Attack on a Dalit family because of past enmity- Badera village

  • Summary:: This incident happened in village Badeda, Thesil Haroli, District Una, H.P. Mahinder Singh aged 28 s/o Charan Das aged 70 belonged to SC (Chamar) used to drive Harinder Singhs truck, who is a Jat caste, from the same village. After a month Mahinder told Harinder singh that he will not further drive the vehicle. On 03-06-09 at 9:15pm Harinder Singh with some of his friends entered Charan Das’s house and started abusing him and his family. Harinder left Charan’s house after sometime. Again around 11:30pm with 20-25 people entered Charan Das’s house. Harinder Singh and his friends started beating Charan Das and family. Next day Charan Das went to the police Station and lodged a complaint. Till date no action has been taken against Harinder singh. Counter case is registered against victim. Victims not receive any compensation and relief. Case is running in lower Court Una.

Denial of Land to 12 Dalit Women

    Dalit women of Tarapuram Taluk from villages namely Karapur, Krishnapuram, Karuppampalayam, Meenakshimangalam, Thalavaipattinam, and D. Kumarapalayam, filed a petition with the Agricultural Department through Adi Dravidar Welfare Department under Adi Dravidar Women Agricultural Land Scheme of TAHDCO. Hence the Agricultural Department indentified 12 acres of land in the D. Kumarapalayam, of Tarapuram Taluk, belongs to Palanisamy Kounder. Palanisamy Kounder agreed to sell the lands for Rs. 100000 for each acre. Hence all the 12 dalit women paid Rs. 25000 as advance and Agreement was made in this regard to transfer the ownership on the payment of remaining Rs. 75000. But Palanisamy sold all the lands to Sadhasivam for Rs. 110000/ acre. On knowing this, on 31/05/09, Kuppusamy, Chinnappan, Karupaayee and Karuppaathal, went to Palanisamy Kounder house located in D. Kumarapalayam. They raised objection for his illegal sale of the land to other person without their knowledge. Infuriated Palanisamy, who was not able to tolerate the assertion of dalits, verbally abused them referring derogatory regarding caste name. He and his nephew Mohan, threatened to shoot them to death. As the perpetrators tried to attack them, they escaped from the place of incident. On 01/06/09, the victims filed a complaint with the Mulanoor Police Station. But the Police have not arrested the perpetrators.

    Later this case was CLOSED as MISTAKE OF FACTS by the DISTRICT VIGILANCE AND MONITORING COMMITTEE.

Murder of 3 Dalits in Keelambur

    Keelambur village is in Ambasamuthiram Taluk, Thirunelveli District. In this village Dalits Pallans are in majority, and the Panchayat President post is always won by the Dalits. Hence dominant caste hindu Devar community members are apprehensive about this. Some of the Devar community people, engages is illegal sand mining. Dalits opposes this practice and resist the practice of illegal mining. Hence Dalits and devars are in conflict for a long time. During the Alwarkurichi Paramakalyani Temple car festival, Devar community youths assaulted Ramar belongs to dalit pallan community. In retaliation Dalits assaulted Saravanan and Ganesan belongs to Devar community. Devar community people decided to murder the dalits as an act of revenge. Hence on 30/05/09, Sudalai, Ganesan and Muthukumar all belongs to dalit pallan community were brutally assaulted with deadly weapons by Anthony, Saravanan, Patchirajan, Brahmaachi, Sailu, Ganesan, Muthaiah, Subramanian, Pandydevar and Karupasamypandiyan. Ganesan died on the spot. Sudalai with severe injuries managed to reach his house and reported about this assault to the villagers. Sudalai and Muthukumar rushed to the hospital but both died succumbing to the injuries. Ambasamuthiram Government Hospital have not immediately provided medical assistance, as they were ordered to delay the medical assistance by the Ambasamuthiram DSP who himself belongs to Devar community. Hence relatives and villagers of the deceased staged a protest and refused to receive the body, requesting for the arrest of the perpetrators. As the police department promised to arrest the perpetrators the relatives of the deceased agreed and withdraw their protest.

False Accusation & Arbitrary Detention

     Mr. Bharathan, a stern Dalit Human Rights Defender and Director of Human Rights Education and Protection, Council (also known as Kalam), is engaged in the upliftment of the Dalits in Thirunelveli District. He is instrumental in filing highest number of cases under PoA Act. He has been campaigning for      police reforms and against custodial torture. Thirunelveli Police Department who were apprehensive about his legal aid to the dalit youths arrested by the Muneerpallam police in the Suthamalli village. On 27/05/09, Bharathan was arrested by the Muneerpallam Police officials without giving him any reason for the arrest. He was arrested in the case where there is no mention of Bharathan is not made and he has been arrested based on the testimony of a person who name was not included in the FIR. On 03/06/09, Bharathan was produced in the court with his hands cuffed. His family members and relatives were not allowed to speak to him. As he was given water to drink, SI Munees and SI Ramesh Kannan snatched away the bottle. The highhandedness of the caste hindu officials is evident from the ill treatment meted out to Bharathan. DIG Kannappan has been misled by the caste hindu police officials to give an order for the arrest of Bharathan.

ATTACK AND SOCIAL BOYCOTT

     Vangipuram is a village in Prathipadu mandal of Guntur district. There are a total of 750 families in the village of which SC (Madiga)–245 families, OC Kapu – 502 families and OC Vyshayas – 3 families. The village is dominated by the Kapus and the dalits depend on the Kapus for their daily livelihood by going for daily labour in their lands.  In the recent elections among the dalits some were sympathizers of Congress, some for Telugu Desam and the Kapus for Praja Rajyam.  The Kapus have asked the dalits to vote for Praja Rajyam, whereas the dalits denied.  This irritated the Kapus. On the day of elections Macherla Mahesh went as an agent on behalf of Congress party. Ekurthy Pedda Rao, Ekurthy Thandava, Makke Srinu and Sandhu Venkata Siva Rao of Praja Rajyam pulled out Mahesh and beat him up. Likewise they also beat up Kundapati Samuel who has come to vote. In the mean time the elders came and pacified the situation. Since then the disputes arose between the dalits and kapus. As per the custom the dalits are to carry the dead body of the landlord with whom they work and burn the body. In the routine manner the dalits were going to one of the landlord’s house to discharge their duty as per custom. The kapus objected and warned the dalits not to go through the main streets, but from the outskirts. The dalits informed the same to their caste elders. The caste elders decided that from hereafter any dalits should not go to dispose off the dead bodies without the knowledge of the elders. 4 dalits went to dispose off the dead body of one of the landlord without informing the caste elders. The caste elders held a panchyat and imposed a fine of Rs 500/- each. This irritated the kapus they imposed social boycott on the dalits saying not to sell domestic commodities such as rice, vegetables, provisions, eggs, milk, medicines etc. and if anyone violates this, they will be fined Rs 10,000/-. Kondepati Samuelu asked Cherukuri Nageswara Rao to get a tractor load of sand for him and Negeswara Rao denied saying I cannot get and if I do so I will be fined Rs 10,000/-, likewise Vangipurapu Kotamma went to the shop of Amara Subba Rao for tablets and he too said he will be fined Rs 10,000/-, further Sika Yakobu went to the hotel for Tiffin, he was denied saying the same. The caste elders of dalits having confirmed that the social boycott was ongoing lodged a complaint in Prathipadu PS. The social boycott was imposed from 26th to 28th June ’09. Having come to know about the incident many other human rights organizations including DSS have organized the community and ensured that the case is registered in Prathipadu PS.   The peace committee compromised the case.
