The victim Elina Kandi, D/o Sarat Kandi, Village- Sirikoili, Block/PS- Nimapara, Dist- Puri, belongs to SC (Bauri) community. She has 100% permanent speech and hearing impairment. She was continuing her studies in 8^th class at Patitapaban Seva Sangh, Chanarapada, Nimapada. Due to the lockdown (Covid-19) in Odisha in the month of March 2020 all the educational institutions were closed. Elina had to return home. During this period, the perpetrator Ajay Kumar Nayak aged about 17 raped her by taking advantages of her disabilities. Subsequently he repeatedly raped and she was pregnant. The matter was not disclosed because of the disability of the victim; she feared to disclose before anybody.

After few months the victim’s mother and cousin came to know about her pregnancy and for the confirmation they went to the nearest private hospital. After few tests, the doctor said that she was nearly 7 or 8 months pregnant. After that it was difficult to identify the accused as the victim could not express. After many efforts for days, she indicated the accused. After knowing this, Elina’s father Mr.Sarat Kandi met father of the accused and demanded justice for his daughter but he refused to admit that his son did this kind of obscene activities.

            Then Victim’s father Mr.Sarat Kandi informed ALVM. The team immediately reached the victim’s place, conducted a fact finding. A written complaint was lodged by Sarat Kandi which was registered in Nimapara police station case number 287 dated 22.11.2020 u/s 376 (2)(h)(l)(n), 376 (3) of  IPC, 3 (2)(v) of SC & ST (PoA) Act and  6 of POCSO Act. The accused is in Juvenile home, Berhampur, Odisha and the investigation is still going on. 

Devendran (43)is a resident of Thiruvalluvar town, Aluthupalayam village panchayat of Modakkurichi Erode district and is residing with his family.He has been working as the State General Secretary, Tamil Nadu in BahujanSamaj Party (BSP), the national party led by Mayawati.

He was extending his support for the candidate Mr. Boopathiof BahujanSamaj Party (BSP) in theModakkurichi constituency in getting votes for him. And on 31-03-2021 at 08-30 he along with the BSP candidate had canvassed in the Aruntathiyarresidentials located in Keeramadai village in Inchampally panchayat to collect votes in support of them. Bhupathi, SivagiriBorasapalayamDamodaran, KodumuduIchchipalayamRanjithkumar, ArachalurVinoba Nagar Sekar and KeeramadaiArundathiyar were among the more than 50 people who came there at the time.    Meanwhile the dominant caste people/non-dalit came there and abused Boopathi and the canvassing team in filthy and abusive language referring to the caste names. The caste mob also tried to attack them and also threatened to kill him.

Devendran, along with 5 others including Boopathilodged a complaint at the police station. FIR was registered under the Prevention of Atrocities Act-2015 at the Malayampalayam Police Station with the Crime No: 87/2021 U / s 294 (b), 506 (i) IPC r / w 3 (1) (r), 3 (1) (s), 3 (2) (va). On 02-04-2021, Ramshankar and Viswanathan were arrested and remanded in custody.

1. There are more than 60 Scheduled Caste Paraiyarcommunity living in Ottanandal village, Thiruvennallur circle, Villupuram district. More than 250 Scheduled Castes are inhabited by non-Vanni community.

2. It has been the custom of the Dalit people to hold the Mariamman Temple Festival in the month of May every year. Similarly, the festival has been organized in May this year and has been held for three consecutive days from 09th to 11th. On the 12th, sports competitions were held for the youth and boys in the Dalit area and a prize giving ceremony was held. At around 08.30 pm that night, the police arrived from the Thiruvennallur police station and confiscated the mic set, the loudspeaker and the vehicle and took them to the police station.

3. The next day at around 11.00 am on 13.05.2021 the village leaders in the colony were Santhanam (70) S/oKannan, Thirumal (60) S/oManikkam, Arumugam (65) S/oKoothan, Murugan (38) S/oVenkatesh, Thiruvenkadam (55); S/oPitchai, Kumaran (28) S/oRamasamy went to the Thirunavur police station with about 10 persons in his presence and confiscated the mic set, amplifier and all the vehicles. Police Inspector Pandian told them that it was wrong to hold the festival without permission. On his way back home at around 08.00 pm to get a reply from Ramesh (28), (Vanniyar Caste), S/oRamalingam, the branch secretary of the BJP, intended the persons in stopping the festival.

