Abetment to suicide and atrocity

    The victim of this case namely Chhaganbhai and the complainant Chakabhai are belonging to schedule caste community. The complainant resides at village Kanesara, Ta- Jasdan, District Rajkot. There are people of different communities living in the village. The accused persons are involved in animal husbandry. On 11-07-2006 the accused persons went with their cows, buffalos, goats and destroy the corps of the victim and complainant. Thereafter, the victim filed complaint against accused. Police proceeded under section 151 of Cr.PC.

    Thereafter, on 14-07-2006 the victim was coming from his farm, accused persons had stopped him and used abusive and filthy words, they also insulted him by stating abusive words regarding his caste. He was also threatened by the accused. Hence, on next day i.e. 15-07-2006 the victim hang himself with fan and gave up his life.

    The complainant had filed FIR against Galabhai Bodhabhai Soriya, Jivabhai Kadvabhai Ratadiya, Rukhdbhai Vibhabhai Soriya, Khodabhai Merambhai Zafda, Mangabhai Sidhabhai Ratdiya and other. The police registered FIR under section 306, 506(2), 114 of IPC and section 3(1)(10) and 3(2)(5) of SC/ST Act.

    Case in Brief:

     

    Background of the Village:

    Uyyuru Mandal, Gandigunta village consists of 600 families (approx.) of which 200 families belong to Kamma caste, 400 families being from other castes.  Kammas dominate this village. 

     

    Socio-Economic-Political Conditions of the Village:

    The dalit families in the village are mostly landless and work as agricultural laborers; hence they depend on the dominant land owning community as wage laborers for survival.   Naturally the dominant caste Kammas exploit the dependant status of dalits to their advantage and oppress them in all ways.

    Summary of the incident:

    Gummadi Sudheer, s/o Hanumantha Rao, aged 40 yrs, Kamma by caste, native of Gandigunta village, Uyyuru mandal of Krishna district is the accused in this case.  The victim, resident of the same village, Ms.Chinthagunta Jhansi Rani, D/o Kanthamma, aged 36 yrs, SC-Mala by caste is a married woman and she has a grown up daughter studying 10th standard.  Few years after marriage her husband deserted her and as such she was staying with her mother in Gandigunta village, i.e., the village where the accused Sudheer lives.  While so, the accused Mr. Sudheer seduced the victim Ms.Chinthagunta Jhansi Rani to have sexual relationship with him.   Ms.Chinthagunta Jhansi Rani, being a lonely woman without husband, reluctantly maintained extra marital relationship with him for the last one year.   In such a situation Mr. Sudheer, the accused started dominating her and controlling her freedom in all manners.  He would not tolerate her having friendly relations with any other men.  With such an authoritative male chauvinistic attitude the accused continually harassed and abused her of having relationship with other men.  He always doubted her fidelity and arrived at the opinion that she was having extra marital affairs with other men. Finally he decided to kill her so that she can never have relationship with others.  On 13th July, 2006 he went to her house and set her ablaze after pouring kerosene all over her body.  Her neighbours noticed the smoke from her house and when they came to her house and tried to open the door, it did not open. They tried to catch hold of Sudheer when the door was opened but he escaped and fled away on motorcycle with other person.  The matter was reported to the police and a case U/s 302 IPC & SC/ST (PoA) Act u/s 3(1)X  was registered as Crime no.106/06 , against the accused on 13/07/06.  The body of the victim was sent for post mortem.

     

    Recommendations:

    1.            Compensation must be provided/paid as per SC/ST (POA)   

                 Act immediately

    1.            Rehabilitation should be provided to the deceased family
    2.            SC/ST Act 3(1)XII  section must be altered in the FIR
    3.            Govt. should take appropriate action on the violence    

                 against dalit women

KIDNAP AND RAPE Sujatha and sony

    Case in Brief:

    G.Vandana resident of Singareni colony, Hyderabad belongs to SC, Madiga community.  She has 3 daughters the eldest got married. Sony (17) and Sujatha(14) the second and third daughters who have completed 10th standard live with her.  Sony is working as a nurse and Sujatha is undergoing nurse training at Heritage Hospital, Khairatabad.

