Rape of a Minor Dalit Girl Bharatpur

    Nagla Kishor village is located on Uttar Pradesh & Harayana border. Nagla Kishor village is very small with 12 families. Kavita was a student of class 5th in the Government girls primary School at Sablana. On July 18, 2006 around 11’O clock, she was coming from a tailor’s shop. There was a millet farm on her way. The accused namely Irshad who was already present there, clutched Kavita with his arms and stripped off her clothes and forcibly raped her. All this caused grievous injuries to Kavita; she got injuries on various parts of her body and her internal genital parts, started bleeding and she became unconscious. Irshad ran away from the spot. She was brought back home by her relatives. During the time her father was out of station, when he came home in the evening Kavita’s mother told him about the whole incident. Kavita & her father went to the police station to lodge FIR. The local police registered their FIR and sent Kavita to the hospital for medical examination.

     

    Accused and his family continuously threatened victim and their community that they would kill or impose social boycott on them.  Later on due to pressure and threats of Mave & Dalit community, Kavita and her family withdrew their case.

     

    Kavita’s medical examination was done but the medical officer produced a report contrary to the factual situation. According to the report, Kavita’s genital parts, hair & breasts were properly developed. He stated that there is no injury, mark or bleeding from hymen and a finger could hardly enter the vagina. The medical report denied any kind of external or internal injury and medical officer mentioned no significance of Rape.

A Dalit Woman Gang Raped and Her Family Attacked

    Rajkumar Kamble (32) belonging to Mahar community, was having two wives Meena Kamble (36) and Pooja Kamble (22). He was an auto driver and was living in a rented house as a tenant. Three members were together in the rented house. Smt. Shantabai Gogte is the house owner. When the advance of Rs. 1200 was paid to the land lady for two months the land lady asked for their caste. When they disclosed their caste, she threatened them to vacate the room. When she was demanded for the refund the advance money, she simply negated the payment of the money in advance. She firmly told that she would not let the family belonging to Mahar community stay in her house.

     

    Once it so happened, Rajkumar Kamble brought mutton and while cooking, Pooja burnt that. That aroused anger in Rajkumar Kamble causing a bit scolding and shouting at his second wife Pooja. Hearing that the land lady started abusing them with vulgarity related to their caste, she went away. The victims too went to bed. Pooja got up for urinal. After her Rajkumar also had woke up and went for lavatory. They saw Ramesh Damodare standing naked outside the door. When they asked for the reason he went away from there. After five minutes or so Dharma Ital, Sunil Kirlekar, Ramesh Damodare and Pravin Banubakode came there and knocked at the door of Rajendra. As soon as Meena opened the door, the culprits started beating them. It was 2.30 a.m. and Smt. Pooja the second wife of Rajkumar Kamble however managed to escape and went to Frezarpura police station. The four accused took them to the house of Dharma Ilal. Both were tied with rope in different rooms and Dharma Ital and Sunil Kirlekar gang raped her and went their way back threatening them. It was then 3.30 a.m. At 4.30 a. m. on 17.7.2006 the victims went to Frezarpura police station and narrated the detailed incident. Policemen along with them went to the house of Dharma, where they met the accused and got them arrested. They were taken to the police station.

     

    Police Administration arrested the accused and remanded three to police custody and sent one of them to the remand room. No protection or shelter is given to the victims. No compensation is received.

    Ms. Bhavani, aged 20 years, r/o Shivajinagar, Meerpet, Ranga Reddy District belongs to SC community. Santosh Reddy residing adjacent to Bhavani’s residence developed acquaintance as their fathers are employees of BDL.  This acquaintance slowly led to intimacy between them where Santosh Reddy used to force Bhavani to meet at Tankbund, Meerpet, Internet and parks. This intimacy developed into love and on 18th June, 2006 she informed him that her parents are seeking to get her married and are searching for matches.  They felt that if their parents come to know about their love, they would not agree as they belonged to different castes.

     

    Santosh Reddy threatened that he would commit suicide if Bhavani disagreed to marry him.  He assured that they would register their marriage and convince their parents later.  On 18th June 2006, accompanied by their friends and relatives, they went to Sai Baba Temple, Vaidehinagar, Vanasthalipuram, Hyderabad and he tied the marriage necklace and both of them exchanged garlands.  Then they moved to the rented house at Gaganmahal in Domalguda, Hyderabad and started living together.

