Village Kasma is located in Aurangabad district of Bihar state. It comes under the territory of Kasma Police Station. The Dalits of MiyaBigaha village does not have toilets in their house so they go for open defecation. Also Dalits are being exploited and are bound to work on low wages in the fields of dominants. Dalits are helpless to work on low wages as they are dependent for open defecation, for gazing theircattles and for their livelihood.

On the other hand dominants takes the poor situation of Dalits as granted and they keep on exploiting them. Particularly women and girls from Dalit community are more victimized and sexual exploited by the dominant caste. PunamKumari is one of the victims of such incident.

Victim PunamKumaria 15 years old girl, D/o ShivnandanBhuiyan, R/o Village- Miyabigaha, KasamTaluk, of Aurangabad District, which comes underKasma Police Station of Bihar state. Her father is a labour and they do not hold land of their own. The family belongs to SC community.

Accused Md. Imran (Abid), 25 year old, S/o BakhtawarMiyan, , also from the same Village- Miyabigaha, KasamTaluk, of Aurangabad District, which comes under Kasma Police Station of Bihar state.  He belongs to Muslim Religious Minority group.

On 11-02-2017 in the evening around 07:30 PMPunamKumari went outside of her house for defecation. The accused was already there knowing that Punam will be coming there regularly. As soon as she reached, Imran went towards poonam and forcibly held her from behind and threatened her if she screams out. He shuts her mouth and dragged her in the wheat field nearby and forcefully raped her. Though she screamed continuously for help but no one could come to rescue her at the time.

After a while, Victim’s cousin brotherNagendraManjhi was going for defecation almost in the same direction. He heard the female scream for help and rushed to the spot. There he saw accused was raping her sister. By looking at Nagendra accused tried to run away but Nagendra chased him and caught him at the place of incident.Nagendra also called upon other villagers and forcibly took the accused towards his house as the accused was trying to escape. The Family members instantly informed the police about the incident. They also started scolding the victim.

In the meantime, the victim could not bear what has happened to her and was feeling very humiliated. She immediately rushed home and set fire on herself fearing social stigma due to rape. She was almost half burnt by the time the family members noticed her and somehow they rescued her in extinguishing the fire.

Immediately the family members rushed to Rafiganj Hospital by taking burnt and unconscious victim. As victim’s condition was very serious,she was referred to Magadh Medical Hospital for better treatment. They could rescue her life. On the same day around 23:15, in presence of victim’s father ShivnandanBhuiyan, the police official took victim’s statement; and on 12-02-2017 FIR has been registered. So far victim has given Rs. 2.50 lakhs as compensation.

Sonvarsha middle school is locateed in the village Sonvarsha, district of Gaya of Bihar state and it comes under Paraiya police station area. There are 50% of Scheduled Caste students who come from surrounding villages are studying in the school. At present 150 students are enrolled in the school. The details of the teaching and non-teaching staffs of the school are as follows: 03 cooks namely Rampyari Devi, Teyarti Devi and Shanti Devi and 05 teachers namely Mr.YugalKishorPrabhari-Principal, Mr. Naveen Kumar, Ms.Nirmala Devi, Ms.Poonam Devi and Shiv Kumar-accused.

The victim Puja Kumari is a 16 year old minor, daughter of ShambhuChoudhry belonging to Pasi caste (Scheduled Caste) R/o Sonvarsha village, PO- BalaBigaha, PS- Paraiya of Gaya district of Bihar State. Pooja was a student of class 8 of Sonvarsha middle school. She was a regular student and very committed in her studies and scores good marks. The accused Shiv Kumar S/o, Raj Kumar belonging to OBC community caste is also from the same village and a teacher at Sonvarsha middle school.

Like every other day, on 25-11-2016 Friday also, Puja have gone to school and was giving annual exam. During the exam her exam sheet had got detached, so she went to office room in the school and asked a teacher who was there Naveen Singh for adhesive; he then sent Puja to Shiv Kumar who is also a teacher in the school. When Puja asked Shiv Kumar for adhesive, he asked her to take it from the room above. As he directed, she also went up to the room to take adhesive. After taking adhesive, when Puja was coming down from the stairs, Shiv Kumar came and pulled Puja into the room which was adjacent to stairs and closed the room from inside. He started to threaten Puja that if she screams he will kill her, if she tells anyone about the incident then he will shoot and kill her parents too. By saying this he forcefully pushed Puja on the floor, naked her and raped her for 10-15 minutes. Still out of pain, she started screaming.

