brief facts of the case as follows 

1)On 27/8/2020 fact 6:30 pm the origanal Camplenant Mrs.Sushma Sunil More ,Lata Chakranarayan ,Vidya Lohara & Jayashree More all R/A  Sidhharth Nagar Pachagani Tal. Mahabaleswar Dist Satara were stnding bifore there housess ,one Mr Prakash Kharat (bodhhachary ) &MR. Prakash Bhalerao ( bodhhachary ) came & starts talking about the principals of Budhhi sm. 

2) The accuse of said affence 1 )Gajendra @ Ganesh Rajendra Kadam 2) Bharat Rajendra Kadam 3) Yuvraj Rajendra Kadam who were standing next to them came towards Bodhhacharyas  the accuse werw starting qurreling with them . they used abusive language & also starting using force against them. the said women try to interrupt  them but the accuse porsons continuous to assault & threat the bodhhacharyas . then the accused person also threat the women and use of filthy abusive language and also make outraged womams modesty and break the blouse of original complanent. 

3) All accused belonging  the Maratha caste whereas complanent and bodhhacaryas are belongs SC categry accuse and complenant knows each other since long tern 

Hence the origanol complanant going to file FIR against abovenamed accuse person but police of pachagani police station refuse to file complent 

This case is nearly one year old of a minor girl, namely Puja Behera belonging to Scheduled Caste category of village Samalpur. Puja is a 16 years old minor girl studying in class 10th. Bothe her father Mr. Tunia Behera and mother Mrs. Santi Behera are daily labourers. On 19.06.2020 at about 1.30 am she was alone at home as parents had gone for labour work and her sister watched TV in a neighbouring house. At that time the accused Kabi Sahu aged about 45 years, entered her house and closed the door. Then he asked Puja Behera to kiss him. Puja did not agree to kiss. Then the accused forced her and repeatedly said to kiss him and tried to rape her. The victim opposed and raised alarm by shouting. To stop her shout, the accused attempted to choke her by pressing her neck and thwacked her with force. The girl was senseless.  Her younger sister named Liza Bhoi came back home at that time with one of her friends.  On their arrival the accused ran away. Finding her in unconscious and serious condition, Liza called her neighbour Basu Behera. They sprinkled water over Puja and tried to bring her back to sense. After gaining sense, the girl said,”I will die so immediate call my parents”. Her parents were informed about the incident and asked to rush back. When they arrived Puja disclosed regarding attempt to rape and murder. Her father Tunia Behera went to Pipili Police Station and lodged complaint about attempt to rape and murder. It was registered as Pipili Police Station Case No. 0164/20 u/s 452, 342, 323, 294, 307,  354-A,354-B, 376,511 IPC, 3(1)(w)(i)(ii), 3(2)(v)(va) SC/ST (PoA) Act,1989 with 8 of  POCSO Act .       

Her neighbour aunty named Basu Behera took her to near Community Health Centre at Pipili. After treatment she came back to home at night. Then Police reached victim’s house for investigation. They found that her condition was very serious. So again victim was taken to District Headquarter Hospital, Puri with the presence of Police.  After 3 days she recovered and got discharged.

The accused Kabi Sahu was arrested. He stayed in jail for one year and three month.

But on 13.09.2021 victim’s family members heard that he is getting bail without bail notice. Then victim’s father Mr. Tunia Behera informed ALVM. On 17.09.2021 the team immediately reached the victim’s place and conducted a fact finding. The team had gone to SDPO, Pipili and met with SDPO Shri Debadutta Barala.