     

    They lived happily for just a week.  Her in-laws started calling her husband and instigated him to leave her as she belonged to SC community.  They also said that he would have got a dowry of 15 lakhs if he would have married a girl from their community.  Gradually, her husband and her in-laws started abusing and harassing her in the name of her caste.  He started coming late in the nights, consuming liquor and abusing her with filthy language.

     

    On 14th morning he took his certificates, laptop and other items that belonged to him.  Bhavani could not understand that he was making arrangements to leave on next day.  On 15th July 2006, he left her without any intimation or information to her.

     

    An FIR was registered on 8th of August, 2006 CCS, Hyderabad.  She also filed Habeas Corpus.

     

    Present Status:

     

    She left the rented house at Gagan Mahal and is presently living with her parents.

Abetment to suicide and atrocity

    The victim of this case namely Chhaganbhai and the complainant Chakabhai are belonging to schedule caste community. The complainant resides at village Kanesara, Ta- Jasdan, District Rajkot. There are people of different communities living in the village. The accused persons are involved in animal husbandry. On 11-07-2006 the accused persons went with their cows, buffalos, goats and destroy the corps of the victim and complainant. Thereafter, the victim filed complaint against accused. Police proceeded under section 151 of Cr.PC.

    Thereafter, on 14-07-2006 the victim was coming from his farm, accused persons had stopped him and used abusive and filthy words, they also insulted him by stating abusive words regarding his caste. He was also threatened by the accused. Hence, on next day i.e. 15-07-2006 the victim hang himself with fan and gave up his life.

    The complainant had filed FIR against Galabhai Bodhabhai Soriya, Jivabhai Kadvabhai Ratadiya, Rukhdbhai Vibhabhai Soriya, Khodabhai Merambhai Zafda, Mangabhai Sidhabhai Ratdiya and other. The police registered FIR under section 306, 506(2), 114 of IPC and section 3(1)(10) and 3(2)(5) of SC/ST Act.

MURDER Jhansi Rani

    Case in Brief:

     

    Background of the Village:

    Uyyuru Mandal, Gandigunta village consists of 600 families (approx.) of which 200 families belong to Kamma caste, 400 families being from other castes.  Kammas dominate this village. 

     

    Socio-Economic-Political Conditions of the Village:

    The dalit families in the village are mostly landless and work as agricultural laborers; hence they depend on the dominant land owning community as wage laborers for survival.   Naturally the dominant caste Kammas exploit the dependant status of dalits to their advantage and oppress them in all ways.

    Summary of the incident:

    Gummadi Sudheer, s/o Hanumantha Rao, aged 40 yrs, Kamma by caste, native of Gandigunta village, Uyyuru mandal of Krishna district is the accused in this case.  The victim, resident of the same village, Ms.Chinthagunta Jhansi Rani, D/o Kanthamma, aged 36 yrs, SC-Mala by caste is a married woman and she has a grown up daughter studying 10th standard.  Few years after marriage her husband deserted her and as such she was staying with her mother in Gandigunta village, i.e., the village where the accused Sudheer lives.  While so, the accused Mr. Sudheer seduced the victim Ms.Chinthagunta Jhansi Rani to have sexual relationship with him.   Ms.Chinthagunta Jhansi Rani, being a lonely woman without husband, reluctantly maintained extra marital relationship with him for the last one year.   In such a situation Mr. Sudheer, the accused started dominating her and controlling her freedom in all manners.  He would not tolerate her having friendly relations with any other men.  With such an authoritative male chauvinistic attitude the accused continually harassed and abused her of having relationship with other men.  He always doubted her fidelity and arrived at the opinion that she was having extra marital affairs with other men. Finally he decided to kill her so that she can never have relationship with others.  On 13th July, 2006 he went to her house and set her ablaze after pouring kerosene all over her body.  Her neighbours noticed the smoke from her house and when they came to her house and tried to open the door, it did not open. They tried to catch hold of Sudheer when the door was opened but he escaped and fled away on motorcycle with other person.  The matter was reported to the police and a case U/s 302 IPC & SC/ST (PoA) Act u/s 3(1)X  was registered as Crime no.106/06 , against the accused on 13/07/06.  The body of the victim was sent for post mortem.

     

    Recommendations:

    1.            Compensation must be provided/paid as per SC/ST (POA)   

                 Act immediately

    1.            Rehabilitation should be provided to the deceased family
    2.            SC/ST Act 3(1)XII  section must be altered in the FIR
    3.            Govt. should take appropriate action on the violence    

                 against dalit women
