Attack on Dalits for Protesting Against Caste Discrimination, Police Refused to Register Case

  • Summary:: Dasanipur village comes under the jurisdiction of Cholapur police station in Varanasi District, Uttar Pradesh. Majority of people, living in this village are Chamar (SC) and Patel community (Backward Community). Rests of the people are from Thakur, Ahir, Dhobi (SC), Yadav and Nuniya (Chouhan) Community. On 27 March 2007 at about 5 pm the Dalit and Patel children organized a dance party in Dasanipur village. Raju, Veeru and Chhannu and other children from the Dalit community were expected to participate in the function. However during the function, the Dalit children were not allowed to participate in the party, instead they were verbally insulted in the public by the children from the Patel community. At this juncture Veeru requested the children of the Patel community not to insult them and that they do not care if they were not allowed to participate. However, the children from the Patel community allegedly continued with their insult and later assaulted Veeru. Raju and Chhannu ran away from the scene. Raju and Chhannu informed Veeru\'s parents that the children from the Patel community were assaulting Veeru. Veeru\'s mother rushed to the spot and tried to reason with the Patel community. However, she was too insulted in public and was chased away from the scene along with Veeru. The following day, the members of the Patel community teased the girls from the Dalit community on their way back home. They went back home and complained to their parents. Following this incident the members of the Dalit community tried to reason with the members of the Patel community and requested them not to tease their girl. This did not however workout and soon a quarrel erupted between the members of the two communities. Soon after this, on the same day, the members of the Patel community went to the house of Shankar, a Dalit, and beat him up along with his daughter Roma and Rupa. The girls rushed into the house while Shankar was beaten up outside the house. Seeing that Roma and Rupa had escaped into the protection of the house, the members of the Patel community tried to break into the house by forcing open the windows and doors. When they failed, they threw stones and bricks at the house, of which some stones and bricks landed inside the house destroying household utensils. The house was completely damaged. Meanwhile few other members of the Dalit community tried to intervene. But they were unsuccessful and the members of the Patel community of which three men injured eight of them from the assault and two girls were injured seriously. They were later admitted to the Pandit Deen Dayal Upadhyay Hospital, Varanasi for treatment. At the hospital they did not get good treatment. The nurses and the doctors allegedly refused to give proper treatment to the injured on the ground that they were members of the Dalit community. Aggrieved by this, the injured lodged a complaint with the Chief Medical Officer, Varanasi against the discrimination they faced at the hospital. They also went to the Bhusaula police outpost and informed the officers about the entire incident that happened starting from 27 March 2007. The police officers on the same day came to the village and talked with the Patel community but refused to talk or record a statement of the injured Dalits. The same day evening on March 28, the Station Officer from the Cholapur police station came to the Dalits\' house at about 9pm. The Dalit community showed the officer the house that was under attack and also the stones and bricks pelted at the house and the damage it has caused to the house. The officer however, did not record any statement, but allegedly shouted at the Dalits saying that they were making up a case against the Patels. At that time Mr. Paras and Mr. Ram Shakal, two Dalits, came to the scene. They are cart pullers and they were not present when the incidents happened. But the police officer allegedly took them to the police station along with two members of the Patel community. The next day morning, the officer allegedly started assaulting Paras and Ram and they were both charge sheeted along with 10 other members of the Dalit community under Sections 107, 116 of the Indian Penal Code and 151 [arrest to prevent the commission of cognizable offense] of the Criminal Procedure Code. They were however released on bail by the officer on the same day. On 31 March 2007 a complaint was filed by the injured and the representatives of the Dalit community at the office of the Senior Superintendent of Police. However no action was taken by the SSP. In the meantime, the rest of the accused who were charge sheeted were scott free. FIR has not been registered from the either party. Though people from Dalit community gave complaint to Senior Superintendent of police, but no action has been initiated.

Five Members of a Dalit Family Attacked and Women Raped

  • Summary:: Raj Kumari (26) W/o Subash Singh, Mana Singh (36) S/o Late Deepchand, Subash Singh (28) S/o Late Deepchand, from Meerapur Garhi, Pilkhua Police Station, Dist- Ghaziabad, U.P belongs to Scheduled Caste (KORI Community). On 20th March 2007 at 02.00 a.m, a gang comprised of 12 people, putting mask and armed with Pistol, Dagger (Chhuri), Stick (Lathi) entered the village while the villagers were asleep. First, they entered the house of Manasingh whilst he was sleeping on the Veranda and rest of his family members in the room. First, the assailants tied with rope both hands of Mansingh and his son Subash, and then locked them in a room. Three of the assailants (name unknown) from the gang asked Mansingh that where Rajkumari is? In answer he said that she is sleeping in the room. Three of them took her to a separate room where she was allegedly gang raped. Meantime other assailants from the gang sexually assaulted Baby (25), w/o Rajendra. Before leaving the place, the assailants ransacked and looted money, gold and other valuables belongings from the victim’s house. Instantly Amarpal (34) S/o Late Sishram, the neighbor of the victims contacted to Pilkhua police station over his Cell phone. The police reached the spot at about 4.30 a.m. and enquired about the incident, by the time all assailants had escaped from the spot. Police could not trap the assailants, however police asked the victims to go to the police station in the morning to lodge complaint. On 20th March’07 at about 10:30 am police lodged complaint u/s 380 IPC. While Narinder, a news reporter from “Amar Ujala” was visiting the place at about 11 a.m again the police went to the spot. One of the Police personnel, named Amarpal (34) s/o Sishram asked Mansingh Rs 200/- towards their vehicle fuel expenses but Mansingh was not able to afford the amount as he was in a very wretched situation. Conversely Narinder had covered all the news and published on the following day in Amar Ujala. Once again a team, comprised of 7-8 police personnel went to the spot by a jeep, but none of the lady police was in the team. Bobby and Rajkumari were taken to the police station. From there a lady police accompanied them to M.M.G. Government Hospital, Ghaziabad for medical test. On 20th March’07 at around 9:00 pm at night, District S.P. and Pilkhua O.I.C and other police officials went to the spot for investigation. At around 10:00 pm, they took Subash Singh, Mann Singh, Rajkumari and other victims to the police station. On 21st March 2007 afternoon, Mann Singh and Rajkumari were sent to the Magistrate Court, Hapur, to give their statement. None of the assailants has been arrested till date. Custodial Torture of a Dalit on Theft Charge

