Padarthapuli panchayat is home to nearly 30 Dalit Arunthathiyar family of 100 people. During 1996, panchayat election, votings of these 30 Arunthathiyar families was transferred to Ramanuthu panchayat, which is 3 kilometre away from their settlements. This transfer lead to many hardships for the Arunthathiyar families. They are deprived of proper street lights, drinking water facilities. Elected representatives are negligent to fulfill their basic needs. To avail the benefits of government schemes, they have to walk long distance to reach Ramanuthu panchayat. They were not provided Identity Card to get jobs under 100 days NREGA Programme. Nayakkars of this panchayat due to their political influence, transferred their votes without getting the approval or their opinion in this regard.
These 30 families are not having proper road facilities, they are discriminated and omitted regarding provisionof benefits regding government schemes. Hence they were filing petitions with the District Magistrate, Tahilsdar, and Member of Legislative Assembly, to rejoin these 30 families back to the Padaruli panchayat, for the last 2 years, in vain.
Saravanakumar, resident of Kodipallam village, Chidambaram Taluk, Cuddaore District, belongs to Dalit Paraiyar community. He is working as a Lecturer in Annamalai Univerisity. Oli Mohammed, resident of the same village, received Rs. 2 lakhs from Saravanakumar by leasing out his 2.5 acres of land located in Kodipallam. Due to financial constrains Mohammed decided to sell the land to Saravanakumar. Knowing this, Muthaiyan, Sivalingam and Murugasen all belongs to Dalit community and Kodipallam village, demanded Mohammed to sell the land to them. But Mohammed refused and told that he will sell the property only to Saravanakumar. Being disappointed by this, all the three men started exerting pressure on Saravanakumar. They instigated the villagers to seek the land for construction of free houses. Hence they filed petition with the District collector and Tasildar seeking the Mohammed’s land for provision of housing patta. Mohammed rejected the request of the District Administration. Due to further financial constrains Mohammed sold the land to Saravanakumar. Muthaiyan, Sivalingam and Murugasen, who were not able to tolerate this, out of jealous, organized the Kangaroo court and ostracized Saravanakumar. Hence the villagers were prohibited to speak with Saravanakumar and not to have any contact with him. And announced that the defaulters should pay a fine of Rs. 5000.
Saravakumar reported about this ostracism to the district collector. The district administration organized a peace meeting and warned the three culprits not to indulge in ostracism.
P. Ganesan, working as a night watchman at the District Judge Residence in Thiruchendur Taluk, Thoothukudi District. He belongs to Dailt Arunthathiyar community. On 14/11/2009, due to heavy rain, rain water entered the Judge residence. After noticing the house is soaked with rain water, Ganesan with the help of two Office Assistants of the Judge, removed the water entered into the house. On 15/11/2009, 2.45pm, Judge K. Subramaniam, belongs to dominant caste hindu Konar community, enquired about the incident with his two assistants namely Kandhasamy and Marriappan. Subramanian verbally abused Ganasen, saying “bugger, what you were doing until the water entering the house? . Then he slapped Ganasen for not of his fault. Ganasen, unable to bear the humiliation, went to the Court building. To add further woes, Subramanian forced Ganasen to work from 15/11/09 to 17/11/2009 without giving him any break for food and denied him permission to drink water. Hence on 17/11/2009 evening Ganasen file a petition with the Senior Judge seeking justice in this regard. On 16/11/2009, Judge sent a memo alleging Ganasen for dereliction of duty and asked him to report within two days. Ganesan filed a petition with the State Human Rights Commission, Adi Tamilar Peravai and SC/ST commission regarding this. No action was taken against the District Judge for the physical assault, verbal abuse and torture.
M. Kumar, resident of Keelavadi Natham, Chidambaram Taluk, Cuddalore district, belongs to Dalit community. He is the Panchayat President of keelavadi Natham Panchayat. He was dismissed from the Postion, alleged of misappropriation of NREGA funds. The accusation are as follows – payment of wages under NREGA 100 work scheme to one deceased woman; paid NREGA salary to the cook of a school, who is registered as present in school; the people who visited him in the jail to bail him out, were also registered as working in NREGA 100 days of work scheme. All these accusatios were based on the accounts maintained by the Clerk of the Panchayat, Pandiyan. The clerk forged the records as if Panchayat President Kumar approved all these misappropriation of funds. Even though the witnesses gave affidavits in favour of Kumar, and the people disclosed that they did it on their own without the knowledge of the President Kumar, District Collector Mr. Rajendran and his incumbent Mr. Sitharaman executed the Dismissal Order. M. Kumar was dismissed under under Section 205(1)(a) of Tamilnadu Panchayats Act 1994.
Ramalingam, President of Eraiyur Panchayat, Thittakudi Taluk, Cuddalore District, belongs to Dalit community. He was implicated by the District Collector Mr. Rajendran for surplus expenditures. Being one of the biggest panchayats and located close to national highway, this panchayat incur heavy expenditures for its maintenance like, 150 street lights, ambulance facilities, 24 hand pipes, and 4 water storage facilities. This involves recurrent maintenance expenditures. Having met those expenditures, Ramalingam was charged with surplus expenditure under Section 205(1)(a) of Tamilnadu Panchayats Act 1994.
T. N. Selvaraj (57) resident of Nilali, Ellappalayam Pudur, Gangeyam Taluk, Tiruppur District, belongs to Dalit Arunthathiyar community. He is Ex-CRPF Military man. He returned to his native Nilali, after being in Coimbatore for the last 25 years. He is residing in his native (Nilali) for the last one year. He is owning a Limestone producing unit in his home town. Since his son is residing in Aandipudur, Selvaraj used to go to Aandipudur every day in his motor bike. On 12/11/09 3.30pm as his bike got punctured, he was returning from his son’s home by walking. While he was on his way back to home, one person aged around 30, (later came to known as Loganathan Kounder) unknown to him, came by a bi-cycle and asked him dis-respectfully saying, “ bugger where is your bike”. Selvaraj replied that it got punctured. Loganathan started abusing him saying” don’t you give respect to the upper caste people?, how dare you a dalit walk infront of us? you are having tea in the tea shop with crossed legs in the midst of kounders; I would have slapped you with the chappal yesterday. Then he boastfully told that he is a influential person in this locality. When Selvaraj asked him to mind his own business, Loganathan tried to slap him with the slipper. He verbally abused referring derogatory regarding caste and shown no respect for Selvaraj’s age. He threatened to kill him if he happened to see him again, He told that henceforth you should not sit in front of us (caste hindus), need to give respect while he is see caste hindus on the way.
Selvaraj who felt humiliated by this encounter, lodged a complaint with the Tiruppur Superintendent of Police Ms. Shanthi IPS. But the SP failed to take any action on the complaint given by Selvaraj. Again on 16/11/09 filed a complaint with the DRO. DRO told that he will forward this complaint to the SP and asked Selvaraj to approach the Udiyur Police station regarding this. Noticing the official negligence, Selvaraj sent a postal complaint to the District SP, DSP, District Magistrate, District Adidravidar Welfare department, Chief Minister Cell, State SC commission, and State Human Rights Commission. After two weeks, Udhiyur Police personnel gave a copy of the FIR. On 07/12/09, DSP conducted an investigation. Since there is no witness for this atrocity, police department failed to take action against the perpetrator.
