Denial of Housing Patta

    Kallakuli, Veruvadasalaigal, is in Coimbatore Southern Taluk, Coimbatore District. Kallakuli is home to around 250 famililies with 900 people, belonging to Dalit Arunthathiyar community and some Muslim families. They have been living in this locality since 1947. Most of the people of Kallakuli are working as Scavengers in the Municpal Corporation, Scavengers in the nearby streets, and also as Masons and daliy wage labourers. They have been denied Housing patta for a long time. Their petitions seeking housing patta, street lights, drinking water facilities were largely ignored by the district administration. Pakshiraja Studio belongs to Veruvada Chettiyar is located near to Kallakuli. Now the descendants of Veruvada Chettiyar are claiming ownership over this land. They are forcing and intimidating the residents of Kallakuli to vacate the land. Thiruganam son of Veruvada Chettiyar is threatening this people to vacate and migrate to other places.  Palanisamy MLA asked this people to vacate this locality, with a promise for provision of housing land in Chettipalayam. But Chettipalayam located 30 km from the city limit, will jeopardize their livelihood. Kallakuli residents fear that Chettipalayam being a village, they may subject to caste based discrimination and atrocity. Hence they refused to vacate the land and to relocate to Chettipalayam.

    Thiruganam, Palanisamy and other influential people of the dominant caste hindu community are compelling the people to vacate the land. Resident of Kallakuli formed a association under the name of Subash Chandra Bose Residents Welfare Association , to raise a collective voice to protect their rights.  Thayanithi Maran, called up the leader of the Subash Chandra Bose Residents Welfare Association and asked them to vacate the land and to move to Chettipalayam. Police and District Administration are negligent to take action against the perpetrators who threatens the dalit residents to vacate the land. Till date the Dalit residents of Kallkuli are not provided Housing Patta and other basic facilities for their decent standard of living.

Mob Attack and Property Stolen belongs to Dalits

    T. Prabhakaran (32), resident of Nitchampalayam, Perundurai Taluk, Erode district, belongs to Dalit Paraiyar community. He is working as a District Distributor of Auromax Couriers Intl Ltd. On 26/06/2010, evening, as his Maruti Esteem got punctured, he was repairing it at a puncture shop near Velusamy Private Hospital. At that time one Vellaisamy belongs to Pandaram community, who came in TVLS motor bike, hit his car causing damages all over the front portion of his car and the damages to the tune of Rs.10000. Vellaisamy who caused this accident, sustained minor injury due to this accident and his TVLS bike front tier got damaged. When Prabhakaran asked Vellaisamy to pay for the damages, Vellaisamy called Selvam, District president of Kongu Vellalar Kounder Peravai to come to the place of incident. Prabhakaran called Vijayabalan, the District President of VCK Party to the place of incident. On bebalf of Vellaisamy around 50 Kounders gathered and argued in favour of Vellaisamy. Vijayabalan and other VCK cadres spoke in support of Prabhakaran. The heated conversation led a scuffle and both the groups started attacking the opposite. During this scuffle, one Selvan belongs to dominant Kounder community, snatched away the Cell phone and 3.5 pound gold chain of Prabhakaran. The mob also snatched away Rs. 10000 from Vijayabalan in the midst of the scuffle. Prabhakaran and Vijayabalan were man handled and sustained injuries. The caste hindu mob verbally abused the dalits referring derogatory regarding caste name.

     

    Injured dalits informed the Perundurai Police station about this mass atrocity commissioned by the caste hindu mob. But SI Valarmathi and other police men who arrived to the place remained a mere spectators. Again another 150 caste hindus joined the mob and attacked the Dalits and VCK Cadres who gathered in support of Prabhakaran. Later the victimized dalits filed a complaint with the Perundurai Police station. A case was registered against the perpetrators. But the negligent police officials failed to arrest the perpetrators regarding this atrocity.

     

    Later this case was CLOSED by the DISTRICT VIGILANCE AND MONITORING COMMITTEE as MISTAKE OF FACTS.