    Bhuraram (38) S/o Kasthura ram, a laborer, resident of Bhadrajun Village hails from a Scheduled Caste (Meena) family. He survives with 3 children and a wife.

     

    On 19.03.07 at 9.00 a.m Bhura Ram returned home after harvesting the wheat in. Eswar Singh a police constable from Bhadrajun Police Post came to his house and informed him that A.S.I  Shivlal called him to the police station. When he asked the reason the constable responded that he did not know. Eswar Singh took Bhura ram to Bhadrajun Police Post in his motorcycle.

     

    S.I Veena Lodh and A.S.I Shiv Lal were present at Bhadrajun Police Post. After making Bhura ram to sit for 2 hours, Veena Loth ordered Eshwar Singh to beat him and Eshwar singh obeyed his words. And after 2 hours they took him to Nosara Police Station where they kept him for 3 days. At Nosara Police station Eshwar Singh, Manghilal and two more constables have beaten him with belt and lathi. When he asked the reason for beating they beat him without replying him. When his father, uncle, Mangalram came with the request to release him, the police threatened them by saying that they would file a false charge against them and chased from the station. Eshwar singh and another constable tied his hand and made him to sit on the chair. Bhagchand and Shiv Lal kept their legs on his neck and hip and 4 of them beat him on his shoulders and pulled out his hair from the front head and blood started to bleed. They also beat him with belt on his hip, later he became unconscious for that whole night.  When he became conscious he vomited and Bhagachand told him that he vomited due to food poison and gave him some medicine (suran). The police took him to Ashoor Government hospital, where he had given medicine.  Later they took him to the DeputyPahar Singh Rajpurohit R.P.S. of Ashoor Police Station, to whom he narrated the whole incident and Deputy warned the constables and ordered him to release. Shivlal sent Bhura ram along with Kasthuram, father of Bhura ram.  Bhura ram and his family members met the S.P Dr. B.L. Meena IPSand gave the complaint as well as showed his injuries. The SP responded that the injuries were not severe and asked him to continue the medicine and scolded and chased out them. On 24/03/07 Bhura ram filed a petition in the court. Village people filed 6-7 theft cases against Bhura ram.  But he denies nothing he has done. FIR registered in court but not in PS. Nosra Dist. Jalor.

    Case in Brief

    After the death of her father the victim stayed at her aunt’s house. After two months she met Dharma Suresh who was her neighbour. When her aunt used to go to her job Suresh used to come to her house and deceived her with deceptive words. Slowly they developed physical intimacy which resulted to pregnancy. When she informed him, he promised to marry her as he shall be getting money. On 4th of January, 2007 he informed her that he is going to Hyderabad and return within one week of time. As she had no further information about him, she went to his house where she was attacked by his family members. With the intervention of the police his parents agreed to call the accused and get marry to the victim.

Rape of a Dalit minor in Borgaon

  • Summary:: This is the incident of village Borgaon, in MoudaPS in Nagpur district. Puja Manvatkar(9) a student of class 3 was raped by 63 old man Mahadeo Meshram. Puja Manvatkar d/o- Bandu Manvatkar is a dalit girl is resident of the village. Puja’s Grandfather Yasbant Manvatkar is the neighbor of the accused Mahdeo, and puja used to play in front of the house of her grandfather. She knew the accused very well and used to regard him as grandfather and used to tease her. One Saturday on 10.03.2007 when puja returned from school as usual she went to play with her friends Madhuri Meshram, Komol and Nikita. They were playing in front of Mahadeo’s house; Mahadeo called puja to his house tempting her to give money and raped her and did not give her money but slapped her threatened her when she asked for the money. When she came out of the house shama Peter saw her and she told everything to him. She even told her family that Mahadeo has done this with her before 5 times and was giving money. He had even threatened to kill her parents if she informed it to anyone. Her parents reported in police and FIR was filed. Police has arrested the accused and taken the statement of Shama Peter but he has left the village because of the threats of the accused.
