital. But after a few hours, Dharmendra Ravidas lost his breath due to severe torture.

    Initially, a case was registered against the criminals on 11/10/2009, u/s 341,323,325,307, 34 IPC. The sections of SC/ST (PoA) Act was not attracted in the FIR.  After the death of Dharmendra Ram, sec. 307 was altered into 302 IPC. All the perpetrators bailed out. The case is under trial now. The victim’s family has not received any compensation from the administration.

Verbal Abuse and Criminal Intimidation Ration shop

    Pudapaadi village Panchayat is in Ammapettai Union, Bhavani Taluk, Erode district. In Pudapaadi, during 2004 women belongs to all SC/MBC/BC community formed a SHG under the name Sri Lakshmi Women Self Help Group. Due to its better performance, the group was awarded Rs. 3 lakhs as a loan by the SBI Bank, to start a marriage decoration business. Chandrika w/o Ganesan  is the Coordinator of the SHG. Ganesan belongs to dominant caste hindu Kounder community and affiliated to ADMK Political party. He usurped the 3 lakhs given by the bank. Since he have not given the money to the SHG, on 09/10/2009, members of the group went to his house to enquire about the money. Ganesan who could not tolerate the assertiveness of these women, verbally abused them derogatory regarding caste. On seeing Lakshmi and knowing her community, he verbally abused her saying, “you sakkili prostitute how dare you come to my house and ask me to repay the money. All the SHG who felt humiliated by this abuse, filed a complaint with the Ammapettai Police station. Since the police have not taken any action on the complaint, they filed a complaint with the District SP and Ganesan was arrested. On knowing this arrest of Ganasen, through his political influence, 4 MLAs visited the police station and brought Ganasen back to his house with all the due respect.