     

    Legal Standard Breached:

     

    1.       Whoever is guilty of rioting, being armed with a deadly weapon or with anything which, used as a weapon of offence, is likely to cause death, shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both. [Sec. 148 of IPC].
    2.       Causing grievous hurt with dangerous weapons is an offence punishable under section 324 IPC, and any person who commits any offence under the section 324 IPC shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to five years and with fine. (sec. 3(2)(v) SC/ ST (PoA) Act).
    3.       Voluntarily causing hurt to and assault or another person is an offence Sec.323, 326, 342,355, 34 of IPC
    4.       Whoever  commits,  the  offence  of  criminal  intimidation  shall  be  punished  with imprisonment of either description for a term which may extend to two years, or with fine, or with both. (Sec. 506 of IPC).
    5.       A person, who is not a member of a Scheduled Caste or Scheduled Tribe, who intentionally insults or intimidates with intent to humiliate a member of a Scheduled Caste in any place of public view, is guilty of an offence under the Act ( sec. 3(1)(x) SC/ST (PoA) Act).
    6.       Whoever commits theft shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both. [Sec. 379 of IPC].
    7.       Whoever, being a public servant but not being a member of a Scheduled Caste or Scheduled Tribe, willfully neglects his/her duties required to be performed by him/her under this Act, shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to one year [sec. 4 SC/ST (PoA) Act].
    8.       No citizen shall, on grounds only of religion, race, caste, sex, place of birth or any of them, be subject to any disability, liability, restriction or condition with regard to - the use of wells, tanks, bathing ghats, roads and places of public resort maintained wholly or partly out of State funds or dedicated to the use of the general public. (Art. 15(2)(b) IC-FR).
    9.       No one shall be deprived of his/her right to life or personal liberty except according to procedure established by law. No one shall be subjected to arbitrary detention or imprisonment [Art. 21 IC-FR, Art. 9 UDHR, & Art. 9(1) ICCPR].
    10.   Everyone has the right to life, liberty and security of person [Arts. 3 UDHR, Art. 6(1) ICCPR & Art. 5(b) CERD].
    11.   No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment [Art. 5 UDHR and Art. 7 ICCPR].

Police Atrocity and False Accusation Thatchanallur PS

    C. Rajkumar, (23) resident of Alaguneri Village, Trinelveli Corporation, Trinelveli District, belongs to Dalit Pallan community. He is working as a farm labourer. His relative Mani of Chattirampudukulam, was arrested for the murder of one Madan and three others belonging to dominant caste hindu Devar community. Hence Rajkumar visited the jail to meet him. Police of Thatchanallur Police station, remanded Rajkumar in the pretext of enquiry, tortured him for two days under police custody. He was also implicated in the Madan Murder case and kept beind the bar. When he came out on bail, Police again arrested him and implicated him under many cases. The police department charged him under GOONDAS Act and again put him behind bars.

     

    Alaguneri and other nearby villages are prone to caste violence. In the last 5 months, the police department who were bias infavour of Devar community, implicated many Dalit youths under false cases and arrested them. Thatchanallur Police are allegedly filing false cases against Dalits to counter their assertion. Rajkumar was brutally tortured by the police department and no action was taken against the erred police men of the Thatchanallur Police Station.

Encroachment on Dalit land in Mattapparai

  • Summary:: Murugesan (50) s/o Palani @ Palaniyappan is living with his wife Tamaiyanthi, he resident at Mattaparai village of Dharapuram, Tiruppur District. He belongs to dalit community, he working as a postman in local area. His wife Tamaiyanthi was working as a daily agriculture worker. His father palaniyappan was purchased 2.60 arcer land in the year of 1925. He cultivated another 1.3 arcer land near to his land and paid beema receipt from 1941 to till date. On 20.05.2010 Murugesan was given petition in Jamapanthi meeting for patta to those 1.3 arcer land which was cultivated and beema receipt paid by him. When this matter was known by caste hindu Sellamuthu gounder and other 10 dominent caste persons including women were came to his land. Meantime her wife tamayanthi was working in that land, they forced her to evict from the land and they yelled at her calling abusive words including casteist language. On 24.06.2013 Tamayanthi given complaint in moolanur police station. Police said that VAO was out of the village if he come we will enquire the case. After long struggle one police was came and enquired then he made a compromised with accused.

Devaraj brutal attack case

  • Summary:: In Nallichettipalayam, Annur Taluk, Coimbatore District, Dalit hamlet was named after E.V. Ramasamy as Thanthai Periyar Nagar long time back. Arundathiyar youths in this village formed Periyar Youth Charitable Forum and in the name board, they added Dr. Ambedkar and Periyar photo and kept at the entrance of the village. In Nallichettipalayam, nearly 300 families of Caste Hindu Chettiyar Community ( Most Backward class) are residing and around 150 Dalit Arundathiyar families living in this village. Dalit Arundathiyars are denied access of Panchayat office, Bus Stand and Temple. In this midst dominant caste hindu Chettiyars banned the banner having the portraits of Periyar and Dr. Ambedkar. In sequence to this episode, Dalits were physically assaulted and derogatory referred by caste, by the dominant caste hindu Chettiyars. Complaint has been registered and 3 chettiyar youths have been arrest. Two weeks later counter case has been filed against Dalit youths and were arrested.
