Mariamma was working as an agricultural worker. On 04.02.2008, while she was about to go to work, servant of Taapula Rayappa Reddy, aged 57 years, OC Reddy by caste came and said that Rayappa Reddy’s wife has gone to her parents’ place and hence asked Mariamma to clean the utensils. While she was cleaning the utensils in Rayappa Reddy’s house, he entered the kitchen, bolted the door from inside and raped her. He asked her to keep quite by taking Rs. 500/- and threatened her that he would kill her husband if she reveals the incident to anyone. She did not reveal the incident to anyone on that day. Next day, i.e., on 05.02.2008, she narrated the incident to her husband at around 06:00 am. He beat her after listening to the incident. Her in-laws immediately informed the incident to the village elders. They complained in the Pedakurapadu PS. Police sent the victim to hospital for medical examinations. Case was registered.
The incident happened on 02.02.08 at the village of Mahua comes under the jurisdiction of Jumhare Police station in Aurangabad District. At around 5 a.m. Lakshmi Devi w/o Basant Ram and her mother in law Radha Devi w/o Dhaneshvar Ram belonging to Dalit community (Chamar). Krisna Sav, Kunder Sav, Raju Sav, Suresh Sav, Upendra Sav, Sudhir Sav, Balinder Sav, Kanhai Sav, Dileep Sav, Deena Sav, Dinesh Sav, Ramesh Sav belonging to Non Dalit community from the same village started abusing them.
When Lakshmi Devi asked them to leave them alone, Dileep Sav grabed her and tried to rape her. Lakshmi Devi tried to save herself by struggling with Dileep Sav at which point Raju Sav pulled out a pistol and began beating Lakshmi Devi with the butt of the pistol on the arm, shoulder and waist. She was badly injured and her whole side got bruised. The commotion woke Basant Ram s/o Dhaneshvar Ram, Lakshmi Devi’s husband who came to the doorway to rescue her and was also beaten brutally with sticks and abused. In the meanwhile, Upendra Sav brought Kerosene oil and set fire to Lakshmi Devi’s house. Her family ran out and too was beaten badly.
On 09-02-08 F.I.R. was filed u/s. 341,323,225,436 of the I.P.C. and 3(x) of SC/ST (PoA) Act, 1989. So far the victims have not received police protection, and no police officer has begun investigation of the case. No Compensation has been given to the victims.
Ladbai (45) w/o Murarilal Kanjar, Aswini Kanjar (25) s/o Murari Kanjar are r/o Vill/P.S. Choth Ka Barwara, Sawai Madhopur Dist. Police officials under the influence of liquor caught Aswini s/o Ladbai and put up him in the lock up. When Ladbai protested against this, a police slapped and tried to outrage her modesty by pulling her saree. Next Day, a group of 100 people from victim’s community went to the Superintendent of police and made a complaint. As a result, Aswini was released but the police did not register FIR.Through the intervention of court the FIR was registered on 17 Jan, 08.
On 29h Jan, 08, when Ladbai was out for some work, the police took the opportunity to put Aswini in the lock up again and threatened Ladbai by saying that she should compromise or else they would book her son in false case. When Ladbai refused, police booked Aswini in a false case of manufacturing country made liquor. Ladbai went to the court and got bail for his son.
Victims filed a complaint under 190(1-B) of Cr. PC, Dated 17.1.08. u/s 147, 323, 341, 354, 509,506,451,510,330,149,IPC. No action taken against the police officials by district or State authorities.
Deceased Mahendra Sada (45) s/o Chiringi, Naga Sada (55) s/o Pholdev and victim Ghuram Paswan (58) s/o Ramji, the resident of Gaijori Village, P.S/Block- Kushaswarsthan in Darvanga District, Bihar, belong to Scheduled Caste (Mushahar) community.
On 14.01.08 in the evening at about 4.00 p.m. Mohar Yadav, Pholdev Yadav, Chandev Yadav s/o Mohavir Yadav, Tuntun Yadav s/o Mohar, Ram Yadav s/o Bhular Yadav, Bhagewar Yadav s/o Ratan Yadav, Tarini Yadav s/o Prameswar Yadav, Shibu Yadav belonging to Backward Community from the same village went to Mushahar Basti with well armed and gunned down Mahendra Sada (45) s/o Chiringi, Naga Sada (55) s/o Pholo over a land dispute. The perpetrators packed the corpses in a sack and carried it along with them. On their way back they met Ghuram Paswan (58) s/o Ramji belonging to Scheduled Caste community, brutally beat him.
The criminals threatened villager with dire consequence if they reported the matter in the police station. Even they harassed the victims to flee from the village or else they would set the village on fire. Majority of the villagers flew from the village in fear of their lives to the neighboring villages. On 15th Jan 2008 in the morning Chingi Sada, the father of diseased Mohendra Sada, accompanied by some villagers went to Kushaswarsthan police station to lodge complaint; however the station Incharge Shivnath Ram asked them to meet him on the next day. On 16th Jan 2008, FIR was registered u/s 147, 148, 149, 302, IPC & SC/ST Act 3(1) x in the Kushaswarsthan police station.
The majority of the villagers flew from the village fearing further intimidation by Dominant Caste. On 22nd Jan 2008 in the night at about 10.30 p.m approximately 150 people from Mushahar (SC) community staged an infinite protest in front of the office of sub-divisional commissioner Mr. C. Lal Sota against the inaction of the police officials and administration. They also submitted a complaint to the Commissioner wherein they expressed their concerns and grievances. DM, SDM, SP and DSP visited the spot after four days of the crime committed. The police have not yet arrested the accused. The administration has not yet given any compensation or relief to victim family. SC/ST Act not invoked in FIR after the protest it was invoked. Indira Awas allotted for victims (140 families). 7 Accused arrested and they are in the jail. Charge sheet not filed.