4. The next day on 14.05.2021 at about 09.00 am the village leaders in the colony were Santhanam (70) S/oKannan, Thirumal (60) S/oManikkam, Arumugam (65) S/oKoothan, Murugan (38) S/oVenkatesh, Thiruvenkadam (55); In the presence of S/oPitchai, about 10 people have appealed to the village leaders of the Vanniyar community, Balakrishnan, Ramalingam, Purushottamman, Gokulraj and Ramasundaram about the incident that took place the day before. Santhanam, an elder in the colony, said that this would not happen again, and that it was not possible to apologize to them. The village leaders in the colony apologized to all the youths and youths in the Vanniyar community saying that they should apologize for any problem. Suresh (20) S/oGovindaraj, a youth from the Vanniyar community then slapped Murugan (38) S/oVenkatesh.

5. After that the members of the Vanniyar community complained to the members of the colony. Later, Kumaran (28) S/oRamasamy from the colony lodged a complaint against members of the Vanniyar community.

यह घटना जिला ऊना के रामपुर के वार्ड न० 2 की हैं. यह गांव जिला मुख्यालय से 1 कि०मी० की दुरी पर है इस गांव में बाल्मीकि  जाति में से रजनी देवी स्पुत्री टिक्का रहती है. रजनी देवी के पिता टिक्का कमेटी ( NAC ) के जमादार हैं. रजनी देवी की तीनों बहनों की शादी हो चुकी हैं. एक बहन छोटी है. एक बहन SDM ऑफिस हरोली में नोकरी करती हैं. दो भाई अभी छोटे हैं.रजनी देवी मनापुरम गोल्ड बैंक में नोकरी करती थी. रजनी देवी जिस बैंक में नोकरी करती हैं. उसी बैंक के सामने नारायणी आयुर्वेदिक क्लीनिक में लवकेश नाम का लड़का  काम करता था. लवकेश गावं डोहग तहसील बंगाणा का रहने वाला था. लवकेश नाई जाति से सम्बन्ध रखता हैं. लवकेश की उम्र 29 साल की हैं. लवकेश ने M.com तक पढाई की हैं. लवकेश रजनी देवी को पसंद करता था. रजनी को यह बात शिव कुमार नाम के लडके ने बताई थी की लवकेश तुम्हे पसंद करता हैं.रजनी देवी ने इस बात के लिए साफ़ - साफ़ इंकार कर  दिया लेकिन लवकेश ने धीरे – धीरे रजनी को अपने प्यार के जाल में फंसा लिया. लवकेश ने दिनांक: 10.06.2017 को रजनी को शादी का झांसा देकर पहली बार रजनी देवी के साथ शारीरिक सम्बन्ध बनाये. दिनांक: 07.07.2017 को लवकेश ने रजनी देवी के साथ बडहाला  होटल सनशाइन  में फिर दूसरी  बार शारीरिक सम्बन्ध बनाये. रजनी देवी ने लवकेश के साथ शारीरिक सम्बन्ध इसलिए बनाये थे क्योकि लवकेश ने रजनी देवी को शादी का झूठा झांसा दिया हुआ था जिस बात का रजनी देवी को पता नही था. रजनी देवी ने लवकेश को शादी करने के लिए कई बार कहा लेकिन लवकेश रजनी देवी की बात में हाँ में हाँ मिलाता रहा और रजनी की बात  को हर बार नज़रंदाज़ करता रहा.  लवकेश ने अपने घर में रजनी से शादी करने की कोई बात नही की थी. ऐसे ही लवकेश रजनी देवी के साथ कई बार शादी का झूठा दिलासा देकर शारीरिक सम्बन्ध बनाता रहा. नवम्बर 2019 में रजनी देवी गर्वभती हो गयी. रजनी देवी ने यह बात लवकेश को बताई तो लवकेश ने रजनी से कहा की हम जांच करवाने के लिए डॉक्टर के पास चलते हैं. लेकिन लवकेश के दिमाग में रजनी देवी के पेट में पल रहे बच्चे को गिराने की जो साज़िश चल रही थी उस साज़िश का रजनी देवी को पता नही था. लवकेश रजनी देवी को चौधरी क्लीनिक में टेस्ट करवाने ले गया. लवकेश ने बबिता नर्स से रजनी का टेस्ट करवाया. बबिता  नर्स ने रजनी देवी को एक गोली दी और नर्स ने वह गोली उसी दौरान नीचे रखवा दी. लवकेश ने रजनी देवी को बच्चा गिराने की दवाई जबरदस्ती ही खिला दी थी. लवकेश ने रजनी