    Munuswamy K. Kannaiah belongs to Scheduled Caste (Mala) working as jeep driver. He is surviving with wife Karavadi Cheeralamma and three children. On 01March 2007 at 7.00 PM Gangadharam (brother) of Munuswamy got a phone call from Ramu, jeep owner of Gandadharam that the jeep owner Bunapalli Chandra S/o B. Krishnaiah belong to Chakala caste and two others Thagiyuru Ramana S/o P. Ramakrishna, Scheduled Caste (Madiga), Desithoti Chandrasekhar @ Sekhar S/o Ramana belong to Scheduled Caste (Mala) tied Munuswamy to the iron rod and beating him with the sticks near the railway station, because he did not pay the due taken from the owner. When the deceased Munuswamy lost his conscious they took him and thrown him nearby depilated AP Tourism Building and went away. 02 March 2007. Manemmma elder sister of Gangadharm came to him and told that the accused killed Munuswamy near Govindarajaswamy Tank. When both of them went to place of offence they saw the dead body of the Munuswamy lying in an old building of AP Tourism. They found several injuries on the body of Munuswamy. He had a swollen face, marks of the rope on his hands and blood clot at the back of the head. The elder brother of the deceased K. Gangadharam gave complaint at East Police station on 02 March 2007.

     

    Ch. Rajaiah, SDPO, Tirupathi, conducted investigation, Accused arrested and Rs 1, 50, 000/- was paid as Compensation .Ganesh was admitted in Social Welfare Residential school. House site was sanctioned. Deceased wife was provided employment. Charge sheet filed on 05/06/07PRC No 14/07.

    Badivenkstappagari Nagabhushanam, 33, S/o B. Kondanna r/o Anjaneyaswamy Manyam of Tadapatri Town, Ananthapur (D). On 01.03.07 at about 05:30 pm the accusers P. Kalavapalli Pedda Mallesu, P. Chinna Mallesu, P. Suhkanna @ Nallodu, P. Mallesu @ Dubbodu, P. Chinna Sunkanna, P. Venkatesu @ Ladda, P. Suhkanna @ Yerrodu r/o Paddapappur (Village), (mandal). Wear cutting thorny plants in Anjaneyaswamy Manyam of Tadapatri Town on seeing this victim B.Nagabhushanam & B. Sreenivasulu went and questioned their action, then the accused questioned as who are you to ask in abusive language then B.Nagabhushanam told the accused to speak decently so the accused grew wild and attacked the victims with sickles causing bleeding injuries, B. Ramanjinamma w/o B. Sreenivasulu came there to rescue her husband by raising cries the accused beat her with sickle and the same missed and caused an abrasion on he throat of B. Ramanjinamma, C. Nagabhushanam came there to save the above mentioned victims but he also was attacked by the accusers with sickles causing bleeding injuries. Later the victim complained in Tadpatri town police station and the case was registered as Cr.No 16/07 U/s 147,148,324 R/w 149 IPC. Ananthapur Court.

     

    A Case was registered Cr.No 16/07 u/s 147,148,324 r/w 34 IPC, In Tadipathri, Police Station. Charge sheet filed on 11.05.07 and CC. No 138/07.Petition file under section 216 Cr.P.C .SC/ST Act to be Added. No right sections has been added in FIR the police did not follow as per compliant .SC/ST Act is not Added. Looting, destroying and burning of Dalit houses because of previous enmity, Salwan village

