Rape of Dalit girl

    Victim Amrita Kumar d/o- Ramji Ram had gone to see a marriage procession on 12.06.2011 at 08pm. There accused raped her, victims brother came to know about the incident and informed in the family. Then the victim’s family came in search for her and the accused left her and runaway from the place.

    Legal Standard Breached:

     

    1.       Rape is a criminal offence [sec. 376 IPC r/w. sec. 3(2)(v) SC/ST (PoA) Act].
    2.       Punishment for voluntarily causing hurt- Whoever, except in the case provided for by voluntarily causes hurt, shall be punished with imprisonment of either description for a term, which may extend to one year, or with fine which may extend to one thousand rupees, or with both [sec. 323, 334 IPC].
    3.       Assault or use of criminal force on a woman with intent to outrage her modesty [sec. 354 IPC].
    4.       Uttering any word or making any gesture intended to insult the modesty of a woman [sec. 509 IPC].
    5.       Being in a position to dominate the will of a woman belonging to a SC/ST with intent to dishonor or outrage her modesty [sec.3 (1)(xi) SC/ST (PoA) Act].

    3.      Voluntary Causing grievous hurt – whoever, voluntarily causes hurt, if the hurt which he intends to cause grievous hurt [sec. 325 IPC].

    4.      Rape- A man is said to commit ‘rape’ that, except in the case hereinafter excepted, has sexual intercourse with a woman without her will or without her consent [sec.375 IPC].

Ban on taking water from the public tap in Kurukiyaampalaym

  • Summary:: Shanmuganathan(18), is a student of the Periyar Law College, Periyar Nagar from the Hindu Arunthathiyar community, Nallichettipalayam village, Annoor panchayat, Coimbatore District. On 12.06.2011 he went to Kurukiyaampalayam village to take drinking water from the public tap for his sister’s puberty function. This village is 10 kms away from his own village. When the villagers saw him taking water, they prevented and shouted at him saying “Chakliyar should not take water” from this tap. Shamuganathan replied,”This is a public tap, from which anyone can take water”. The villagers replied that,” the place will be polluted,, and in the past they had only poured water into the containers whereas at present the chakliyars have come directly to collect water. The dalit youth attempted to talk further, the villagers especially women shut his mouth by saying that “they would drag him to the Police Station and lock him up by giving false complaint that he misbehaviored with the women”. Shanmuganathan returned home without taking any water. VasanthaKumar a friend of Shanmuganathan heard about this incident and went to the same village on 12.06.2011 with his friends from the Periyar Dravida Kazhagam. Again the villagers belonging to the chettiyar caste prevented him from taking water. Thirumeni, the Inspector of the Annoor Police Station who heard about this and warned the villagers that cases will be filed if they continued their objections.The villagers said that “if the chakliyars take water, the water will be polluted, the rain will be insufficient, thefts and robberies will increase, the goats and cows will not become pregnant. Therefore, they should not take water”. They also assaulted Radhakrishnan special wing police for condemning their action. Vasantha Kumar unmindful of all their statements continued to take water and was assaulted by Dhamodaran chettiyar and other women. Based on the complaint given by Vasantha Kumar, only Dhamodaran Chettiyar was arrested.

Rape on a Dalit woman

    Mahemadpur village is ten k.m far from taluka place Chanasma, there are families of Dalits, Patels, Rabaris, Thakor and Kumbhar living in the village. Most of the villagers survive on agricultrual and animal husbandary. Patesl are economically and educationally well to do. There are 55 houes of Thakor community and they are dominating over the Dalit community. Dalits have to depend on Thakors and Patels. The girls are less educated as compared to boys in almost all the community. The victim of this case belong to shcedule caste.

    On 10-6-11 the victim went to Patan for shopping and came back in the evening. Thereafter, she was going to attend natural call, at that time accused Jayantibhai came there and he was drunk. While passing through he shouted at the victim and used abusive and filthy words regarding her caste. He tried to molestrate her and rape her but she shouted so the accused hit  on her forehead.

    Thereafter, she was taken to the hospital, she got four stiches, police came there to take her statement.

Murder of a Dalit youth- Kishangad, Ajmer

  • Summary:: Kaluram Medhbasi s/o Nathuram Medhabasi was a resident of village Mohonpura, he had a van and used to give ride to people and earn money. He had drinking habit, and because of that most of the time does not come home at night. On 6.06.2011 night at 10pm Kaluram got a phone call and went out by his van and did not come home, his family thought because of his drinking he did not come. On 7th police found a dead body near Mondabari road and identified as Kaluram’s body because he had written his name and his village name on his hand. Police informed his family and they identified him. Kaluram’s head was crushed and on the neck there was grip sign and they found Kaluram’s van in a secluded place with blood mark on it. On12.06.2011 police arrested Amar Chandra Medhbal for the murder of Kaluram. Amarchandra was trying to sell the land of Nathuram so Amarchandra and Kaluram had conflict.

Illegal Occupation of Dalits Land Tirrupur

    Kethanar village, is in Palladam Taluk, Villupuram District. Dalits of the Kethanar village and the nearby villages Mansaipalayam, Vaavipalayam, Panapalayam, Mathanayakanpalayam and other villages, are allotted 67.57 acres of land. This land was taken from Mrs. Rukumani w/o Srivasa Naidu. But the Panchayat president Harigopal, threatened the dalits and forcefully took away their lands by paying meager amount of Rs. 5000 to Rs. 10000. For this illegal land abductions, Harigopal, is supported by Balasubramani, Pongalur Palanisamy and Home Secretary Tripathi and Tiruppur District Collector Samayamoorthy. Narayanasamy belongs to Naidu community, who championing the cause of dalits land rights, filed many petitions with the District collectorate and the State government regarding this illegal occupation of lands allotted to dalits. Since they state government negligent to take action against the culprits, Narayasamy staged many hunger strikes in front of Tiruppur collectorate, Tamilnadu State Secretariat and in front of the Chief Minister Residence. But till date no action against the perpetrator Harigopal and his associates who threatened Dalits and forcefully and illegally occupied the lands allotted to them.