को  इकठ्ठी 4 गोलियां खिला दी थी जिस कारण रजनी देवी की तबियत खराब हो गयी थी. रजनी की तबियत खराब होने के कारण लवकेश ने रजनी देवी को उसकी सहेली के घर में कुछ दिन के लिए छोड़  दिया. लवकेश ने रजनी देवी को उसकी सहेली के घर छोड़ते समय गाडी में इंजेक्शन दे दिए और रजनी देवी को उसकी सहेली के घर छोड़ दिया. अगले दिन रजनी देवी ने लवकेश को फोन किया और शादी के लिए कहा तो लवकेश ने रजनी के साथ झूठ बोला की मैंने शादी के लिए घर पर बात चलायी हुयी है तुम थोडा इंतज़ार करो. लवकेश रजनी को कई दिनों तक झूठ बोलकर अपने विश्वास में लेता रहा और रजनी को  ये भी धमकी देता रहा की अगर तुमने इस बारे में किसी से भी बात की तो मैं ट्रक के नीचे आकर अपनी जान दे दूंगा. लेकिन ज्यादा समय होने के कारण रजनी ने 2020 के जनवरी महीने में लवकेश को फिर से फोन किया लेकिन लवकेश रजनी के साथ शादी करने से साफ़ – साफ़ मुकर गया और लवकेश ने रजनी से कहा की तू छोटी जाति में से  हैं और मेरे घर वाले छोटी जाति की लड़की के साथ शादी करवाने के लिए कभी नही मानेंगे इसलिए मैं तेरे साथ शादी नही कर सकता.  फिर एक दिन रजनी देवी लवकेश को मिलने रेलवे स्टेशन गयी और शादी करने के लिए कहा तो लवकेश ने रजनी देवी को लात मार कर धक्का दे दिया और लवकेश वहां से चला गया. फिर एक दिन रजनी देवी ने लवकेश को msg किया  की मैं तुम्हारे घर जाउंगी और ये सब बताउंगी. एक दिन रजनी देवी अपने बुआ के लडके जेकव और सहेली शिवाली  को लेकर लवकेश के घर चली गयी. लवकेश के घर पर उसके माता – पिता थे. रजनी की सहेली शिवाली ने सारी  बात लवकेश के माता – पिता को बताई. लवकेश की मम्मी ने रजनी से कहा की ऐसे केसे हम अपने बेटे की शादी किसी से भी करवा दे. लवकेश की मम्मी ने रजनी से कहा की तू चूड़ी – चमारी हैं हम अपने बेटे की शादी तुझसे कभी नही करवाएंगे और लवकेश की मम्मी ने रजनी को धक्के मार कर घर से बाहर निकाल  दिया. रजनी देवी ने अपने साथ हुए अपमान के कारण चूहे मारने की दवाई खा ली. रजनी के घर वाले रजनी को अस्पताल लेकर गये और लवकेश को फोन किया की रजनी ने दवाई खा ली हैं तो लवकेश ने रजनी के घरवालों से फोन पर कहा की मैं किसी रजनी को नही जानता. रजनी के घर वालों ने ये सारी  बात पुलिस को बतायी और पुलिस  ने लवकेश को थाना ऊना में बुलाया तो लवकेश ने अपनी गलती का एहसास करते हुए पुलिस को यह लिख के दिया की मैं लवकेश रजनी देवी के साथ शादी कर लूँगा.  और प्रीत खैला रक्कड ने लवकेश की ज़िमेदारी ली. लवकेश ने बाद में रजनी देवी को फोन करके कहा की मैं तुम्हारे साथ शादी कर लूँगा तुम अपनी शिकायत वापिस ले लो. लवकेश ने रजनी से कहा की मैं बैंक ट्रेनिंग के लिए अबुधावी जा रहा हु ट्रेनिंग से वापिस आकर मैं तुम्हारे साथ 31.03.2020 को शादी कर लूँगा. लवकेश दिनांक: 24.02.2020 को अबुधावी चला गया और लवकेश ने वहां जाकर अपना फोन बंद कर दिया. रजनी देवी ने दिनांक: 28.02.2020 को पुलिस स्टेशन में लवकेश के खिलाफ FIR दर्ज करवाई. पुलिस लवकेश के घर गयी. लेकिन लवकेश की मम्मी उर्मिला ने DSP से झूठ कहा की हम इसे नही जानते.           DSP ने लवकेश की माता को कहा की आपका बेटा जहाँ भी है उसे यहाँ बुलाओ लेकिन लवकेश ने आने से मना कर दिया और कहा की मैं आत्महत्या कर लूँगा. पुलिस ने बाद में लवकेश को दिल्ली में  रजनी देवी के साथ किये गये धोखे के कारण गिफ्तार कर लिया. लेकिन लवकेश और उसके माता पिता जेल से पैसे देकर छुट गये और लवकेश रजनी देवी को जान से मारने की धमकियां देने लगा. लवकेश ने रजनी देवी के फोन नंबर को बाँट दिया और रजनी देवी को गंदे – गंदे msg करवाने लगा. दिनाकं: 17.08.2021 को रजनी देवी ने शिकायत दर्ज करवाई. लवकेश के खिलाफ केस कोर्ट में चला हुआ हैं.  