By hearing Puja Kumari’s scream her schoolmates Raviranjan also known as Fonu Kumar s/o Vijay Das and Abhishek Kumar s/o Vinod Yadav have pushed and opened the door and saw Shiv Kumar raping Puja kumari. Thereafter Puja Kumari somehow wore her clothes and ran away to her parents who were cutting the crops in the fields. And she told everything to her parents about the incident. Puja’s father Sambhu rushed to the school and started asking why he has done this to his daughter. On this Shiv Kumar ignored him and shouted by saying he didn’t have time to talk and asked him to come tomorrow and immediately he went off by his two wheeler.

In the meantime, the villagers also came over there to school and started shouting in front of the school. They were inquiring with the other teachers about Shiv Kumar and started fighting with them. The teachers also started arguing with the villagers it continued for long time so the day gone in that and finally they returned back to the village.

On the next day on 26-11-2016 Saturday Shambhu along few villagers reached the school at 9:00 am. But Shiv Kumar was not available. He met with another teacher Naveen Singh and told him that he wants to meet the Principal of the school. Naveen responded that the principal is on leave so asked him to come on Monday. But Shambhu urged that he wants to speak to the principal as it is related to his daughters dignity. Then he was made to talk over phone to the principal Yugal Kishore. Shambhu narrated the whole incident about his daughter Puja’s rape by Shiv kumar to the principal. Principal responded that he is away and asked him to come on Monday and he also promised that he will inquire the incident.

The same day on 26-11-2016 after knowing about the incident the watchman of Paraiya Police Station Mr.LalBahadur Yadav s/o Mukhlal Yadav, R/o Sonvarsha, PO- BalaBigaha, PS- Paraiya of Gaya district of Bihar state, has suggested ShambuChoudhry and his wife Gyanti Devi (victim’s parents) to file FIR in the police station. On this the villagers interfered and manipulated the victims’ parents saying that it is our internal matter and we will inquire it and then we’ll inform the Police In-charge’.

On 28-11-2016 the Principal YugalKishor organised the meeting with the victim Puja Kumari and her parents ShambhuChoudhry and Gyanti Devi, teacher Naveen Singh, accused Shiv Kumar and NanhuChoudhry who is the ward member of Sonvarsha village, the witnesses of the incident Raviranjan Kumar/Fonu and Abhishek Kumar who witnessed the incident and few villagers. He inquired the victims and witnessed and during the inquiry it was found that Preeti was raped by Shiv Kumar.  Immediately the villagers who gathered in the meeting started beating Shiv Kumar for his misbehaving with the minor girl. No sooner, MunniPaswan s/o Doman Paswan of Sonvarsha village rang the Police of Paraiya Police Station and informed about the incident. He also informed to some media about the incident. Within 45 minutes the police and media arrived at the spot and took the accused Shiv Kumar, victim Puja Kumari, her mother Gyanti Devi and her father ShambhuChoudhry to the Paraiya Police Station. The police arrested the accused Shiv Kumar and sent Puja Kumari to Chandouti Women Police Station along with her parents. There Sub Inspector MeeraKumari took Puja’s statement and registered FIR and thereafter SI MeeraKumari took Puja Kumari to Prabhavati Hospital at Gaya for medical inspection. On 28-11-2016 around 4:45pm medical inspection has been done.

The police have taken statement of the victim u/s 164 and have provided the copy of FIR, medical report, final report and daily report of case proceedings to the victim’s family. The police has charged the accused u/s 376 of IPC, 4 POCSO Act and 3(1)(x), 3(1)(w), 3(2)(v) SC/ST PoA Act, 1989. As a result the accused is in the prison.

Kasturba Gandhi BalikaVidyalaya(KGBV) is located in the district Gaya of Bihar state and it comes under Chankand Police station of the state.Around 40% of Scheduled Caste(SC) girl students studying in the school. At present 100 girl students have been enrolled in the school, out of which 22 girl students have discontinued their educationafter this cruel incident. The teaching and non-teaching staffs of the KGBV school are as follows: female teachers are 05 in number, there are 02 night guards and 02 cooks; and is directed by Mr. Madhav Prasad who is also the in-charge of Rahim Bigaha Middle High School. Mrs. Vidyapati is the present warden who mistreats the girl students particularly from Dalit community and makes them to clean the hostel and toilets and also make them to do the oil massage for her. The victim PreetiKumarione of the students from Dalit community had the target for the warden this time to do all these menial jobs.

