Late Sampatrav Ramrav Kale (52), Taulabai (45) w/o late Sampatrav Ramrav Kale and Prabhakar Sampatrav Kale (20) belonging to the Dalit community (SC) are from Balapur Village, Tehsil Beed, Dist. Beed. Savantwadi is a village under the district of Beed in Maharashtra situated at 35 kilometers from Beed in Neknur Police Station. The village is dominated by the Marathas (non-dalits). Closer to the Savantwadi, Balapur is the village where the three families from Paradhi Society belonging to SC community live. It seems that from the time of British the community is accused of theft. In fact they are named as a thief community. It is on that basis, if any theft takes place the Paradhi community is target under suspicion. No matter even if they are innocent they are forced to accept the work of theft.
Under this situation, the victim late Sampatrav Kale s/o Shamrav was alleged to have involved in the false accusation of the theft. On 25.5.2006 late Sampatrav Kale and his wife Taulabai Kale went towards the village Savantwadi in search of a goat. When they reached in the mango groove the accused Dadarav Baburao Sawant and Suresh Baburav Sawant came to them questioning whether they had come to steal their mangos. Accusing them of the theft, the accused brought them to their house and together with Chandrasen Baburav Sawant the accused started charging sticks at them ruthlessly. The victims got fractures in their legs and hands as well. Taulabai Kale w/o Sampatrav Kale got her right hand fractured. The victims were beaten till they were unconscious.
Later on the accused took the victims to the mango groove on the bullock cart and made them lie there with a few mangoes plucked by the perpetrators themselves. Soon after that the accused went to the Neknur Police station and registered the false complaint of the theft of their mangoes. The S.H.O. came on the spot and took the victims to the Neknur Primary Hospital. From there they were admitted in the Civil Hospital in Beed. They were admitted there for five days and on 30.5.2006 at 5.10 p.m. Sampatrav Kale breathed his last. The body was taken for the Postmortem Report on the same day. On 31.5.2006 the dead body was taken to the police station. FIR no. 79/06 was registered in the Nekunur police station u/s 302, 326, 504, 34 IPC and SC/ST POA, 1989 section 3(2)v
On 31.5.2006 NCDHR and Human Rights Commission together with the people of the Paradhi Society staged a Protest against the perpetrators demanding the police to register the case u/s 302 IPC and to register the SC/ST POA 1989. As a result, on the same day all three accused were arrested and the police registered the case u/s 302 IPC and SC/ST POA 1989 (section not known). Dausa District is abundant of Dalit community but a few Dominant caste villagers rule the whole village and majority is pointless. Most of them depend on Agriculture and rest work as daily wages laborer in various sectors. By and large Dalits work in Sikandera in mines of stones. Maya and her younger sister Lali got married to the sons of Chotey Lal, resident of village Ganipur, District Dausa. Maya’s Father in law lied about his sons to be in good profession but after marriage Maya came to know that her husband is not in a government job but works as a daily wage laborer in Haryana. Maya accepted it as her fortune but on the contrary something else was going on in the mind of her in laws.
Soon Maya understood that she has been trapped by her in laws and this marriage was done for dowry. Her in laws showed their real faces and started abusing her for dowry from the very first day of marriage. Maya tolerated all this and did not say anything to her parents. Beyond this her husband Mahesh forced Maya to get some money as dowry. Maya’s in-laws humiliated and tortured her for dowry as they wanted money at any cost even at the cost of Maya’s loss. Her in laws asked Maya for dowry to build a house for them and used dishonorable words for her father. They demanded for telephone to be installed at their home. When this humiliation and torture was unbearable to Maya, she told her father about this humiliation that her in laws are demanding 50,000 Rs. to build another house. Maya’s father was a third grade school teacher and he was unable to fulfill their demand. Before two months from the incident, Maya went to her parental home and denied to go back to her in laws house, she expressed her desire to stay with her parents. After 15 days Maya’s in laws with Lallu Ram, Sarpanch of the village and 10-15 villagers came to Maya’s house and apologized for their behavior. They requested Maya to come home back. Maya went to her in laws on May 2, 2006 with her husband.
Everything went normal for 2 days. After that again they started harassing Maya. On May 19, 2006, Maya’s Aunt Sanjha Devi went to meet her & Lali; she found both of them in very miserable situation. Sanjha Devi made a call to Maya’s father and asked him to call Maya & Lali back. One the following day, Maya’s father met the D.S.P regarding the matter who assured him to help.
On May 20, 2006, Maya and her sister were sleeping in the room when around 12:00 am, her husband Mahesh came and knocked the door and asked to open it as their brother in law has come to meet them. Maya’s younger sister Lali opened the door. Mahesh and other 3-4 men were standing outside. Mahesh entered the room and dragged Maya to another room. Maya’s brother in law was already in that room, Maya’s husband held her hands and clutched her mouth with handkerchief and then her brother in law stripped off her clothes and raped her. Maya cried a lot for help but nobody came to her rescue. Mahesh beat her up very badly. Subsequently three other men raped Maya in front of her husband. Maya became unconscious. Maya’s sister Lali came to help her but her mother in law and husband threatened her that if she helps her, she would also be harassed.
After this inhumane act Maya’s husband carried her out of the room and threw her in corridor. After some time Maya regained consciousness and asked for water. Mahesh came to Maya and asked to clean her clothes to remove all the signs of rape. The following day morning, Lali went to meet Sarpanch of the village and called her father. Lali narrated the whole incident to her father and Sarpanch and asked them to come to their home. Maya’s father went to SP and narrated whole matter. Then with some police officials he went to his daughters and took Maya and Lali along and filed FIR against the culprits.