यह घटना जिला ऊना की तहसील बंगाणा के गांव त्यार  की है. यह गांव ऊना मुख्यालय से 15 कि०मी० की दुरी पर है. राज्य हिमाचल में जातिय व्यवस्था पर आधारित छुआछूत की घटनाएं थमने का नाम नहीं ले रही है भारत को आज़ाद हुए 70 वर्ष के करीब हो गए है पर ऐसी घटिया मानसिकता रखने वाले लोग आज भी समाज में मौजूद है. घटना सिथित इस गांव में पंझडा (डॉम) SC जाति के 10 घर,  चमार जाति के 60 घर, राजपूत जाति के 4 घर, सन्यार जाति के 50 घर, ब्राहमण जाति के 2 घर, जट जाति के 70 है इस गांव में 2 प्राइमरी व एक +2 तक हाई स्कुल है इस गांव में डिस्पेंसरी भी है व् पानी की भी कोई समस्या नहीं है.

                  इसी गांव में दलित चमार जाति में से सोमनाथ  स्पुत्र स्व: गुरवक्श सिंह  रहता है जिसकी उम्र लगभग 43 साल की है. वह शादीशुदा है और उसकी 2 बेटियां हैं. 1  बेटी शादीशुदा हैं और दूसरी बेटी सीमा देवी  8वीं तक पढ़ी – लिखी  हैं. सोमनाथ की छोटी बेटी का व्यव्हार साधारण हैं. इसी कारण  वह घर पर ही रहती हैं और घर का कामकाज करती हैं. सोमनाथ की बेटी सीमा देवी दिनांक: 16.10.2020 में अचानक गायब हो गयी थी. सोमनाथ की बेटी सीमा देवी अभी 16 साल की नावालिक  लड़की है. सोमनाथ की बेटी सीमा देवी 16.10.2020 को सुबह 8 बजे अपने गावं में दूध लेने के लिए गयी थी लेकिन वापिस नही आई. सोमनाथ की बेटी सीमा देवी को नितिन नाम का लड़का जो की झीर जाति में से था जबरदस्ती उठाकर ले गया था. वह लड़का सोमनाथ के गावं का नही था सीमा देवी ने उस लडके को गावं में पहली बार देखा था.नितिन सीमा देवी को जबरदस्ती अपनी बाईक पर बिठाकर हमीरपुर ले गया. नितिन ने दिनांक: 16.10.2020 को हमीरपुर में एक होटल में किराये पर कमरा लिया और सीमा देवी के साथ गलत हरकत की.  17.10.2020 को सोमनाथ की बेटी सीमा देवी के पास एक फोन था. सीमा देवी उस फोन से अपने घर वालों को फोन करने लगी तो नितिन ने सीमा देवी की सिम तोड़ दी. नितिन ने सोमनाथ की बेटी के साथ काफी मारपीट भी की और उसका मुंह बंद करके कमरे में बंद करके रखा. फिर नितिन ने दिनांक: 17.10.2020 को फिर से कमरा बदल लिया. सीमा देवी के फोन में 2 सिम थी एक सिम तो नितिन ने तोड़ दी थी लेकिन दूसरी सिम अभी फोन में ही थी. उसी दिन सोमनाथ की बेटी सीमा देवी के फोन पर किसी लड़की का फोन आया पर नितिन ने सीमा देवी को फोन उठाने नही दिया और नितिन ने उस लड़की के साथ फोन पर खुद बात की. तभी वहां पर सीमा देवी के पिता सोमनाथ , चाचा . दीदी – जीजा और पुलिस वहां पर आ गयी. और पुलिस ने नितिन को गिरफ्तार कर लिया. अब इस केस की कार्यवाही हो चुकी है और यह केस अदालत में दर्ज हो चूका है.