The victim Preetiwas living at her grandfathers’ house of village: Kandi, PO: Bithosareef, PS: Chandouti Block, Dist: Gaya, and studying in Kasturba Gandhi Balika Residential School, Rahim Bigaha from past three years. Preeti was 13 years old studying 8th Standard. She was very calm in nature. She was being mistreated by the warden by making her to clean and cook food. She was even not allowed to go home during the holidays and only once or twice she was allowed. When she was at home also she was very quiet and unwell. She could not say anything to her parents/grandparents. So they did not take it seriously. The warden hasnot allowed Preeti to stay at home for more than 2 daysby sending hostel guard Shanti Devi to bring Preeti to the school. And whenever her parents come to meet her, she was never allowed to meet them separately in person and always she was accompanied by the teachers/guards.

It was revealed that the warden Vidyapati was having an affair with someone and during the night a vehicle used to come to the warden room frequently. Victim Preeti have seen the warden and a man together once and she also raised question about him. So since then Vidyapati was torturing her very badly and targeting the victim as she has seen them.

About a month before the incident, Mrs. Vidyapati the warden of KGBV had blamedPreeti for theft of her money and emotionally victimized her a lot and also blackmailed her using that theft incident. On the night of 28-10-2016, after having dinner all the students went back to their rooms. But the warden called only Preeti to her room to get done oil massage.Preeti went to warden’s room but did not return back. The same night the vehicle also had come to the warden room.

Then the next day morning on 29.10.2016, Preeti’s body was found on the railway track behind the KGBV School. It was cut into pieces. It was informed to the school by some passers- by but even after the information no teacherhave informPreeti’s family or relatives. One among the students phoned to her own family and informed about the incident and through them Preeti’s family got to know about this. Immediately Preeti’s family went to the incident place and saw her body was lying in a very bad condition. Her hands were tied in rope and there were injuries of cut on her body.  In the meantime the police also was informed about this incident and came to the spot. Thereafter Preeti’s body was sent for the post mortem.

The same day on 29.10.2016 the complaint was given by Preeti’s grandfather and lodged FIR. FIR was registered no. 301/16 u/s 302, 201, 34 IPC and 3(1)(r), 3(2)(v) SC/ST (PoA) Amendment Act against the Warden Vidyapati and hostel guard Shanti Devi as she also was in support of Vidyapati.

Even after the FIR, the police didn’t arrest the accused warden Mrs. Vidyapati; After the protest by NDMJ team and the victim’s family the police arrested the accused and after 24 hours she was released. So far no further action has been taken.

From Kandi village around 35-40 girl students were studying in KGBV but after such incident happened with Preeti, from then onwards 22 girls have left their studies from there. Warden Vidyapati has been transferred to some other place. So far the accused has not been sentenced any punishment. In this case there is negligence of responsibility from the police; the victims are not able to get justice and till date police haven’t completed the enquiry procedure.

on dated 14-1-2018 at approx:10 pm victim vikram was kidnapped due to previous jealousy by accused balraj,sunil, leela, meera, sanjay, jeeta and others. accused took him at their house and blocked his hands,mouth,legs with the rope and beaten very cruley with the iron rods, lathi and others weapons. accused did unnatural sex and inserted iron rod in his private parts. police informed to victims faimly through village watchmen and also abused on casteline. victims reached at accused jeeta\'house where two policemen and dharmbir panch already thier. victims took to vikram at their house in half unconscious condition where vikram told to his mother and aunty about the tortured by accused. after that vikram uncoscious victims took him hospital where he was dead due to seriuos injure. 