The Local police registered her FIR under section 498 A & 376 (2) (g) of Indian Penal Code. Soon she was sent for medical examination but the local police did not arrest accused so far due to pressure from them. Many a times Maya Devi and her parents met Superintendent of Police and other police personnel for fair and just investigation. Although perpetrators were arrested, one of them has not been arrested till today. The Local police after completion of investigation submitted challlan before the court.
Husnabad village is in the Kodangal Mandal of Mahabubnagar district in Andhra Pradesh. BC caste people are dominating in this village. Since two years BCs are committing several atrocities on dalits. In this village there are 200 BC families, 30 Ediga families, 20 Sari families, 15 Pottery families, 20 Reddy families, 4 ST families and 120 SC families which are divided on caste basis. The main occupation of ST and SC is daily labour. K.Chennappa has completed his 10th standard and working as agriculture labour. He belongs to Madiga caste (SC). He used to encourage temple entry of dalits and fight against Untouchability, which is prohibited in that village. Goud community people developed grudge against him and also attempted to kill Chennappa.
K.Chandrappa (25 yrs) s/o Sayappa and brother of Chennappa is a agriculture labourer. He has ½ acre land. On 17-5-2006 Chennappa, Chandrappa and Ashok completed their work and coming back home in their bullock cart in the night. They saw person coming on the cycle. Chennappa said, “Who is that person coming on the cycle?” That person is Balaraj Goud who belongs to the Goud caste abused these people saying that “how dare you ask who I am?”. When these three were sleeping in their field on that night Balaraj goud came with his six brothers namely Suresh Goud, Fakeerapu Goud, Srinivas Goud, Mallesh goud, Kistaiah Goud, Venkatesh Goud and killed chandrappa with goddali and injured Chennappa, Fakeerappa and Ashok with rods and cycle chains. Chennappa escaped from them and told about the incident to Sarpanch and the police. The accused were arrested and the post mortem of the dead body was done on 19-5-2006. The case is under trial in a Special court.
Bayyaram village is in the Gajwel Mandal of Medak district in Andhra Pradesh. Reddy caste people are the dominant people in this village. Different castes people are staying in this village. There are 400 Reddys, 4 Vysya, 7 Kamma , 30 Gowda , 30 Mala, 40 Kurmas, 100 Rajaks, 200 Madigas and few people belonging to Brahmins, Yadavs, Telagas. There is a village sarpanch. Congress and Telugu Desam are the dominant political parties. The Sc community people in this village have some land but not enough for cultivation so they are working as laboureres. They also attend the ceremonies and beat Dappu (drum) in the village whenever they are asked to do so. On 4 April 2006, the village servant called Galinka Srinivas, Rajaiah, China Narsaiah, Pedda Narsaiah, Kiran Kumar, Lingaiah all belonging to SC community to attend the cremation ceremony of the B.Adikela Lachavva, mother of B.Penta Reddy as she had passed away. When the six Dalits went to that place as they were called, they saw Muthrajpalle Pothaiah doing that work. When the victims asked why he was doing that work for which the victims has been called for nobody responded. The five people Siva Reddy, Laxma Reddy, Srinivas reddy and two others who were present there used filthy language against the Dalits because they came late. While they were returning home from that place after the insult the accused caught hold of the victims beaten them with chappals kicked and abused them. The victims were hurt badly and they were not able to attend their work for many days.
The victims filed a complaint on 07/04/2006 in the Gajwel police station but the police did not take any action against the culprits. The victims were not given protection and the culprits are constantly threatening them to come for a compromise.On 30 April 2006, Gajwel MRO came to the paddy field of Chippala Peda Narsaiah and removed the fuse of the bore well and locked the switchboard, which is used by him for the irrigation purposes. The accused also came to the field and started destroying them. The MRO did not give any notice and he did that because the Reddy caste people ordered him to do. The Reddys don’t allow these people to use the path to their fields. The barbers of the village refuse to provide services to these people. These people are being discriminated because they belong to SC community.Case was registered as Cr. No. 43/06 U/s 323 of IPC and 3 (1) (x) of SC/ST (POA) Act. Compensation was not paid. And the accused werearrested.
Achanta Bhagya Lakshmi, aged 20 years, d/o A. Chandra Shekara Rao, occ: student, r/o Venakatapuram Village, h/o Bhogolu Village, Lingapalem Mandal, East Godavari District. The victim was studying in the Vennala coaching centre headed by one B. V. S. N. Raju (A2). In the month of May, Venakat (A1), who is her near relative called her to his home misrepresenting that her relatives are waiting at his house. He raped her by offering her intoxicated food. He has also taken her nude photographs and started blackmailing her and threatened her and her family members with dire consequences. He continued his misdeeds further by threatening and putting her in the fear of death, he raped her again in a lodge at Eluru. He was arrested on 30th August 2006.
The victim has been studying in Vennala Coaching Centre since 2005 and in the month of April, Raju asked her to go to vision school on a holiday and raped her in the school. She could not resist him as he mixed intoxicants in a cool drink before rape. She returned to hostel after she gained consciousness. After two days when she was on the way to vision school, a maruthi car with three men and a woman stopped beside her and they showed her photos and cell phone clips of her naked body with Raju. They threatened her to do illegal activities. She was thrice handed over bags which she had to carry to said places. They threatened her and her family.
Venkat and Raju continued to blackmail her with her photos and forced her to have sex with them. Venkat’s friends, Prasad and Gangadhar also tried to assault her sexually. Gangadhar, an auto driver tried to kidnap her with three of his friends but she could escape with the help of local people. Venkat has shown her photos to his friends and this made them to try outraging the modesty of the victim.
The chain of offences committed by Venkat and his friends plainly show his involvement in illegal activities such as smuggling of narcotics, trafficking of women, etc.