     

    On June 17th 2006, both sisters were waiting at IS Sadan bus stop on their way to hospital. Wajid an auto driver his friend Sadik offered to give lift up to hospital, which they accepted. They were given soft drink with sedation mixed in it and were taken to Moinabad in unconscious state and were confined in a house for 18 days.  They were not given food, water, were beaten up and were repeatedly raped.   They were threatened not to file any case nor inform to parents. Meanwhile victims mother Vandana lodged a complaint that her daughters were missing.   Ms. Sultana, sister of Sadik, one of the abductors learnt that police were on look out for Mr.  Sadik and Mr.Wajid and she alerted them.  Fearing police detection the culprits set free Sony and Sujatha and absconded.

     

    On July 7th, 2006 the victims approached Saidabad police station and lodged complaint of kidnap and rape, on Sadik and Wajid.  Now the accused persons are still at large.  The investigation is going on.

Dalit Farmer Denied Access to Water Resources

    Koppula Manoharam, S/o Narasaiah is resident of Kantepudi Village, Sattenapalli Mandal, in Guntur District of Andhra Pradesh. Who is a marginal farmer and Retd. Govt. Employee. He got an Agricultural land near Nalanda Engineering College at same village. On 12-07-06 at about 4.00 P.M. Chandra Mohan Reddy, Jaysankar Reddy, Sankar Reddy and A.D. Appa Rao, Vijaya Kumar who belongs to forward community obstructing irrigation water canal which leads to Manoharam fields and so when Manoharam questioned them, they started abusing in caste line by saying “Malana Kodaka  amanukuntunvura, nee ekara polam chuchukoni virraveegutunnvu memu thalachukonte ninnu 24 gantalalo finish chestam, and thrown away and trying to beat.

     

    Then Manoharam lodged a complaint at Sattenapalli rural police station. Police registered a case under crime No. 91/06 under SC/ST (prevention of atrocities) Act 3(1)(v)(x).As per the case Sub Inspector of Police S. Sambasiva Rao was registered a case under the guidance of K. Veerabhadra Rao (DSP), B. Sivadhar Reddy (SP).Police were just registered a case and prepared a FIR. Till today no person was examined at seen of offence. But 25-11-06 they referred a charge sheet filed as a non-cognizable and civil nature against the Chandra Mohan Reddy and others.

A Dalit Girl Gang Raped and Murdered Ambarnath

    Megha Gayakwad, the deceased and her family members belong to Baudh (SC) sub caste and from Metal Nagar, Ambarnath police station, Thane District, Maharashtra. The Ambernath police have nabbed the murderer of Megha Gaikwad whose body was found in a decomposed state in the shrubs near Navre Nagar at Ambernath on July 15. Gayakwad worked in a company named Excel. After the work she did not return her home till 12 at night. She was looked for everywhere. When parents could not look for her they registered the case in the Ambernath police station.

     

    The family of Megha undergoes poverty and so she started her work after her matriculation. As per the general information suggests that she had fallen in love with one of the colleagues, Shafeek Shaikh (22) s/o Jahur Shaikh, there who happened to be the younger brother of the company owner Hafiz Shaikh. Since the love story was known to everyone in the company she proposed him for the marriage. This did not sound good to Shafeek Shaikh.

     

    It was therefore, the lover Shafeek Shaikh wanted to get rid of her. He called her once on July 12, 2006 to a lonely place in the shrub after six pm. Thinking that he would have some plans to marry her, she went to meet him there after the duty. As soon as she reached the place, the perpetrators  Shafeek Shekh alias Pappu (main accused), 22, s/o Jahur Shekh; Munna, 30, s/o Ranjeet Yadav, Mohammad Shekh, 25, s/o Mohammad Shekh, Anish Shekh, 22, Hanif Shekh and Hafiz Shekh, 35, attacked her, gang raped her and throttled her till death. After raping her they cut off her palms and burnt her face and below her waist. They tried to hide all the evidences.

     

    The family of the girl Megha had lodged a complaint to the Ambernath police station on July 13, 2006. The FIR no. is 272/07 u/s 302, 201 and 34 IPC. The body was obtained on 15.7.2006 and after the identification of the body, which was sent for the postmortem report at the Central Hospital in Ullhas Nagar. Later on the body was cremated from there.  The three friends Mohammad Shaikh(25), Anees Shaikh(22) and Munna Yadav (30) have been booked under sections 302, 201 and 34 IPC. They have been remanded to police custody.