  • Summary:: Saalwan village is situated on the brink of G.T Road, Karnal and about 45 km away from its District Headquarters, Karnal in Haryana. A high-voltage line of caste virus exists in this village, but it will not be visible to the naked eye. This caste disease came to light through the recent incident, occurred at Salwan village on 1st March’07 On 26 Feb’07 at 6 p.m Pradeep Kumar (16) s/o Ram Kumar and Lilu (18) S.o Nakli Ram who belong to Valmiki community were taking their cattle to graze, which entered the field of Mahipal, the Rajput. Mahipal allegedly used casteist language that angered the Balmiki youth, who beat up Mahipal. Next morning on 27.02.07 at 6 a.m Ram Jauari a Dalit boy while he was roaming around happened to see a dead body of Mahipal lying in the field. He informed to the family members and relatives of Mohipal immediately. The family members of Mohaipal informed to police regarding the incident. Police reached the spot and started investigation about the incident. Police found some footprints and sheet of sheep and goats in the field. Based on that police suspected that the shepherds must have committed the murder of Mohipal, and so the police arrested Pardeep and Lilu in this connection. Police cruelly tortured the victims and forced them to confess that they have committed the crime. Pertaining to the murder of Mohipal, the Rajputs convened a meeting at village’s Badi 7Chaupal on 28.02.07 evening to plot against Dalits. 4Conversely someone from the Dalit Basti heard about the conspiracy made by Rajputs. Therefore 90% Dalits had fled from the village, men, women and children ran for their lives, finding shelter with relatives in other villages. Many grandparents stayed back, because they couldn’t run, and their lives mattered the leastThe Rajputs had planned well in advance. They cut off phone lines and so the police could not be informed. On 01.03.07 at 1.30 p.m, with the leadership of Block Samiti Chairman- Surjit S/o Baru, Ranjor S/o Kesa, Maste Ghanshyam S/o Baru Ram, Dharamveer S/o Suresh, Omveer S/o Udha and Kaptan, approximately 2000 Rajputs being divided into 3 groups attacked on Dalit Basti. The mob was armed with swords, pickaxes, lathis, pharses, barchis and gandesis and, some allege, even revolvers. They broke doors and attacked, in every house selective markers of the relative prosperity of Balmiki homes – homes that had nothing to do with Mahipal’s killings. In house after house, utensils, bicycles and fans are misshaped; the suitcases, trunks and cupboards opened and ransacked jewellery and cash allegedly stolen, sometimes along with stored wheat and grains. And then, the houses were set on fire, though the Balmikis who were following were putting it off. The Rajputs destroyed 190 houses and burnt 10 houses with Kerosene and diesel. Where the arson was successful, police reached to the spot after 3-4 hours of the incident, despite Jasveer’s (one of the victims) contact to police over his Cell phone. The police allegedly cleared all evidence of fire, but burnt clothes along the alley; charred walls and the smell of burnt wood still speak the truth. 25 Dalit youth were injured, one of them critically injured. The injured victims were admitted in the Civil Hospital at Assandh, District Karnal. Doctor referred Jasvinder and other victim’s to Troma Center in Karnal since their condition was so critical. Some of them are in the same condition till date. The next day, 2 March 2007, despite heavy police presence, a Balimiki youth, Sonu, 20, died under suspicious circumstances. The Balmikis claim that this is a murder, because he was a cousin of those who killed the Rajput. The Rajputs say that this suicide. The post-mortem confirms suicide, says Superintendent of Police, Karnal, Sibash Kabiraj. But the Balmikis states that the post-mortem report has been managed to prove it suicidal death. Due to this incident, Dalit who left and those who are still in the Basti are scared for their lives. The relief and rehabilitation for the victims is also not adequate. There have been no arrangements from the Government\'s side to make the Dalits feel safe and secure.

    The incident relates to the Village Godana. Poat- Nawada, District – Bhojpur, Bihar. Ppulation of this village consists of 47 Houses belonging to SC Community 45 Houses belonging to upper caste community. Schedule Caste community mainly consists of Chamar, Dhobi, Nuts and Musahars.

     

    The deceased victim Deepak Kumar used to work as a daily labor in the under constructed house of Bali Saw .On 26.02.07 Deepak Kumar went to Bali saw‘s house and asked to clear his three days wages. Consequently, after some time Bali saw came along with his friends and electrocuted Deepak Kumar unto death .After some time his father came to know that his son was forcefully taken by Bali saw towards his house. His father immediately went to Bali Saw’s house and shocked to see that his son was handcuffed with an electric wire in hand. His father immediately informed police officials and lodged an FIR Nawada police station.     

     

    Victim did not get compensation. One accused in the Jail. Two accused bailed out. Case is under trial.