Fafar village is located in Gaya district of Bihar state. In this village there are two categories of community is residing: OBCs and SCs. Dalits (SC) are financially weak and no land for them. So the people from OBC are dominant there and keep on exploiting the Dalits in the village. As Dalits are of poor financial status and have poor education qualification they can not raise their voice for the domination and atrocities. Particulary women of Dalit community are very often subjected to exploitation by the dominant group. Almost all the officials of Fafar village not capable of carry out the responsibility assigned to them agains the dominant caste. The SC colony is so polluted due to sewage water flow from the dominant caste houses. Even though the village head belongs to Dalit community he is just a mere puppet of the dominant group of the village and not able to do anthing regarding the existing problem of Dalits. Whatver the problems happen to Dalit women the head will be watching and does not take any steps same happened to this case also where a Dalit woman ws physically harassed by the

Victim Minta Devi aged 35 years old, w/o Ajay Paswan residing in the Village Fafar, PO&PS- Guraru; Gaya district of Bihar state. She has three children two boys and a girl.She carries out labour work along with house keeping for her daily wage.

Like every other days, on 19-11-2016 at 7:00 am victim Minta Devi was sweeping her house and patio. She noticed the sewage water (mixed with cow dung and cow urine) is coming from Ramraj Yadav house to Minta Devi’s door step, also a large amount of cow dung is kept near the door step of victim Minta Devi. Minta Devi objected to this to Syama Devi w/o Ramraj Yadav and questioned why you have done that in our house. On this Ramraj Yadav abused victim in a filthy language. Immediately Minta Devi objected her for using abusive language. By hearing this accused Syama Devi made generic comment and said you stupid Harijan, how dare you to teach us how to talk and keeping on abusing her; victim was also resisting to their comments for a while. Due to her resistance, the whold family came and attacked her. She has been physically attacked by Ramraj Yadav, Randhir Yadav s/o Ramraj Yadav, Syama Devi w/o Ramraj Yadav and Nilu Devi d/o Ramraj Yadav. They did not stop with that. Nilu Devi D/o Ramraj Yadav brought a sharp javelin and tried to attack on victim’s neck; victim stopped the attack by her right hand and got a deep cut on her right hand finger. She was screaming and trying to escape from their clutter but was not able to free herself.

Whe she screamed loudly Minta Devi’s husband Ajay Paswan woke up as he was sleeping and came out from his house and rushed to rescue his wife from accused’s clutter, but he was also beaten up very badly by accused family.Many villagers were watching the incident as mere spectators but only 4-5 peoplecome forth to stop them and to free the victims. After being freed up victim Ajay Paswan lifted her wife and went inside the house and closed the door from inside. The perpetrators didn’t stop here, they even followed them to their door step and started breaking the door and abusing them, they also threaten them to come out from the house otherwise they will burn the victim’s house.

The victims Ajay Paswan and Minta Devi sneek out from the back door and rushed to Guraru police station. The police station incharge asked them to wait for station accountant as he was not there. After a while victim Ajay Paswan and Minta Devi saw that accused Ramraj Yadaw, Randhir Yadav s/o Ramraj Yadav, Syama Devi w/o Ramraj Yadav, Nilu Devi d/o Ramraj Yadav and Ranjay / Gaya Yadav nephew of Ramraj Yadav are coming on the bike to police Station. Accused Ramraj Yadav and Syama Devi registered their case immediately as soon as they arrived police station whereas the Ajay family was made to wait to register the case. After registering the accused case the victim’s case was registered. Ranjay / Gaya Yadav, nephew of Ramraj Yadav is quite close to police, due to his influence the police did not register victims’ case at first hand.After the FIR, victim Minta Devi was sent to Guraru government hospital for treatment.

On 24-11-2016 Ajay Paswan phoned Rajit Kumar – DHRD and informed him about the incident. After getting the information the FF team went to Fafar village on 25-11-2016. The FF team finds that, there is street road of 10 feats in between accused Ramraj Yadav and victim Minta Devi’s house but till date no sewage channel has been constructed. About 6 feats of street have been encroached by Ramraj Yadav; apart from this, on the remaining street accused family flow out the sewage water from their house.

The fact finding team also digged the other information that there was a similar incident happened six months back 19.11.2016 before this incident, the two family had the dispute for the matter of sewage water. Then the victim Minta Devi made complaint in the police station. But accused Ramraj bribed the police officilas and closed the case. But could not receive much information on the previous case.

So far police have not made any arrest regarding this present case, neither did the victim receive any compensation from the administration. The police have registered the case for the name sake. The police process has been diluted by Mr.  Ranjay / Gaya Yadav due to which the police is not taking the case seriously.
