Dalit Shot Dead for not Paying Chauth Basedi

    Mani Ram s/o Shayam Lal Caste – Jatav, r/o Atarsuma, Police station Basedi, Tehsil Basedi in Dholpur District, belongs to Scheduled Caste (Jatav) community. The Incident took place on 8 Dec, 2005 at about 10.00pm. Janak Singh s/o Nekram, Sardar s/o Karan Singh, Horiom s/o Sardar, Devendra s/o Sardar, Dharam Singh s/o Pooran, Moti Singh s/o Nawab Singh, Hemant Singh s/o Pati Ram, Kunj Bihari s/o Pati Ram, Om Prakash s/o Pati Ram, Caste Thakur, r/o Atarsuma, Modho s/o Tejsingh, Nathi s/o Rati Caste – Lodha, r/o Kuiaa Post – Atarsuma, District Dholpur with same intentions, illegally entered into the house of Mani Ram s/o Shayam Lal and demanded Rs.50,000/-, when the victim showed his incapability pay, accused persons robbed jewelers items from the women and short dead Jitendra s/o Mani Ram.

     

    On the day of incident at around 10.00 pm when Jetendral was sleeping in the room, he heard some chattering outside.  He woke up and came outside the room.  He saw Moti s/o Nawab Singh, Hemant s/o Kunj Bihari, Devendra s/o Sardar, Hariom s/o Sardar Caste Thakur were beating Jeetu’s mother and Bhabhi.  When Jeetu came to rescue his mother and Bhabi, the accused persons started beating abused used bad him.  They robed all Jewelers from his mother and Bhabhi.  Then Jetendra, his mother and Bhabhi came outside. FIR has not been registered.

Dalit Activist was Burnt Alive Since He Lodged Complaint Against Accused

    Diseased Birdichand and his family members wife Santosh Devi, 32, Ashok Kumar, 6, his son, Kumari Manisha, 4, his daughter and a one year old daughter Monika, belonging to the Hindu Balai Community and residing in Dhani Baldawali village, Srimadhopur Taluk, Seekar District, Rajsathan State. He was working as a labourer and earned for the livelihood of his family.

     

    Their village is dominated by the Rajput community people. Once he along with 13 of his friends went to work in a brick factory in Haryana in a vehicle. On the way, in Mahenragarh the vehicle met with an accident and two children died on the spot. Some of them were injured and were admitted in S.M.S. Hospital for their treatment. The vehicle they had traveled had no insurance.

     

    Thinking that he would lodge a complaint against the vehicle owner, the owner tried to console his friends who were injured in the accident. On 13/11/2005, the vehicle owner (belonging to Rajput Community) came to hospital to meet Gyarshilal, 28, the friend of his who also was injured. He was in the hospital writing the complaint against the vehicle owner. Seeing that, the owner gave a bag to Birdichand and went away. Later he came to the hospital and accused him of the theft of a bag. He refused the allegations. But the vehicle owner had planned to take revenge against him. On 3/12/2005, at about 8.30 p.m., Rohitashva Singh, 32, and Ram Chandra Singh, 58, came to their house and called him out to enquire him about the theft of the bag. He came out of the house and he was taken by them. He did not return home.

     

    On 4/12/2005 in the afternoon some of the villagers said that they had seen a dead body half burnt at the foot hill. The body was identified by the clothes by his wife. It was the body of Birdichand. Then the villagers along with the wife of the deceased informed the police and the body was taken for the postmortem report. FIR was registered in Cr. No. 232/05 under the sections 302/ 201 IPC and SC/ST POA section 3(2)(v) in Ajitgarh Police Station. After the postmortem the police forced the family members to cremate the body immediately. On the third day after the incident, out of the 6 accused the police arrested only the 3 accused.  The Rajputs are threatening the family members continuously.

     

    The Government had sanctioned Rupees one and a half lakhs as compensation. When they approached the District Collector for the same he said that he did not have the budget for this. The family had not received any compensation from the Government mandated under the SC/ST (PoA) Act 1989. The case is pending in Seekar District Court.

Banarasi Devi’s grandfather in law was given a land for free by Village head Kamal Pandey. But Kamal Pandey’s brother Rameswar Pandey had sold the land to Mahesh Saha. On 29.11.2005, when Banarasi Devi was working at home, Mahesh Saha and Bhanu Saha came with spade to the field of Banarasi Devi to plough the field. Then Banarasi Devi objected them to plough the field and said I will allow you to do anything after government order only. Then Mahesh Saha started to abuse her in the name of caste and Bhanu Saha tried to hit her with the spade. By the time Renu Devi a relative of Banarasi came to her help and held the spade and she got hurt in the stomach with the spade.(Renu Devi was 8 months pregnant and doctor said the baby inside her moved down because of the attack so she has to be under supervision till the delivery). Mahesh Saha then put Banarasi down on the ground and hit her severely when she became unconscious Maheseh was taking her. Buy the people reached there and protested so he left her on the ground and left. When Banarsi Devi regains her senses she went and filed FIR. But the accused is threatening the victim to kill them.

A Dalit Family Attacked over a Land Dispute

  • Summary::

    Banarasi Devi, 45, w/o Suresh Paswan, 50, belonging to Dusadh(SC) caste, at Lakhan Sarai, Patpata PO, Lalganj Ps., Vaisali Dist., Bihar was a politically conscious lady and strong supporter of LJP( Lok Janshakti Party). Her village is dominated by the Non-Dalits esp. Bhumihar, Pandit, Yadav, Kurmi, etc. She fought for her right to have land because and her family lived there for many years. The ancestors of Suresh Paswan stayed there hundreds of years ago in the same land.

     

    The Non Dalit village members mobilized Kamal Pandey (Teli upper caste) who was a landlord, against Banarasi Devi. And so the main accused, Kamal Pandey had sold the plot of land to Mahesh Sah (Bhumihar caste) very cunningly because he was the supporter of theBJP(Bhartiya Janata Party). He did not like her to live there. And so there were a number of quarrels occurred. Mahesh Sah and his son Bhonu Sah, 20, did not want her to stay in the village. 

     

    On 29/11/2005 while Banarasi Devi w/o Suresh Paswan, was busy doing her household work, Bhonu Sah and Mahesh Sah came to plough the plot of land. Bhonu Sah started digging the ground with a spade. When the victim tried to stop him doing so till the order from the government comes she would not allow them plough the field. He abused her for being a prostitute. He started destroying her hut, by then Renu Devi, her sister in law who was pregnant for seven months came and on the process of stopping him, got hurt in her stomach with the spade. She ran back home. Then Bhonu Sah striked Banarasi Devi down and put his knee on her breast and started beating her. As a result she fell unconscious. Then he tried to carry her away to rape her but stopped by the villagers. In spite of that he managed to run away with the three of her he goats and two hens.  On the same day when she came to the consciousness, she went to the police station and filed the FIR no. 246/05 under the sections 147, 148, 447, 323, 392 IPC and SC/ST POA ACT section 3 (10). Arwind Kumar Shahi, SI, inquires the case in Hajipur police station. No compensation has been given. The case is being inquired. No charge sheet and case diary are presented to the district court.
