Murder of a Dalit youth at Rosanai

  • Summary:: Vempoondi village is in Tindivanam. Near by this village, NSF Hotel is in the Trivannamalai Main road. Since in this main road, many long distance buses passby for refreshments, many nearby villagers station here and sell eatables other small items in buckets. On 24/04/2010 NSF Hotel owner Arif Bhasha told Dalit woman and fruit seller Ms. Mayavati, not to sell at this place and asked her to vacate the place and derogatory referred regarding caste. Even after this episode he verbally abused her several times. On 02/05/2010, Dalit youth Mr. Ramana belongs to Vempoondi Village, asked Ariff Basha, why you scolded Mayavati and asked her not to sell sitting at this place?. In reply Ariff Basha, asked ‘ who are you to ask me?. What can you do even though you are in Viduthalai Chiruthahal Katchi?. I am also District General Secretary of Manithaneya Makkal Katchi. This leads to heated argument between them. In this midst, Brother of Arif Basha and staffs of the Hotel, attacked Ramana with the Dosa turner and Iron pipes. Ramana was severely wounded at the backhead. As he lost lots of blood, he fell unconscious. On Knowing this tragedy, Ramana’s mother reached the spot, and took him to the Tindivanam Government Hospital. Doctors in that hospital asked them to take Ramana to the Puducherry kaalapet PIPS Hospital. On reaching PIPS Hospital, after due checkup doctors told that he was brought dead. On 03/05/2010, on receiving the complaint, Tindivanam Rosanai Police Station arrested Arif Basha, his brothers and his hotel staffs totaling 8 members.

Brutal attack on Dalit youth

  • Summary:: Palanichamy(40) S/o Arumugam, Cheeniyappan(33) S/o Palani, Palanichamy(40) S/o Aarumuham,Chenniyappan(33) S/o Palani, Jegadeesh(23) S/0 Palanichamy,Vijayakumar(20) S/o Duraisamy,Uthiraasu(37) S/o Kuppan, Ramesh(22) S/o Duraisamy of Ramamoorthy Nagar, Moothaampalaym village, Kaangeyam block, Tirupur Dt, participated in the music program organized on 01.05.2010 on the event of the festival of the MaaKaaliyamman Temple. The cycle belonging to Palanichamy did not have a lock, therefore he parked his cycle in the Temple for safety reasons. Kumar and Suresh belonging to the dominant Goundar community noticed this and objected that an arunthathiyar’s cycle cannot be parked in temple. Palanichamy explained the reason. The dalits and Goundars started arguing. The youth from the dominant caste immediately removed the air from the cycle. Veluchamy Gounder who was present there threw the cycle and remarked few derogatory words about the Dalit community. Ravi gounder and Mani gounder assaulted Palanichamy and asked what work do Dalits have in this Temple Murugesh, Uthuraasu, Ramesh, Vijayakumar, Chenniyappan heard Palanichamy’s cries and prevented the gounders from assaulting Palanichamy. The gounders joined together and beat the Dalit youth and dragged them to Thangadurai, Sub-Inspector of Police, VellaKovil Police Station, who was stationed in the village for Police protection for the festival. The Sub-Inspector failed to enquire the Dalits but instead shouted and beat the dalits with the PVC pipe. When the Dalit youth were returning home they were intercepted at the Paraiyur colony and assaulted severely by the goundar youths. Palanichamy and Cheeniyappan were the most affected. On 02.05.2010 the injured got treated at the Kangeyam Government Hospital and filed the complaint at the Police Station. Chenniyappan was referred to the Tirupur Government Hospital for further treatment for his injury in ear. The Police refused the Dalit youth to file a complaint and suggested for a compromise. As the Dalit youth persisted, an FIR was filed on 4th May 2010.

Social boycott of Dalits

  • Summary:: Raj S/o Selvaraj belongings to Adidravida community and resident at Jayakondam, Gingee, in Vilupuram district. On 24.03.10 he and his two friends Sakthivel S/o Rangasamy, Muniyapparaj S/o Rangsamy were came by cycle. On meantime Desingu and Tirumalai who is tha caste hindu persons came by bike had a accident. On 26.03.2010 dalit youths went to participated Mariyamman temple festivel which was located in Vanniyar area and organised by vanniar community. About 15 vanniyar people came with sickles, steel pipes and knives. Raj and his friends were derogatory referred by caste name and beaten and stabbed by the mob. After this incident dalits were socially boycotted by vanniars, even medicals, ration things were denied to provied to dalit community in local shops. The police filed FIR under IPC. Only three Vanniyar have been arrested and counter case filed against the Dalits.