DESERTION & CHEATING IN THE NAME OF LOVE

    Case in Brief

    Savirigana Bharathi, aged 30 years, D/o Savirigana Ramaiah, R/o Patapatnam, Srikakulam, SC Mala by caste got married to her uncle Ramakrishna in the year 1992 as soon as she completed her 10th standard.  In her marital life she gave birth to a girl and a boy child.  But as both Bharathi and Ramakrishna were not willing to stay in this marriage, they got divorced in the year 1997.  The boy child was taken by Ramakrishna and the girl child by Bharathi.  

     

    From 1997 to 1998, Bharathi stayed with her child and was working as joint secretary in IVDS.  Gopi alias Vijay Kumar, aged 30 years, R/o Patapatnam, Srikakulam, OC Brahmin by caste started conversing with Bharathi in the beginning of the year 1998 and gradually closeness developed between them and by ending of the year 1999, Bharathi proposed that they should get married for which Gopi asked time for one month.   After one month Gopi said that he wants to marry Bharathi.  Both of them started living together in the same village with the consent of both the families since 1999.  She got aborted twice from 1999 to 2003.  Bharathi gave Rs.50,000/- to Gopi as dowry when he said that he wants to buy a two-wheeler.  In the year 2003, Gopi got engaged to another girl of his caste and Bharathi approached the collector and SP for justice.  With the intervention of the district SP and collector, Bharathi and Gopi made an agreement and signed in the presence of Patapatnam police station that both of them would live together and Gopi would not marry any other woman except Bharathi.  Gopi was not to be seen from the next day.  Bharathi searched everywhere, enquired his friends, family and relatives but in vain.  

     

    In the year 2004, one day suddenly Gopi called Bharathi over phone and said that he was forcefully sent to Vijayawada by his parents and asked her to meet him immediately.  Bharathi reached him next day by evening and both of them decided that they should stay in Hyderabad.  She returned to Srikakulam and made necessary arrangements, resigned her job and went to Hyderabad to stay with Gopi.  Bharathi stayed in her friend’s place for two months where Gopi used to visit her regularly.  Gopi asked her to search a job abroad so that she can work there and search a job for him.  She got visa to Kuwait but one week before her departure, he asked her not to leave.  She cancelled her trip though she had to loose Rs.60, 000/- that she spent for the arrangements.  

     

    Then she worked in Atchampet for two months and he used to visit her once in a week.  He asked her that they should have a child and as a result she conceived.  Later she worked in Chevella for two months and then got a job in Amberpet.  Both of them took a house in Amberpet and started living together.  He was doing business in Balanagar and said that it would be better for him to stay in Balanagar for it is the initial stages of business.  He started living with his brothers in Balanagar and used to visit her regularly.  A girl child was born on 9th October 2005 and was named Pavithra.  They together celebrated her first birthday on 9th October 2006. 

     

    In February 2007 he said that his family is forcing that he should get married to some one in his caste.  This raised a dispute among them and Bharathi did not agree.  They shifted their house in Amberpet on 25th February 2007 and he said that he is ill and also the issue of his marriage is getting him down and wants to stay alone for some days without Bharathi and his parents.  Bharathi agreed for this.  But he left her on that day without any contact.  She tried everywhere for him but again his whereabouts were not known.  Again he came into contact on 10th April 2007.  When they met Bharathi noticing the guilty feeling in him demanded him what the matter was and he said that he got married to another woman called Durga of his caste and for two days, Bharathi’s friend, Bharathi and Gopi argued on the same matter.  After a week, with the force of Bharathi, he said that he is living with Durga in Kukatpally and she went there.  An argument arose between them and as next day was Sunday, Bharathi went to church and on Monday when she went to Kukatpally she did not find them.  On enquiry, Bharathi found out that Gopi and Durga are living near Durga’s brother-in-law’s place in Bharathnagar.  When Bharathi went there, Durga, her sister Geetha and brother-in-law abused Bharathi in the name of caste.  

     

    When Bharathi took this issue to Bharathnagar Mahila Mandali, they talked to both the parties and Gopi said that Bharathi forced him to stay with her and they don’t have any relation.  Bharathi complained in the Sanathnagar PS on 23rd May 2007, but they registered the case u/s 498A of IPC and 4, 5 of DPA.  No action was taken on the accused and he is living with Durga.  Bharathi is left out with her girl child alone.