    Bablu  Ku Ravidas(17) s/o- Sajjan Mochi is the resident of village Nagamba in Sadar PS of Hajaribagh Dist.

     

    Accused Bajan Mehta had small business in Delhi; he asked and convinced Bablu’s parents to take him to Delhi to work for his business. They agreed to send him to Delhi with a condition that Bajan Mehta will give Rs.1000/-per month. He took Bablu to Delhi since then Bablu has never contacted his parents. The accused also have never sent the money to them. When they asked him to send Bablu back to home, he did not send and abused them. Till now Bablu has not come back.

     

    Legal Standard Breached:

     

    1.       Punishment for voluntarily causing hurt- Whoever, except in the case provided for by voluntarily causes hurt, shall be punished with imprisonment of either description for a term, which may extend to one year, or with fine which may extend to one thousand rupees, or with both [sec. 323, 334 IPC].
    2.       Everyone has the right of life, liberty and security of person [Art. 3 UDHR and Art. 5(b) CERD].
    3.       General recommendation 19 of CEDAW relates to gender-based violence and recommends amongst other things that states should take all legal and other measures that are necessary to provide effective protection of women against gender-based violence including effective legal measures (including penal sanctions), preventive measures (including public information and education programs) and protective measures. 

    2.      Voluntary Causing grievous hurt – whoever, voluntarily causes hurt, if the hurt which he intends to cause grievous hurt [sec. 325 IPC].

PUSHPA – PHYSICAL ASSAULT AND SEXUAL HARASSMENT

    Brief Details of the Incident:

    Ankuri Pushpa (20), D/o. Krishnaveni SC Madiga by caste is native of Chintapalli (M), Nalgonda District. She pursued her studies till 7th standard. Later she joined as servant-maid on 13th September 2003 in G.N Agarwal (60) a retired Major Colonel’s house at H.No. B-206, Sainikpuri, Hyderabad. Pushpa used to cook and look after household works and stay there itself. For a year everything went on well. At that time there were two other girls staying in the house. The harassment to Pushpa started once the other girls left. G.N Agarwal used to often harass Pushpa to satisfy his sexual lust.  He black mailed her by showing her nude photos taken without her knowledge. As he was old, he forced Pushpa to message his sexual organs and later forced her to satisfy his lust. Likewise he continued his sexual assault on Pushpa by threatening her of dire consequences. G. N. Agarwal’s brother B. K. Agarwal resident of Calcutta also used to forcefully have sex with Pushpa in the same manner as he used to come frequently to his brother‘s house. Whenever Pushpa refuses to do so and say that she will go away, they used to blackmail her with her nude photos and beat her. 

    On 23.04.10 morning, B.K. Agarwal came from Calcutta along with another girl and told Pushpa to teach her about the manner in which she does sex and also told her that she will be moved to Culcutta. As she refused, both G. N. Agarwal and B. K. Agarwal beat and punched her with fists in delicate parts, caused her bleeding injuries and kept her in a room. Pushpa escaped with the help of the girl from Culcutta. Later she called the police over mobile phone and the police rescued her immediately.

    Based on her complaint a case was registered in Kushaiguda PS on 23rd April bearing Cr No. 273/10 U/s 376,324,506 of IPC and 3(1)(12) of SC/ST (PoA) Act. The victim was sent to Gandhi Hospital for treatment and was discharged on 24th April. 

     ACP- Malkajgiri being the IO has recorded the statement of the victim i.e. On 26th April and has taken the victim to the house of Agarwal, but failed to search his house. The police have done good job. The victim has stated that almost all the rooms are fitted with close circuit cameras; the computer is loaded with films shooted through the cameras. As stated by the victim a big sex scandal is going on, therefore immediate raid be conducted to procure the evidences.
